block and I in the morning my ring doorbell had so I went out there and in process of getting a ticket parking grass um and that is an in ordinance and I get where you're coming from on that too because you don't want to have somebody a redneck with a car on Center box for two years in front parking one night soos words for 14 days so okay and to be clear did you receive a warning for parking in the front lawn or and Levi do we issue warnings on parking on the front lawn or we immediately to citation yeah we we do we actually have have to warn and provide a reasonable opportunity if it's on if it's something on private property that doesn't uh doesn't have a negative impact on you know health safety welfare then then yeah we we do have to so for something like that we would have to issue a warning before we site so it's easy to not know which one he didn't finish but that's probably what he didn't finish in terms of paring on long but your points are well made not not so yeah if you if you would share that that' be great thank you and thank you for not taking the whole three minutes you get to go home early um that that's one on each of the things okay you just un pass it that thank you um that's the end of people that signed up but that doesn't mean it's the end of this item so if anyone else would like to address the council we would love to hear from you thank you for your comments and stick around for item 7 for sure okay with that Council we'll move on to the Planning Commission report from Levi okay yeah so there were three items got the at Planning Commission well one one was a public hearing on reone request it wasn't it wasn't discussed or considered but public hearing commercial to RN just due to the circumstances what was going on with with the property exchange they they elected to take the discussion consideration off the agenda so that'll be considered on a future agenda um the also on the agenda was the RM Zone work a workshop on the RM Zone and the Planning Commission did provide some potential amendments to the to the RM Zone that staff is going to work on and bring back to them I wouldn't say that there was any consensus on specific spe ific changes so that's that's why we're we're going to to work on some uh specific language that they can consider and and you know debate and and come to more agreement on and then also there was a workshop on the flag lot ordinance and uh some potential changes there specifically Uh current currently for a flag lot it cannot be considered along an arterior Road and there was there was a discussion of whether to lift that regulation potentially uh change some others as well so staff's going to work on some some potential changes to the flag lot ordinance and bring it back to Planning Commission thank you Levi any question thanks okay next um what I have is Christie Walker from from the Logan City police department and we have Chief Jeff Simmons and so one of you both of you however you you'd like to do this I tried to have her do it but she wouldn't so right behind every good police chief exactly uh thank you for let me just finish a little bit there's new information in the um Team site that we could show on the screen that we got from chrisy didn't make it into the information packet but Levi do you 6.2 if that's what you would like to speak to we're happy to put that up and if you don't want to speak to that please tell it thank you we'll be happy to answer any questions thank you for call us distinguished I called a lot of things never something about code enforcement law enforcement that's right well thank you for letting us have have a few moments here I appreciate your time and we know it's viable uh yes Christy Walker is our 911 director and Brian low here he lives in New York City most of you probably know he's our technology wizard he's amazing he's the one that keeps the Dispatch Center and really our Police Department stadio cellones anything electronic computers uh he's amazing he's not allowed to retire before I so that's the deal we made so um thank you for this time to be here I want you to I want to tell you that we had a wonderful wonderful dispat Center uh we didn't always have it under the roof of Logan City it used to belong under the county but they kind of cut them loose like ORS and so we kind of took them over yeah so they're housing under our roof but they are kind of their own little business they their own revenues their own expenditures um and Logan City's not try to make any money off it they just we just want them to pay for themselves essentially so they dispatch all fire and all police units throughout the valley that includes Highway control cash County Sheriff's Office every Police Department each state university so they're extremely busy and they had the same staff now that they had um even back then so we actually reduced it by one just to give them an emergency raise and that's the plan I want to make they are over worked they are underpaid and they are underst staffed um so they have a group of 20 but right now there's only really 14 full timers with two trainees right now um it's very difficult to become a dispatcher uh I don't know if any of you who ever come to come to the Dispatch Center you're certainly welcome to to watch them in action is really amazing last year alone they dispatched out 58,000 calls for service in the entire Valley in 2011 that was 39,000 and they have the same of course in the last few years everything's become more expensive right equipment um all of it's been been raised but especially we're talking about uh wages so for example Box Elder County they start good dispatches at $27.50 Rich County Little Rich County over there they start their dispatches at $26 an hour uh we start ours at 2285 that's after an emergency raise of $2 uh a couple of months ago we cut a position to fund that because what what's happening is we're having a bit of trouble attracting and retaining Talent very smart people who are able to multitask in order to become dispatchers um so what we're hoping to do is is raise um our Revenue just a little bit we currently every residence in Cash Valley pays $3 a month for services that's been that way since 2013 we're proposing and I think it's up there now you have it in front of you uh a graduated increase over the next five years um a 10% increase for the coming year which is 30 cents a month per residance and then after that a 3% for each subsequent year for four years and that would be approximately a 10 cent raise per month residents so at the end of five years instead of paying $3 for your dispatch Services you'd be paying $371 for residents after 5 years so not ask per month right per month uh yes per month exactly and so that would be per mon so it's a 71 cent raise over the course of five years that would help us um to um compensate our dispatches a little more because just a couple months ago we had as wonderful as our Center is can culture there they can't help but to look a little to the to the to the South here or Sor to the South and see the bigger pay and jump them out to dispat Center so we increased their wages but as you can see we still substantially believe that not try to surpass anybody his Wes but we certainly want to be competitive and within Striking Distance so this uh modest um increase that we're asking for for with certain go a long way toward doing that so that's um that that's our proposal we're happy coun I'll ask a couple if I may so first of all on timing so we're we're talking about this first increase the 10% increase starting in the next Municipal fiscal year yeah July 1 exactly so July for total right okay thank you and I don't I don't I don't mean to be I don't mean to sound like I'm poking at you with this just asking all right so given uh recent events for Logan City to say you know on certain things we're tired of being the county and in all fairness I don't blame Logan City for tiring of being the county whether it's trash collection we've got a fire thing to deal with we've dealt with EMS right um in your crystal ball do you think Logan City will continue to run this out of their operations or do you think this will go to the county at some point as long as we're able to fund it to where it's paying for itself yes I don't think Logan City has any problem with that whatsoever um most plac that we visited we've gone to several city council right now spoken to a lot of Mayers they're actually pretty you know pretty happy with how it's run as I am too Christie's been in position for a year and he made a lot of wonderful changes uh to help that Center Thrive um the if if for example it starts to fall into the redit at that point the city would not be interested in no City really red at that point you might look at either kicking it back to the county because ultimately the county is supposed to run it or it could become a Special Service District where it's a taxing entity on your property taxes so we're happy to keep it but we're not Kingdom Builders in the police department we don't need it Christine we love them but uh yeah but it yeah as long as it's paying for itself then yes loan would have and do you operate City owned real estate offices and so forth so do you pay Logan City I I mean I looked at your your budget that you provided I'm not sure if you're paying Logan City for yeah oper I'm sorry yeah you're the chief police all right so yes there's an assess but any Department City that that has its own Revenue source so the city will build them an assessment basically to help pay for the rent the HR the legal all the other times so that money goes into the general fund of city do you know how much that is uh currently as I said every Enterprise yeah that's Nathan please yeah um answer best to prior to now as well as for this the increase proposal increases what kind of analysis went into that how did we determine like that we're charge for household it's going to be the $3 beforehand and then what know like are we are we on the right track we the res anybody to have the right technology mix person to make that so the thinking was at the time with the countywide garbage collection let's use that as the funding mechanism forac so it's easy for the environmental Department to say okay black garbage can you P1 if you dumpster you B everybody PS a dollar and then a few years in 2002 years later he realized that that wasn't that wasn't getting getting cover so that's $12 and it stayed that way until as Jeff said Till 2013 when the radio project started to to kind of creep into the into the mix and that's one the the third dollar came about to cover that to cover the radio so the radios that that the First Responders be use that the fire department and H use are all funded through the Dispatch Center they don't they don't have to go looking for for for funds to buy any of the r equipment that's all accounting wide sort of Coalition takes care of that that's what that so as far as the the projections this is what this is what finance department city is recommending so that that the the expenses don't exceed the revenues like Jeff said so out do fox elder or rich or Weaver we can't get to that point got keep some people this point so we got and this is this is completely wage wage driven it's area of the budget is just yeah thank you Mr low right yes and so I I'll I'll turn it back to councilman thank you all while I'm thinking of it for your service you provide a very very important service to all of us for our safety and you do a great job um the next opportunity for the the opportunity for the council to uh get on board with this will be in our budget team right out okay next uh let's let's move to what is now item seven but was number 22 this is a workshop to talk about the resolution for the amendment yeah sorry it's the yeah I kind of blew it because I thought we'd just take this up in the budget but however we do have a resolution it's on the agenda Amendment to the yes so I apologize it's not a resolution but it is an interlocal agreement that with amend it's an amendment to the original interlocal agreement okay so I mean they are asking you to approve this and it will go into effect in next year's all right so you have an amendment to an interal agreement no that I suggest we do this but if we show up this the only city that doesn't ra that's it might be that they don't provide the service to us so if they know when you call 911 they ought to know from where you're calling it might be that we become a black hole and they don't take our calls it might be that we want to set up our own 911 dispatch in liid City might be that we want to form our own inter local agreement with other communities yeah I mean along that F I do think that good idea to go ahead and the the opportunity to raise wages for and it's probably cheaper for us to do that other in there's an economy of scale to all of these Services right we we've talked about this it would be silly you know I optimate injust it would be silly I think for nly City to run their own Police Department City to run their own dispat service or City to run their own garbage collection so I don't know that I don't know that we have an opch right while anything practical and it is good to do the resolution or to do the amendment tonight because then they can they can write their budget for next year in so waiting to see and though they know they sort of painted into a corner they they know that's what their budget tolat service in Logan City present okay there's a motion to approve the local agreement from norm and a second from Aaron thank you um I think the one well I think the one in the teams has my name on it instead of the mayor of yes discussion I think there do we have sign agement from them already that was proposed I can't produce it but I believe we have a signed agreement okay I don't have it up yeah my preference is always decided come to us we know what they see so if we have that that's fine um and then this was just the Amendments like I haven't actually read the actual loal agreement I don't know it's a preference I'm perfectly okay still first reading things I don't think they big that yeah so we didn't put first second on resolution you're welcome to certain continue I think if we did that it's always good to know what we would do between now and then and I kind of hit on it I'd like to know if a fair and Equitable fee that we are paying is transferred to Logan City general fund right um we know that wastewater treatment has a chunk of money transferred to the general fund we know that operating landfill we know that we know these things and and and it's all within state code I'm not doubting that but that's one of the things we could look at with the uh well he told us is $200,000 we can look at how how much of our fee is actually going into the Loc City gener you think

this they showed us their income and expenses on the latest thing that they provided lat then we could get into the information so that's yes so the motion didn't necessarily first second so I'll do a substitute for first reading it's not it doesn't have first reading on the agenda so you can continue so there's a sub motion to continue until our next meeting assum okay do I have a second on that second from okay so that's the new motion for us to consider yeah I think your suggestions be good direction St I'd like to see the whole agreement um f said but I think I found it interesting started out disposal related we have to count people somehow so right count our dances you'll find out the library was once that way too and so said it that way yeah kind of summary determination and this is a couple sets but like I think we learn ask questions sure and and and and I'm not sure if if everyone had a chance to read the late breaking information that's now in teams but please do that that doesn't mean answers all the questions if you get lost in the numbers at the bottom of that last thing that putting teams I'd be happy to go through that with you because I don't think it's entirely clear but I think it it it does what what the chief said it was going to do it's 10% increase this year it's 3% increase for the next four years after that but when he talks about the per month charge change versus the year change versus the total month versus the total year it's it got fuzzy for me so um Justin and I compared notes to what Justin had in the information packet to what the chief had in in his L say okay any further discussion I the motion to continue until our next meeting with direction to staff on what you can help us how you can help us prepare saying none is there opposition to voting now seeing none let's proceed with voting those in favor of postponement and or continuation to the next meeting please say I any opposed and motion for continuent passes Justin thanks for helping me stay on the agenda yes sir she okay now we're ready to have a workshop on Code Enforcement ordinance um as we move into this um Garrett thank you for some of the specific things that that you have uh put forth and thank you citizens giving us your input on this um this is going to be an open Forum we don't have we don't have a resolution we don't have a change to the ordinance specifically to consider so this is a this is a chance where we can we can run free with this to try to give some sort of structure to it I'm going to list some topics you might want um and they're obvious and it doesn't mean you can't add to other topics but I I'll throw these out so number one warnings versus citations uh number two snow removal on sidewalks number three uh wintertime parking regulations number four parking on sidewalks number five parking on front yards that it us enough to work on so mayor can I ask a question because on the agenda it just says ordinance 13022 removal of snow for the workshop so we're all for this Workshop I'm gonna I'm gonna say we can talk about any of those things okay I'm just that's that's good clarification yeah I just wanted to clarify okay how we because this has been on the books for a while but we just start forcement I think that's yeah just maybe tell what our policy is or how our is and then maybe how they can get a hold of the

board yeah uh so code enforcement isn't new to nibi but we have we have within the last uh seven months or so hired a code enforcement officer um and uh so so we have enforced our code for years I mean long before I was here and we've we've had before that the city planner what had had always been the the code enforcement officer it just wore that hat what has changed within the last a little over a year is we have uh started being able to uh site for parking before that all went through the Sheriff's department and state code had changed where uh it basically anything within our our city code that is an administrative or or or that that is an infraction uh we can we can site for we don't have to go through uh the sheriff's department for those things and and so in a lot of cases it's more efficient for us to enforce it rather than the sheriff department and we can be you know more proactive about it so that's what has changed uh as far as how we go about enforcement anything within nibbly city code our code enforcement officer is charged with with enforcing sometimes that that means coordinating with our our Sheriff but the most common things that we enforce are our nuisance related codes and uh parking at is kind of the recent one uh the nuisance related code those are primarily focused on private property and I'd mentioned uh you know in response during the public comment period that we we have to provide uh reasonable time for someone to create direct a a violation before we site them and so typically how that works is we send a letter that informs them that they're they're violating the code and gives them a time frame in which to comply with the code and then we follow up and if they comply then we consider it resolved and no citations is issued if they if they don't comply then our first step is is to site them so to be clear that's not a warning that's notification that they're out of compliance and a certain amount of time to comply and then the citation right we call it a notice of violation is what is what we send and and we typically send it in in a letter sometimes it can be verbally some sometimes if if we're able to to talk to the people then we can do that what we found in practice and we and and as we hired the code enforcement officer we thought hey let's let's just knock on people's doors and have more conversations that that happens uh sometimes but we're finding uh a lot of times this is in during the day hours people aren't home and and the letter does does provide very clear this is the time frame um for for you to comply so for the nuisance code and and that's what we've done really for years that's not much different than what we' done in the past uh before I was here uh for for parking and enforcement we we typically don't issue warnings uh if it's parking within the Public Public RightWay um how we've approached that is is if if there is a violation then we proceed with with citation uh we were set up originally or or re recently we we have an actual ticket book uh but most people that have received a citation they receive it in the mail and that's partly just because the limitations of of uh how our system was set up so we we would because we we had we had to find out the license plate number and then we have to look that up and it's you know you have to look on a computer log into a system and then and then write the citation uh now with the ticket book uh our code enforcement officer is able to to site and and you know put it just put it right on their vehicle and then track it later on look up look up all their information all that's track to ensure that you know payments received and so forth and that that parking in the right way just so I'm clear that a citation that's not a notice of non-compliance and that's a citation yeah we we typically just just site for that uh we have considered warnings the if if we do go down the road of warnings that I I think and again we're we're we're new to this and so we're trying to improve our processes as we go but what we've bound with warnings and we have to warn with with the you know on on the people's private property like I mentioned but it takes a lot of additional time for the code enforcement officer because uh it's it's not just as simple as writing a warning and and sticking it on the vehicle uh first first they'd have to look they'd have to have some kind of way in which you know they'd have to have a device to look up their license plate and to determine uh have they received a warning before and if if they already had then they would proceed with the citation if they hadn't then they would warn them and then they would have to track it and then the next time they went out they would have to look it up again and so it it's it it would be significantly more time so just as an example um Evan he he went out this morning morning and he covered almost the whole community in like four or five hours found 12 vehicles and they did receive citations the he probably would have only been able to do half of that this just kind of a rough guess if if it was through the warning system because uh he would have he would have had to take all those extra steps that would have taken additional time and and we're currently not set up for that I he would have to have a mobile tablet so that's an additional expense to the city as well about 12 citations for parking in the street during wintertime hours right well and and it there I think that were those were the only things if he's out and about and he sees another violation he'll site for that as well or or if it's a nuisance type violation he'll he'll follow up with that but that's that was the reason he was out there was looking for for vehicles that were parked on the street does that answer your question Norman or or do you have other kind of follow up so to contact him is he in office hours or phone or email I've had a couple people say like I don't back or yeah yeah so so they can call the office and and he he is a part-time employee so he's not here every day and his hour are uh flexible and a lot of that's by Design so if he had specific hours that he was here uh there there would be there really would be lost time if he s If he if he finds more violation violations that means more time because that's more followup if he goes out there and he only finds one or two people violating our code he doesn't need to work as many hours so he has I mean what we posted when when we posted his position we said 5 to 20 hours and that he's typically within that range and it just depends on the the day and he this isn't his full-time job he works a full-time job which thankfully there's some flexibility with that job of of his hours but it varies from week to week and so when he comes in is it's kind of different depending on the week but he's been effective and and my my experience in supervising EV is he's he's followed up pretty quickly to these often he'll have to answer voicemails the first thing he does when he comes into the office is check his voicemail and call people back I know there's there there may have been times where he hasn't worked for three days so he doesn't get that voicemail for three days but that's that's the approach we we considered well maybe they they talk to me and sometimes I do talk to the to to people if they if they have an issue but a lot of times that's inefficient because I can't speak to the specific case I'm not the one that I'm not the code enforcement officer I can't speak to why they may have received a citation and what the specific conditions were of all of that so that's kind of what we're we're dealing with we have heard a few of those complaints I mean I feel like he's responded quickly from what I've from what I've observed as far as enforcement officer job is there any component education that trct measured or identified education just educating the is he part of that education at all is that not a part of his job as far as it's no not I don't know if he do in the sense that you're you're thinking he he does he does when he speaks with people he informs them and that's that's a form of education but really his job is to go out and enforce the code uh not necessarily to put out you know public service announcements those kinds of things that would be our our office staff he might inform us as of issues that that would go into that but uh but really his primary responsibility is to enforce the code for what type of violation $25 $25 of paid within the first 14 days and then it goes to $30 if if if not was a late yeah and I and I can explain the snow removal one so the snow removal yeah yeah so for for snow removal on sidewalks uh within this the fee schedule there's nothing that calls out specifically remove the vi the um the citation for removal of snow on sidewalks but what is in there is obstructing streets and public ways and so that is what we have put on the warnings that we have sent out we haven't in the time that I've been here we haven't yet cited anyone for that uh but but what we have warned them is that we could uh used for you know obstruction in public Street those that which I believe is like $75 and then it escalates first second and third offense so that's that's what that that's what that's based upon so really it's the same violation as if someone were to uh put a pile of dirt on the sidewalk that people couldn't get by or or in the street that would be the same type of violation uh be because the way that we interpret it is not clearing the Stu that that is that is an obstruction within within the public right of way and we've had other things that fall within that category that so to rectify that you can't just for two weeks we have we always have we always have um and and we also with the snow removal we haven't just we we could we haven't flat outside at anybody the you know when we when we see it out there we've we've issued These Warnings now the amount of time practically that that becomes a little bit difficult with the snow removal we we just issued the warning and we say you know the next time take care of it or else or else you'll be sided is kind of the way that we've we've approached that because every Storm's different and it's not the same as of you know a pile of rocks that you just need to move and it's out of the way yeah I mean when I that my biggest issue is the graduating e schedule and why I is treated any different from parking citation it's 25 bucks cuz the snow 75 15 300 yeah that I mean that that was that was adopted by the council and the Consolidated Fe scheduled the uh the graduated rate is is is just as an incentive to take care of it the first time if it if it becomes an issue then it's then it then it graduates higher of parking for you know that that's just what was adopted there's there's no graduation of it so that that's just how that's just how the fees were were adopted I don't I don't have all the background of why it is that way the council could decide to adopt a fee specific to snow removal on sidewalks that could be different than that because like I said that's a very broad category of obstructing public streets and in some cases may you know maybe it is more egregious than not clearing your sidewalk but that's that was the only category that staff could fit it in so that's why we cited that on those warnings C just see what was thinking I think being a little more specific on some of that hearing specifically maybe some time frames and dates days enforcement help with some of that it's not so vag and you know well well the warnings that have been sent out are are specific they do they do speak to sidewalk but it's clearing to sidewalk but the fee is based upon obstructing public ways so so yeah I mean if the council wants to adopt a separate fee for uh not clearing you know violating this specific of removal of snow that's different that that that's fine is that is that what you're talking about yes they talked about you know we need St M to school we need you know KS me need to be able to walk on the sidewalk safely to school I don't know many kids walk to school anymore but some still new um I think you know when I it's for the majority to good I think that's important Saturdays and Sundays when you don't have school you don't have stuff should there even be infor for that because have less people trying to move on that I'll play Devil's on sidewalks on the weekend not sh make that make a difference I mean I guess had a snow storm but bar even got any snow this year so I'm gonna go to Justin but since you asked the question I mean just again I'm not I'm not s this one way or another but um if you want to read the letters that I received that are in support of clearing sidewalks maybe you've received them as well it's a little bit harder to this day I support the enforcement of ordinance in a room full of people that don't want the ordinance or want the ordinance changed or something which is fine that's all part of the process but I mean I'm not going to read their letters in to the record but if you want to see them or if you haven't received them I'll just balance the equation there are people that appreciate uh ordinance that requires for and I've got I there some changes and clarifications probably treat first and foremost should be educ learning and education cation should just person so and I I I think that's that's fine the uh one thing just kind of additional history one thing that was changed within ni city code and and in the code enforcement section of the code is that there's discretion given to the code enforcement off more much more discretion given to the code enforcement officer of the process that they go through for enforcing the code uh that it used to be more prescriptive of this is this is the warning you sent out this is that what you put in that warning and this is the uh this is how much time you're you give to cure it if if the council wants to provide direction for hey the first offense is a warning I think it would be helpful if that was written into ordinance so it wouldn't be just arbitrary depending on that that's my that's my viewpoint uh so so if if and I think there 's some Provisions in our ordinance that call for a warning for specific violations not really ones that I've dealt with but we could put in there that for parking by if if you want if you want to go that way which again I think I think it would take a more City resources and and in some cases would be would require you know quite a bit of followup but if you want to go that way it might it would be helpful to put it in in ordinance to provide that direction I'm going to go to Justin if I yeah just real quick on the USA how much the citation was and I pulled had Amy pulled me a report this morning and of all the nuisances and everything there's only been uh just over $3,000 in Revenue over the year so far so far since July correct just reminder for Council specifically um I was getting comments that it's hard to hear you as Council if you're not in here all of us hearing you guys okay couple coms online next question that we heard from you I have conversation week ago um Levi know you mentioned when gets just going to mail I think mentioned also he's heard from a couple people that it's just a little hard to get a hold of and that when they left when they try to get a hold of them they haven't heard back so I wonder if maybe that's just something we could reiterate to um you it's just important to people when he does get a voicemail make sure and call them back and and talk with them like that's a few people I've heard sure I did wonder um another question I had based on that conversation was five Lane how do we parking the road things like that work on so we don't we don't enforce uh parking on private Lanes I know there have been a couple instances where there was there was an error that he wasn't aware that it was a private Lane and we did void those those tickets out but uh but no if it's a private Lane we don't we don't enforce we sign maybe in October or know leading up to the date that changes where you can't the street I still think that's something that we should be doing coming up this next fall before they changes like hey just FYI don't park on your don't park on the street after the to maybe we talk like what are the top five Ser two or three or five goers that he typically see the most of and maybe that is a chance for us to do better education maybe run a little campaign over the next you know 6 weeks 8 weeks say hey resents so you know these are the common issues that we're seeing this is why we have them and um you know Please be aware that we'll be either warned or cited for these things I think that pretty easy thing that we can do L we can do I don't know if that's I we already have March newsletter done no so I mean maybe we maybe we have time to do March I'm not going to volunteer for that I'm busy next week but I'm ride back yeah I I think those are definitely good ideas one one thing we had discussed with staff in addition to that idea with of yard Steins like I said it is if we want to to do warnings and as actual warnings where we follow up there's quite a bit of work to that however we could um like the first week we could issue notifications that just I mean you can call it a warning but we we could just within the first week issue a notification that says hey this is you are violating city code and not necessarily note it and follow up but just just as a at least for for the for the people that are that are there for for that time that would help them um right right U but but if we want to go down the warning route we can I just that that's going to take more resources than than just a notification that says hey you're viol but but we don't necessarily issue citations that first week or something we could do that right we could do we could do something like that and that wouldn't take too many resources for nor on that you said last week he did 12 citations is that is the citations decreasing so are we getting them educated or is it still saying oh yeah yeah he he's now it's he he said they've gone down significantly the last month or so yeah it it didn't seem like they did for a while uh it kind of it seemed like it it it wasn't catching on for the first month or two but within the last month they've dropped quite significantly yeah it feels like um in general I kind of hear us and think you mentioned this there's kind of four things one is the communication of our ordinances and just newly city code in general I gu you can call that education as well the other aspect is code enforcement in general all right we've got a new code enforcement officers cities getting used to a little more frequent or consistent um dealing with that enforcement of that um and then you know snow and limited winter parking so I think n city does a great job of communicating when things have timelines like signing up for recreation soccer or Here Comes Heritage days or it's time to renew your pets and I feel like it's really easy to split winter parking and snow removal into that timeline because we have specific dates um but I really love the ideas that that we've gotten tonight as well as from citizens of maybe there's like just once a month an ordinance spotlight and that comes from evence experiences right or or because of timeliness right and so like we just pick parts of code and throw in the newsletter and paste it place just like we do with hey don't don't bury your hes I think just picking an ordinance that that we find is is common right we would probably be around spring summertime that kind of stuff I think would go long way and it would force us to be consistent and then you know probably in the course of seven years we cover the whole thing maybe I don't know um but I part of me with the sidewalks I think this is kind of what gett was goings weti streets that we plow and hle City for those that maybe don't know actually plows quite a bit of sidewalk my understanding um for individuals and it's prioritized based on about to school and some of that um maybe we have a committee or two look at some of these ordinances that we're talking about specifically and address some of these things or like snow remove on sidewalks should should we prioritize like a tiered structure on which one should be done by 9:00 a as opposed to ones that could be done in 24 hours I agree with you mayor I also use sidewalks when snoke and U so like sayr to school we definitely want those sidewalks first staff committ talk about are those the ones we plow usually ourselves as a city but that that that's an idea for the at least the sidewalk issue so maybe be prioritized those are the ones that be done by certain time in the morning and everything um you want to go Council go me I I I encourage us to take one step back from this and ask ourselves what are we trying to accomplish with orament now I've heard from people were trying to generate revenue for the city and I mean we're we're spending money on Code Enforcement that doesn't come in on fines we're not I mean you all know we're not trying to we're not trying to generate a revenue stream here with code enforcement um are we trying to educate absolutely but I think there's one thing in front of that and I think what we are really trying to do with ordinance is to figure out how all of us live in a community that's happy healthy and harmonic with our neighbors so we're trying to trying to model or change or encourage a certain Behavior right and there's a lot of ways to do that and I think one of the most important ways um is through education um I might be naive I think that fundamentally people want to do the right thing and if we explain somehow even in a warning I know it's extra work or even in a in a citation why is this a problem how how does this impact the community how does this impact my neighbor um I don't know that we have to do Public Service Announcement announcements with every citation or every warning but maybe um an attorney told me that you Engineers are like this you hate something and when I explain to you why it's like that you accept it and so maybe we're all a little bit like that we could do we we could do some some efforts on education as to why that ordinance exists and how that helps us have a a happy Community healthy Community um it's interesting Levi and I have talked about warnings versus citations we talked about it when you all went through with us the nuisance code you know enforcement which we've done recently um I'm reminded of a discussion that I've had with the cash County Sheriff who does law enforcement in in nib we contract with them and when I was a non- voting member of a voting member of council like you I got a report every month from the sheriff what they did in nibbly to earn the money that we paid them and so I'm seeing his NOS you still get that my conversation with the sheriff's deputy assigned to D is half of these speeding stops are warning why when we know we have 85% from the data from the radar data 85% of of the people that drive in nibl on some very vulnerable streets for children going to school 8th West 10th West 300 South 80% of our V drivers speed why are we writing warnings does that modify safe behav modify Behavior towards safety as effectively as a citation and um the sheriff's response was because we don't want people to hate us and that's a valid response because they're they're trying to build a relationship with public and you all understand how important it is for local governments to build a relationship public so I don't know where to draw the line between warning and education versus at some point you just have to write a citation but I I do think there's there's room for both we're doing both and we need to we need to continue to to Define um you know where we draw that line I want to ask a question that nobody has to answer out loud I'm wondering if do we really not know that it's illegal to park on the sidewalk suggesting maybe we do know that it's illegal to parking sidewalk but opportunity for Education again is that we're going to enforce the CIT the ordinance that says you can't park on the sidewalk so that's the new news that's the the thing we need to tell people it's not that it's illegal to park on the sidewalk I think probably we've all lived in the city for long enough that you know we can't park on the sidewalk um however what people don't understand is that whether whether the city is going to enforce that or not so again that's where decide what it is you're trying to educate and and follow through with with that and um I I think that that's a key to to getting this figured out I'll for while two questions so here I know specifically about s have suggestions um if gett did have specific changes he wanted to make to like the or maybe we wanted to separate out snow removal sidewalks from the Nu ordinance what would be the process need to put this on the agenda again with a chance to actually update ordinance or how yeah so I I will put this let's go to the planing commission first this land use is so so I will I will put a specific uh item on the an item on the agenda to look at amendments to our our Cod and so what I'm asking of myself and I'm asking you of the council is that you work with Levi right to be specific about what words you would like to see change in what way and some of you have already done that and I appreciate that and then you know Lei you can you can help us draft and so on and so forth but eventually we have to get to a specific adoption of a new org so I'm saying work outside I don't I don't want to see six of us words smithing with Levi I don't think that's sufficient but but if Levi I'm sure you'll go along with this know if you'll if you have specific things you'd like to present in terms of an amendment work with Levi on that write it up ches AEK from if you want this and I'll check with you or check with Lei and see if we're ready we want to we'd like to gather up as many these changes as we can that are applicable um three weeks from now is our next meeting you all have a week to um review the packet and the specific changes before it happens there's a week before that that typically we get legal review and we get staff review so really it gives you about a week right between now and next Thursday now next Thursday to say Levi I'd like to work with you on specific changes and and working you if you want to done that quickly otherwise you got another three weeks so I have one thought on the warnings versus citation on wintertime parking and I thought this for a while but I might might and I'll talk to you about it you know the first week is a warning and the next week is a citation right of the wintertime months I think that helps people that eventually park on the street but a lot of times a lot of people that are most agreed by receiving a ticket during wintertime parking is they park there once so if it's the second week third week another possibility you know and we'll get to it in a specific change and I've resisted having encouraging citizens to be their own meteorologists with their own forecast but maybe we write warnings for spring time parking if there's no snow I may write a citation for winter time parking when there are when there is snow it's possibility um I've talked about what I think we should be trying to accomplish with ordinance modify Behavior so we can all get along I think what we don't want to do with ordinance and the member of the Planning Commission who got a parking ticket this week said Larry do you really want to be the HOA president and I'm not the PO enforcer but he said look you really want to be the HOA president that's just out there making trouble for people and certainly that's not what it that I agree the education as important part of that I think we learned didn't like on Miguel's name but she even talked about she went and looked up the code and found out oh yeah this is angle and so I think education is essential in helping people know because I do agree that when people know what they can and can do most people choose to do they can choose to do and then I had a scenario so this is one of the issues with one of my neighbors so people visiting they got want parking on the streets and they're all parked in the driveway but of course Drive big enough the cars are the driveway but they're also over the sidewalk in the driveway I agree drive a sidewalk but do we consider a sidewalk when it goes through the driveway ifw easy yes it's a side there there's not a there's not a complete prohibition on street parking around the clock or around the year it's it's a limited amount of time so make sure the parking's over by want to came ising certain consistent repeat vendors versus just lot of new people yeah there's definitely repeat offenders there there's a there's a variety of both yeah yes and that and that's been my experience too with just in general code enforcement this five years it's it's it there there are several I would say the majority are one time and then there's one case and then that's it's taken care of and and that's it and then there's se you know there's a smaller pool of repeat offenders would it be hard to get a report of of like what citations he gives you know like we are brought up that we get the one for the highway patrol once a month would be hard like that just difficult yeah and typically what I've done I don't know if anyone remembers but in the past I've I've done reports on Code Enforcement and broken down the different violations that we've experienced over the course of the year uh I don't know how frequently you want that kind of information but we we did that kind of on an annual basis in the monthly what what's actually going on in the community and how is our meeting Community meet all right Council uh we're right at 44 minutes and unless you ask to spend the agenda I'm going to wrap this up thank you for coming out um you've heard the discussion hopefully understand the next step that's a matter of uh uh please continue to reach out with specific suggestions thank you for that uh reach out to council members I'm a member of council just as well and then we can direct direct those to Levi and at at some point in the near future anticipate seeing an nenda item with specific changes on the agenda uh specific changes to the ordinance being proposed no to be clear there's no at this point in time direction for staff to to draft any changes but to just wait for what's going to come from Council correct we get something in the March newsletter about whatever think snow removal or parking is more pertinent at this moment just no it's going to be nuisance season pretty soon parking isn't going to be as big of a I mean yeah I Wonder has already started submitting oh so he chose to address one I could ask you for information on anything you guys wish for the March newsletter but we're already in the process of having us be be a fun discussion property you don't own you have to maintain I guess one other suggestion if it's not too sure you realize you're all invited every single month to write anything you want and you can have my slot anytime you want or you can ask me to share it or you can ask me to get out of the way whatever but you all realize that are welcome authors to the newsletter each and you get emails from Sheryl telling you what the deadline is and what the topic is for the month the there's nothing holding you back from expressing anything you want sh that's an indication so good okay thank you Council thanks for coming out uh let's move to item eight uh this is a uh discussion and consideration of the word of a contract to wall Consulting Group wcg to complete a brand new sparkling nible City General plan Levi is going to do this for us yeah so uh it's an update to our general plan is currently in the budget for $80,000 the we did receive a grant from UD technical planning assistance that's $40,000 for this for this update our plan was last updated in 2016 and the so it's been it's been a while we feel it's it's do uh the in general what our what our general plan does is provide guidance for the implementation and coordination of land use Transportation housing parks and open space water resources and Municipal Services uh I won't you know I won't go through the whole scope of work and you know if you want if you want me to go into more detail there I'm happy to uh but as far as as this contract and who's um who is who has been selected and I'll I'll go over that process a little bit so selection committee consisted of U mayor Jacob son council member Manel uh CL Clare shank Nick Kensa from the Planning Commission as well as Tom Dickinson just m myself and uh we we received uh responses from four different firms uh and in general it was it was a very difficult decision I'll just say that of of selecting this they were four well qualified uh firms with pros and cons of you know different directions of of different uh strengths but in general and as you can see the scores there kind of Razor thin margins of of of the average scores but what what the uh the discussion with the uh the committee was the you know wall Consulting Group they kind of some of the reasons why they were selected is is their technical expertise and the the team that they bring so what uh the L Lewis Robertson young is also on the team as a sub consultant and they're they're really experts in financial analysis and they'll they'll perform uh that expertise will be helpful to understand the fiscal impacts of of those decisions so that that will be valuable to the city but while Consulting Group uh they've they just bring a lot of broad expertise to the project and where there's there's all these different components of the general plan we felt that was that was important um it's helpful that their project manager is local uh that wasn't really a consideration for for the the team but but in in discussions negotiations for the contract that that's a helpful thing for when it comes to travel expenses uh he he's here local Kyle Horton and so the the recommendation is from from the selection committee is to recommend awarding this contract to to wcg Le General plan thank you Levi questions for Levi and motion anytime you're ready motion to award the contract CG okay there's a motion to award contract to revise the n city General plan second thank you from the four proposals I can't maybe it's in here I started oh there it is the the term of the contract schedule about when we expect to get this done thanks right it should be it should be done about by the end of the year I I believe the term of the contract is longer than that something like 18 months just so we don't have to come back and change it if it if it does take a little bit longer the term of the contract but the schedule is within the contract to complete the tasks by by

December yeah's a few questions um maybe more for the next group to take over but um I know some SC work it talks about them referencing City plans in coordination with staff um and I just didn't know if we wanted in that SCH work to specify those before the agreement is signed is like are we going look at all of them you got a lot of plans and a lot of us have similar goals or conflicting goals and I think sometimes we get a little too distracted by the actual overall that's why I'm excited about this one because it's supposed to kind of so I just didn't know your guys's experience if listing specifically all the city plans you want them to look at or is it better to keep it General I thought we got a little bit more specific about that so I I have to look at that the but it's not going to be everything it's going to be what's pertinent to the general plan uh the they look at the transportation master plan they'll look at the parks they'll look at um the probably the recently adopted Act of Transportation plan the previous General plan uh might get the highlights of some of the other you know the water sewer storm water is pertinent but they're probably not going to sit through that whole thing unless you identify it as a wait a minute we can't plan to do that until the sewer there and that's not anticipated for another 15 years right right that's what I'm saying but but it'll probably be I we'll work with the cons to get at what the pertinent information so we don't spend too much time in the Weeds on those things yeah what I read wcg will coordinate with City staff to identify and document existing City and Regional plans all right okay it was very yeah if you get to yeah just thought and then I just noticed I assume it was a TY but the date on estimated cost was it it reference to sorry that their estimated cost kind of sheet I think page seven okay matter yeah we did Issue the RFP in 2024 so I

about this vacation of proper thanks just to get us start started out this is kind of in connection with a development that's in progress right now hwk Hollow located right near where the old 1200 West alignment was along 3200 South there's no real need for it the city hasn't found any real need for it anymore and with the an upcoming agenda item with a land swap agreement this part of the the roadway that we're proposing to uh vacate would be part of that land agreement and swap with that development so state code does allow a municipality to adopt an ordinance to vacate some or all of a public Street if the legislative body finds that there is good cause for the vacation and neither the public interest nor any person will be material injured will be materially injured by the proposed vacation that's just simply a a quote from state code I'm going to catch up with our slides here um we have to have a public hearing and I already mentioned that there has to be good cause and no materially injured parties we've done investigations there's no known utilities but there is an existing irrigation pipe that serves a property to the West um people may know Randy feaser Randy's been in contact with me and the upcoming developer on the hwo development Randy actually did sign the petition for the roadway vacation so he's very aware aware of this vacation as well notification was sent to All Property Owners within 300 feet in accordance with State rule or state code 109 A- 6952 A1 we sent out with that notice a copy of the petition to vacate the driveway with the opportunity for each person that received that notification to sign it and return it or come into the office and sign the petition I didn't collect I meant to before this but we jumped it up ahead but I I know that we have I'm going to check right now who's signed there has been two three parties signed the petition one being Rocky Mountain Power they they are also a utility that was notified other utilities were all West and Comcast and there was no response from those two all West the mailing address we had was wrong but it came back but we we got no response when it was resent to the right address so the part that little Pink Spot in the map there shows where the vacation is proposed this is a blow up of it on both the left with an aerial and then also on the right is the property description and then this overlays that rideway with the proposed Hollow subdivision so hawala subdivision has gone through preliminary plat it was approved by by Planning Commission and staff is currently working through the developer with the vinyl flat and construction drawings we those be submitted very very quickly so this is part of all the land Swap and and that final yeah can you Tom if you don't mind just the way of information go back one slide and just let us focus on that for a minute everyone get their bearings on where that is so this is part of the roundabout at 12th West and 3200 South realignment of 12th West so that it aligns on both sides of 3200 South and that's where 12th West used to be that's the part we're vacated that's correct it's old alignment of the 12 12th West roadway the the north portion that connects from the top of that pink portion to 3200 South was vacated a couple years ago when the roundabout was constructed I've also been in contact with the property owner there Bob stot we met the other day there was uh some discussion on the ride of way vacation there's no concern on his end he had more questions on the development that I was able to answer with him thank you sorry for if I skipped ahead I'm just catching up to you any other questions on this one I question onti yes only three that's reflective of how many the percentage of maybe manyan there's 54 property owners that were notified and the three utilities that I mentioned so very little response thank you thanks for that question any other there wasn't any other public utility AG in that section star there known there are no known Utilities in that section at all um but because it's a public roadway there's an inherent easement through those so those three utilities were notified you may also notice if anyone read the petition that there was two references to Logan that just gives you an insight to my history um we I did contact the the City attorney and he said that's fine we don't need to R notice or anything like that it we could carry on this first region or even wave first reading go second and approve this vacation yeah we I should have mentioned that we don't share a name but we do share a zip code so I knew someone would catch it sounds like na did so again moving forward here this is the overlay of the existing RightWay that's to be vacated right in to the the development if there are any questions for the developer they're both here and and uh they do have interest in this as well as the upcoming agenda item on the land swaps again what the council should consider is is there good cause for the vacation staff feels there is and if neither public interest nor any person will be materially injured by this proposed vacation so those things are very important in this and it protects through state law these interests so I'll uh turn it over to the mayor thank you that that introduction open the public hearing to let anyone who is more yeah and I think one thing of note of just the layout of and this this relates a little more to the the next item but if you go back to Tom's slide here it it really the the way this the subdivision is laid out it's it's much more uh accessible I mean and and there is on street parking adjacent to the park then than previous versions that we saw of this subdivision where it kind of turned it back its back and we were just when we said oh it could be used as parking it's like what else are we going to use it for so that was that was kind of the idea there wasn't it definitely is not the ideal play it wouldn't have been the ideal place for parking anyway a lot better discuss so that I don't know how to take this one at a time but the the what the citizens of nly are giving up by abandoning that piece of property we're getting in the land swap that we will talk about in the next time yeah yeah so they're all related but we but but the actions are are separate we're not giving the citizen property away for nothing that was actually my question I uh I don't think it's a problem in this situation but I was curious like if if in a vacation you can do it on a conditional basis want to know that for pach records like if we could for example if I wanted to amend this ordinance and should this be it's an ordinance like hey only on condition of a lands slap I'd be interested to know if that's the right or allow again I don't think there a problem here but no I I actually considered that but even if we don't end up going forward with this land swap it still makes sense because we own the property on the other side we just retain a little more of it don't tell the the proponent that wants to swap with us that we don't want this property anyway this is the most valuable piece of property I just think for future like procedural to know you that might be problem if you want to De vation on some other things that we ar compac and so this doesn't swap right this does is vac thatty say like maybe ask oury inure if you could do a condition any other comments questions discussion is there an objection to voting on this ordinance to to abandon prop sounds so thank you councel thank you Cheryl let's move on to item 16 this is uh ordinance 2505 development and land adjustment agreement between n city p uh to adjust boundaries that we're going to hear about right here so all let uh Levi or Tom Levi take it away please right uh so this land adjustment agreement it's primar primarily the reason for this is to set the terms for the land swap that we've that we've discussed between this this property to the uh kind of the east of of Hawk Hollow or sorry to the west of Hawk Hollow and then and they would then uh give the city property to the sell uh but there's there's some other Provisions included in here as well uh so and I I just want to go through a summary of of the the conditions first so the property line shall be adjust between the current currently owned city property and right away the proposed open space as display as displayed on the preliminary plat and I'll I'll I'll put that on the next slide developer shall design and construct a sidewalk which connects the project to the existing sidewalk near 3200 South 1200 West around about beyond the project boundary so what is included in this isn't just a land swap there's some other uh improvements and that factor and and that really factors into why we feel like as staff that this is this is a good deal for the city and and we'll go over those numbers one of those things is uh you know additional Improvement is is a sidewalk that goes beyond this project boundary so there's a Gap a current Gap in the in the sidewalk between where the roundabout ended and where this picks up and they'll they'll be able to close that Gap but that isn't something they would typically provide with the development of the uh developer shall design and construct curb gutter sidewalk adjacent to City parcel installs St waterline electrical service property so just being clear about that that although that's our what will be our property that they they are required for to install C gutter sidewalk there uh the the city shall vacate the RightWay which you've already done so I guess that's that's already been fulfilled um and then this fifth one this is actually the re the only reason why this was on a Planning Commission agenda agenda previously uh the this would Grant an exception to nibbly city code for pedestrian connectivity and I'll show you on the map but there there's a there's a provision in in Ni city code uh uh providing pedestrian connections every 660 ft and they go a little bit beyond that so this would be granting that exception um it would also allow for phasing the project into into two phases just clarifies where that phasing is so this is the I'm going to go up here so I can point uh so so this area basically from from where my cursor is over here this is current currently city-owned property and so the city would would dedicate this portion of the property and then they they would um um dedicate this portion to the city and you can see how that all Lays out with the proposed subdivision that has received conditional approval for the preliminary plat one of one of those primary conditions of approval is this this agreement that's in front of you right now um the the sidewalk I referenced is they they are proposing this sidewalk connection to uh to this Trail which is is a going to be put in as part of nibbly The nibbly Meadows development U but when you measure all the way from from here to here it's a little bit more than 660 feet it's somewhere around 700 a little over 700 feet and and we just felt as staff and you know the the Planning Commission agreed that it made more sense to have that adjacent to the open space than between couple of uh build building Lots there um so that's just to give you a little more context on on what was approved on the on the subdivision this is the phasing lines that they they've drawn and are also Incorporated in in this agreement of they they are proposing to complete this in in two separate phases and this is the boundary line adjustment so the next item on the agenda would actually if if you if you approve this agreement uh you would would actually formalize the the a transfer of land so this is an agreement of of all of those terms but this that would that would formally transfer the land between the two parties that boundary line adjustment so that's uh this is just the the boundary line adjustment document that would be recorded where this portion that the current the city doesn't currently own right here would would be conveyed to the city and then this portion right here would be combined with the current H Hollow owned parcel and then once that happened then they own all of the property that they are proposing to improve through their subdivision and uh they they could then subdivide that that property this just kind of a step stepwise process there but this is this this all comes together and this this property here is included because uh we're drawing a line uh that doesn't doesn't Curr currently exists on the edge of 12 west that that affects this other parcel but really what we're talking about with the land exchange is this property and and or this portion of the property and this portion so go over uh we have a more detailed spreadsheet on this that goes over these these costs but these were uh coordinated between City staff and the developer these these costs and so if you see here the land value uh what what they are dedicating they are dedicating a little bit less land um than what we are than what we're giving them so that that's that's reflected here in the land value uh that the the price per acre was for the purpose of this analysis is is the same for both properties they you know they they didn't necessarily propose that oh well our property's more valuable than that one uh no that and here they're they're really treated the same and so for that reason if we just take the the land value and none of the other factors we we considered there is a discrepancy where based upon you know these estimates there uh the city would be giving up $117,000 but when you take into account and I I guess I didn't go into the storm water uh portion as well of of What's um of what the city is is uh agreeing to provide and then the the developer is is green and Tom you can get into this if I'm if I'm a little off based but but the um the developer is and and the city are working together to uh basically push the storm water across the street but this uh and just just to the West on on the property there but this area wouldn't just only serve the Haw Hollow development it would it would serice um other developments as well in this area and so they they're they're proposing to pay for a pipe that goes across the street there's some other costs associated with that as well um and so those total costs would be 80,000 uh the the yeah yeah I think really really here so this is this is where the col developments going to be and and the city staff's been working with with the engineer and the developer to provide storm water over in on this parcel and it' be kind of a a regional storm water facility again if you if you want to get into more detail on on that Tom provide provide that information yeah yeah and so that uh that's but that but that property is reflected here so um hwal they're providing some improvements but the nibi city and then that and those add up to estimated about 880,000 but nibbly city is providing the design $5,000 construction about a little over 10,000 and then this commensurate land cost that that's that's an estimate of how much how much land that their um storm water is is is taking up so that's the 26,000 so when you take into account uh the the total cost attributed to Hawk Hollow and then to nibbly City uh that there's there's really a surplus a little over 20,000 based on those estimates in the city's favor we can get into the detail of of each of those but just wanted to provide a summary so we do feel like you know it is a good deal for the city there's a there's a lot of you know kind of win-wins here I think on both sides but uh staff's recommendation is approval of this ordinance which which would adopt this development agreement or approve this development than so um before we into this was there a public hearing at the Planning Commission yes yeah and any comments no came out okay I'll turn it to the counselor a lot of work I think it's a great Cooperative effort between City staff and the proponent um thank you for working together on that yeah I'll just that if I could real quick it's pleasure agreement staff a great job the developers been great to talk to sotion to approve first reading okay we have a motion to approve 25-5 first reading is second discussion please yeah so the reason for not waving here is just a few questions so they may be cleared up um in the agreement well ordinance talks about there's a reference one of the third where as has a reference to Oh shoot that's my my bad yeah know I meant to delete that bad have do that quickly that we'll be taking for the entire so the property that we're taking the part part portion of it that is most the reason that this is being phase there is a wetland that's shown on the national Wetland inventory working with the developer in delineating that but we have to wait for the growing season to occur that won't happen till spring summerish so conservatively we've asked for a buffer not to disturb any City roadway or build any any Trail in that area you can see that hatched line down in the Southeast corner of the exhib there that designates the boundary that's on the national W Wetland inventory however we realize that that's just a th 10,000 foot level analysis so we need to do on the ground analysis and investigation so to get them going they we we suggested doing a phase plan so it doesn't delay the entire project they can do that North section while they continue to work on the left when I read the agreement I did not it was not clear to me that it was discussed on um who would be responsible the city or the developer for the southern part of that road that would be adjacent to city property I guess it was just implied that it's their responsibility to Le construct the sidewalk and subties yeah and it is it is on the approved preliminary plot already those those improvements what you see on the screen shows those improvements but it's not explicitly in the agreement I don't I don't think it is we could we could put a provision that states that yeah so those would be my yeah discuss it we can discuss it okay the clarification responsible for those I don't think we can get the Army Corps Thing by then but maybe you just like your your confidence level of this space is going to be usable would be I don't know I don't know if there's much there but usability I can't vouch for but I want to make sure the city's protected and not accepting some condition that's in violation of the army court so do you would you like to see some language in the agreement that defining Wetland or when when they could start phase two yeah it talked a little bit in there about some some stuff being based upon that but I think the phasing would be I think to the question of usability it's helpful that it's in the corner of the park it's not smack dab in the middle so if there's a fe you know if we want to put a field there at least we don't have we don't have to work around something that is in the middle of it I can't is some thought that devel to the irrigation patterns are going to change rigs eventually will put irrigating things this might dry up we just can't guarantee it we don't want to take chance with the on cour I'm not as worried in the past we have taken land I was not pleased with because it was pretty so I don't think that's going to be the case here it's not that big I don't know that we're going to use it very well it's pretty saturated they plot around it Farm grounded it's quantity Wise It's a little less than a half acres about 43 Acres just based on what the national wi Ling shows it might be less it might be more once we get the delineation and I think in this case whether it's usable or not it still makes please any opposition to voting on first reading seeing none let's proceed uh those in favor of adopting this for first reading uh with the direction given to staff things to take care of before back for second reading those in F any any opposition to okay we'll Pi that up next time all right Justin let's jump back please to what was originally item nine ordinance 256 notice to adop amend and impact Fe facilities plan right thank you mayor this is item has been before you guys a number of times if you recall this is regards to the wastewater treatment impact fee that we passed through to Logan we talked about how in our rest of our impact fees nible City had already adopted the process to reduce the impact fee for multi family dwelling and to charge per unit instead of historically had been charged a meter size so we we gone over this a couple of times I don't want to bore you with it again other than to say the only new information that Logan City is done they did complete this Tuesday and they have reduced the impact fee in Logan City and this brings us into alignment with

them for both of these next few items no these are the same items there's two two items originally this started as one item and I apologize for not understanding that it needed to be broke into two items one of those items is adoption of the impact fee facilities plan and the second is the was or sorry the uh yeah impact fee enactment or basically adjusting the impact fees you have to adjust the impact fee you need to have a facilities plan and the facilities plan Maps out the conf the the capital projects that need to happen over the next few years that the development will cug the impact of so they map all that out they plan it all out they plan projects in the case of the wastewater treatment plan it's upsizing and and constructing the for F the fork bioreactor which is a giant concrete tank that waste water will travel through and time to certain aeration and aerated areas and basically treat the water so so the facilities plan is just that document it talks about that and it puts numbers and calculates you know the impact and the percentage to what's existing and What needs to go to growth and basically just the legal Hoops you got to go through to be able to charge an impact fee so that is the facilities plan which is item number nine item number 10 is to adopt the fee and the fee being proposed is 70% of a multi or 70% of a regular residential home for each multif family unit which is in accordance with what we do except we only reduce our the rest of our impact fees by 20% Logan did their analysis they used water meter data for their actual units they looked at actual meter read reading data and they came up with that number we used fixture counts and the IBC code to to determine and to back up why we only went 20 so they went about it a little different way and came up with a different number but the concept is the same that a multif family unit should be charged less than a residential unit now that's beneficial to the city because each unit now is being charged an impact fee where historically in the past one meter was charged and it was a 2in meter so it was $7,000 impact fee but they may have put 12 units on or 15 units on it and so this kind of not only uh the better way to finance things and to plan and understand how much money is coming in but it's also more consistent across the board because different cities allow different amounts of units to be put on a single meter and so rather than try to attack that and standardize that across the valley and those that feed into the wastewater treatment plant it's much cleaner just to do per unit thank for that question um the the impact fee facilities plan I assume includes building a new bio reactor yes sir right so it says here's what we're going to use the impact fee money for to maintain the same level of service to existing residents or users of the waste water so if I may add that good news is say impact fee is being reduced per unit being reduced a little bit but this impact fee analysis was all done on objections and estimated costs of construction for the wastewater treatment plant so this will be re-evaluated very shortly and new numbers of actual impact fees will probably be proposed but there will be the reduction for the multif family does that makes sense we've been operating the wastewater treatment plant now for three years four years we got a couple years history they've seen what's actually coming into the plant and there just a clearer picture of the need of what bioreactor 4 is how soon it needs to happen there's also been some grants that have been obtained so they want to push a little bit forward for that so they will be relooking at probably next year doing a new facilities plan and implementing new fees but in the meantime there's a lot of cities that are have multif family developments coming in and try trying to standardize them and making sure that was my biggest thing going into this was we all should be paying the same if nothing else we should all be being paying the same and the same way of doing it and so this is a good way of making that happen is by going per unit and they have shown through the numbers that it's a little less than impact than a home that's what the reduction is multif family residential impact one unit is a little less regular house corach house um you mentioned grants that are also tied to developing that bioreactor so mayor paie Dan in a meeting yesterday mentioned that uh one of the those grants for this bioreactor is a Federal Grant and it's on hold so Lan city has 9 million of federal grants currently on these are reimbursement grants so this is money some of them are are some of these grants are not the bioreactor but money Logan City has spent dispa being Reed by the so I don't know where we are on land waterer Conservancy question topic but I know mayor D is a little bit worried about that 9 million okay um thank you Justin we'll turn 256 to the council so this would be to the doctor amend the facilities inact plan and this is second reading if you're so plan number nine can I make a motion then yes pleas 26 or second okay thank you eron uh this is the motion to think demonstration of the process working right we're allowed to disc impact Fe of new development that would not reduce the level of service to our existing customers and existing customers includes nigan Logan City and all the other people that send the brown stop towards that treat plan okay any discussion no any opposition to voting saying none uh this for second reading this will be final so a second reading on Park parking requirements you have information for us please yeah I if you don't mind I'll give a quick overview of what of what this ordinance does I I gave a more detailed uh presentation at the last at the last council meeting but give a brief overview and then just some follow up on uh some questions that were raised uh so this this ordinance does update the minimum parking requirements in most cases it either reduces them or or um or used as a different metric than what we're currently using for for those standards and I and I presented the in in the last meeting the uh you know those specific numbers we can go go through those if you'd like some more but that's a big part of this that was kind of the impetus for the Planning Commission taking this up was looking at looking at those metrics but it also provide allows for an alternative provision of parking based upon a credible parking study so we're not necessarily tied to those standards if the applicant uh can can Pro provide enough evidence that that there's going to be adequate parking based upon based upon a parking study uh it also only requires the provision of of minimum parking uh with new construction so so if there's a change use we're we're not necessarily going to tie hold them to these minimum requirements so that will that will be you know up up to the private Market to decide whether you know whether there's enough parking there and then it does uh adopt some bike parking standards as well that are based upon active Transportation recommendations uh just just some followup from the last meeting uh uh Nathan asked asked about parking for other devices than than bicycles and step did do a little did do some research on that but there's there's really very limited standards out there U if if any on this topic there are some examples that exist of you know for example scooter parking uh diff different of types of of stalls but those are usually an application where there's there's a scooter share system like a a bird or or lime those those seem appropriate but you know this this could be something that could be Revisited in the future as this these Technologies emerge and there's there's additional options just for for now I think the industry we've only figured out how to how to build and standardize bike racks and some of those things can be Tethered to a bike rack okay and some of them not not so much but there's not really something out there so staff does recommend um adopting these these currently drafted standards this is uh planning planning commission's recommendation is approval of of this second I'll say one thing in the context of what we're talking about in terms of front yard parking I'm not going to suggest an amendment she thinks it's it's right here in front of us about a possible nuisance code change that we might be interested in in terms of front yard parking um in addition when when and if we go to that Nu ordinance we need to make sure there's a spot to clean up in this ordinance depending on what we do in the nuisance ordinance because there's the main 1924 160 and there's an A and A B in the table and if you go to what is now item e uh maximum yard area to be used for parking and vehical access Lanes goes like this for all uses permitted in residential Zone none of the front yard area required by the respective zones shall be used for parking but shall be left open Green Space except that access across over the required front yard um allowed FL driveways so depending on on what we do uh with the Nuance code we need to come back and either I don't know at that point we need to deal with this section of code in this even though we might adopt it tonight so mentioning that to make a note asked last meeting about you know and I did have Troy reach out to me on that icicle requirement you know that you know does that create an unexpected cost or hurdle that hurt us in getting more commercial they had to provide alternative parking is part of the requirement so I did talk to Troy a little bit about that I wondered if if that could be changed to a recommendation just to know to the commercial guys because I mean they should know what they're doing they they got to make money which seems they're going to bring in more people I do like that we're adding alna options do this for Liv and I just wonder SCH I feel like should change to a recommendation so if it's if it's a recommendation it I I would suggest it just be removed from the ordinance because an or an ordinance should should provide something that's enforcable and if it's if it's just a Rec recommendation I think that that that's somewhere we should have that somewhere else not within not within our city code uh I think the reason the reason for the requirement is uh you know and it's tied to our the act of Transportation plan which is the next the next item on the agenda it really undermines the city's uh efforts and uh you know for for more safe uh bike facility if there's nowhere for people to park them when they get to their destination uh and and requiring these uh it is additional expense if someone doesn't want to put a bike rck in and we're saying you have to put that them in but the expense is pretty limited when you compare it to the expense they incur for vehicular parking it's it's pretty small and they usually they can put it somewhere like they're not having to get additional real estate for for the bike parking they they probably have a corner on that they they can they can put it um it's pretty limited the amount of parking that is required so like for example for a for a restaurant one space per 2,000 square fet let's say it's a bigger restaurant that's I don't know 10,000 square feet well that's five bike racks I don't that and and I I don't know about any restaurants that are 10,000 square feet but say it's a big Brewery I don't know then maybe it's 10 and how many vehicle spaces would they have to provide for that s right uh six well six spaces per thousand square feet so 60 spaces of vehicle vehicles and then and then five five bike bike places for five bikes right understand the expense my I just wonder is that going to create early inhibit commercial I don't think it would be the straw that breaks the camel's back to talk about but talk about concrete proposal I'm going to suggest that that would be uh perhaps an amendment offered after we have a motion to adop and then then we know exactly what we're talking about if you're with that feedb okay and that's great my experience in settings like this is the best way to get feedback and constructive discussion is to know exactly what the proposal is right and so the way to do that is to say you know I move to aend so that we all know what the with the what the alternative that we're talking about this and it's great great to talk toic to talk about this might be a little bit more efficient if we know what the proposal is make a motion to approve okay motion to approve 254 this would be for second meing and final is there a second okay uh thank you Nathan it's to the have to build as much parking when I think of a commercial spot that I think would uh most likely not support bicycle parking I think of Home Depot just because not their anti bikes but I go there a lot in my car it turns out I go there a lot on my bike and turns out they have bicycle parking and I am so appreciative of Home Depot having bicycle Park where so the South entrance you know it goes into the electrical to the the north of the South entrance there's a bike track and I didn't know that at first either cuz I was locking it to a bench and what have but this is and then I realized as I was coming out one of those times cuz you go out that way wait a minute there's Spike right here well good for those guys so my own limitations I don't carry 8T 2x4s only in my bike but sometimes I carry small things wrench further discussion Nathan um I haven't come to conclusion proposal but um help me understand confirm for me uh staff or others um our mixed zone is referenced and it just says the parking now for that is this or it's the changes here um and I don't see a specific reference for residential other than single P right so for residential I guess I'll answer the first the last question first for residential uh that we did have a version that that put um the the residential standards in this chapter uh Planning Commission said well we don't want to change anything on that just leave it the way it is and so that's actually found we only we only allow multifam and RP and the RM zones and so there are some parking standards in those in in those zones we could migrate them over here that was kind of what was proposed before but they said just leave it so that's that's kind of where where it landed uh they didn't they didn't they didn't want to change to the residential parking uh that may so the first part of my question is that um 19.1 12.04 is next resal section ised I think that was a good catch I don't I I thought that was I I I think we meant to uh I think we meant to not delete that section it was just a that was dozen air that's a good catch because uh in a previous version we did have all of that listed on that chart and then it was taken out but we didn't we didn't uh reject these changes so a probably an appropriate Amendment would be to just remove that whole section change right so anything yeah 191204 could be removed just REM just adopted sections on micro schools that are specific to them but we haven't I think like I think we'd have to look at a whole like section of code that talks about micro schools and how we if it's if it now if it's a micro like let's say it's a homebased and I don't I don't know much about micro schools but like let's say it's a a homebased business that has less than eight children I think we would treat that the same as we do like a daycare and it would just it could operate at home but if it's bigger than that I think we would consider it a you is there an objection to vote see let's V not to actually do the adjustment right Lei you talk us to that please yeah so uh the property owners between 2944 and 2988 South Highway 89 have approached Logan City and nibi with their intent to to Annex into ni they're they're currently within within Logan City so we recently went through this process on another property to the north 2200 South and and Highway 89 this is another property a different property owner that is that is requesting you know essentially the same process the same thing and we've been in contact with Logan City and they and they've um you know we're we're coordinating with them through through this process of of adjusting the boundaries of which would you know essentially disconnect this property from Logan and anex into uh nii City so the purpose of this is they they would like to develop this property with a landscape business um and or one one of these properties and utilize the city's uh utilities to support that that business and our utilities are a lot closer could be provided much more efficiently than than Logan cities um it is it is within nibbly City's annexation declaration area uh and just this is this is updated from what was in the packet but Logan City Council has approved this same resolution they did on Tuesday night um February 18th I did provide in the packet on this and one other item I I probably should have mentioned an update in the agenda item report that reflects that but it wasn't in the packet it you know that that that information wasn't provided in time for for the public notice but uh just just to orient you a little bit the the area in red is the properties we're talking about here um so just south of nibbly Parkway the the road that goes to Maloof and then the the you know just north of the the new stop light there on the highway is are these properties Uh ni's current boundary B if you follow my cursor basically ends right here so it would just be expanding that into this area this is the proposed plat for the for the boundary adjustment that includes those areas as well as you know a little bit of of the rideway of Highway 8991 one and staff's recommendation is approval of this to the n city code public heing so this would uh this would change delinquencies yes do you want me to wait till all council's here or we're okay to proceed yeah let's take we have Forum we could move okay while I was talking to you I didn't realize they disappear Forum when thanks for coming in at 9:30 at night welcome first I want to extend my gratitude to Talent ordinance for me ins I at that he a lot of time thoughtful consideration and I especially greatly appreciate it um so current city Cod 1502 states that if a customer fails to pay their water charges within 30 days of the due date um service may be discontinued however resolution 0307 specifies that Del that are 70 days P du are subject to termination of water service so the inconsistency in language um between the ordinance and the revolution has caused some confusion um as one refers to 30 days after the due date and one refers to um 70 days of delinquency so the pro proposed revision clarifies that water service shut offs will occur 40 days after the billing date um so since um assuming the role of a utility specialist in 2022 we have been using the resolution as our policy which allows uh nibbly City residents to be delinquent in their utility um bills by 7 n d days um so I have observed that allowing residents to carry delinquent balances for 70 days places a financial strain on nible city um a recent case um exemplifies this issue a customer who was over 70 days um past due declared bankruptcy and it left the city with um that unpaid B and we just had to absorb that um and the bill was over $700 because she was in that that third period or that 70 days of delinquency um during the annual Cassel conference that I attended in October in Salt Lake um I had the opportunity to discuss shut off policies with representatives from other municipalities and ni city is notably more lenient than many of these other cities um some of them were even enforcing shut off days as as early as 30 days uh past due um while we as staff acknowledge that some residents May face challenges in keeping up with payments um I have spoken to city manager Justin about this we have um he has approved a thre Monon adjustment period um to facilitate the transition um by shortening the delinquency period uh we will devot greater Financial accountability while reducing the city's Financial Risk um Additionally the change will help residents avoid excessive task due penalties by encouraging timely pain um So currently our um shut up date falls on the second Tuesday of every month which doesn't always align um with the billing cycle so by implementing this 40-day shut up period we can better synchronize the shut up date with the billing schedule and adhering to the ordinance um the new shut off date would consistently be 40 days after the billing date except when that falls on a Thursday Friday a weekend or a holiday since we cannot shut off water on those dates um those specific dates um from a utility billing perspective I firmly believe that this ordinance revision is in the best interest of both ni City and its residents so thank you for your consideration on this yeah thanks for that information council do you have questions for Wendy before we go to the public hearing many we off here um I it really fluctuates but try my headest to not shut any so that means getting them personal phone and things like that um we normally shut off maybe two one two to four Meers a month if that and so we really do try hard to you know help collect the money from them see what we can do to get these utility bills up to date so it it would not say more than you know maybe 20 a year that we shut off um and you know in changing this delinquency date it may that rise unfortunately since we are allowing less time but to you know to continually allow people to go 70 days without paying their bill that that is a lot of risk on the city so and by shut them off at 40 your bill would be smaller if you shut them off correct so easier to get caught up exactly because right now their balances are so big and we do require that when someone is shut off that they have to pay their full delinquency balance rather than just the minimum due and so if they are get shut off it is a a hard other um financial burden on them to to pay that full past due balance which is now three months worth of of bills yeah thank you nor any other question I'm trying to think of so with Human Services on brag there are there are there are programs like heat you know yeah I mean fortunately Brad did discontinue their water services going right to my question yeah so then know how water specific there is you know electricity help and and gas electric gas but time they have discontinued their water services I appreciate how much you go to make sure that we can make sure families okay this kind L yeah we're not trying to shut anyone off just to be mean we really just need a you know pay work service that we've provided with those conversations and Communications regardless of the utility do we offer suggestions of ways to help them like is that like do weer them to brag or church services or anything like that are struggling to pay their utility bills we do you know say hey there is some with drag if they can get help with their electricity or their you know their gas then they would be able to and maybe afford those water services but yes we do try to refer them to to programs like that to get with those questions covered Wendy if you wouldn't mind hanging around C Street yes of course in the middle of the night anyway we will open the public hearing and uh so you can sit down relax and maybe thank you Wendy so with that we will open public 2510 the dely process on water as described 25 St Char first reading okay motion to approve on first reading is there a second Nathan second thank you so with first reading this is a chance for us to make sure we understand the ordinance ask staff questions um heavy duty lifting of policy discussions could come now or they could more easily perhaps come at second meing um this is a good chance for us to ask staff for more information before we get first uh before we get to second meeting but we'll talk about it for as much as you'd like to gett please just have more questions on in section B 20 days instead of the 30 in The Bu day would be considered delinquent will that increase the number of delinquencies yeah will you pull that up please is so this is the actual ordinance language that you're referencing wait not not the cover sheet um so we send up a billing we have a billing date and then we have um a billing due date and some of the the the ordinance was written to um do 20 days after the due date and so in turn that's really um 40 days yeah and so um that's what that's kind of what the the the wning is just you know we're trying to streamline it so all means the same thing if we're saying we're going to start the 40 days from the billing date which is the first of every month instead of you know the the due date which is the 20th so where it says the 20th it is referring to 20 days after the um bill due date first the bill due date is the 20th Wendy if I'm reading that right it used to say 30 days after the date due yes and now it says 20 days after the billing date correct correct we're stilling date come before the due date um yes it does and so we're proposing that it will be um 40 days from the billing date which is always the first but it says 20 days 20 days after Amendment and vision code is defining what delinquency is currently as schedule is that after the 20 days from the billing date is always the first of that's when delinquency occurs and that's when the late penalty is then applied that does not mean shut off um this ordinance further goes into 20 days of delinquency so that's 40 days from the billing date or you could understand it as 20 days or 40 days from the billing date or 20 days from the due date of non payment so it's however you want to write it but it's the common point of a billing date versus a due date so one's the 1 one's the 20th so we're ref say everything to the billing date and not the due date yes so right now I'm it doesn't specifically Define what delinquency is and when that late Fe will be applied that's just in the utility Milling policy now that's applying in in COD that delinquency is now defined and very clear and enforceable the due date is the 20th and then shut off occurs 20 days if it's not paid after the thank you so the the light theing considered it yes that's what's definition and with that definition of delinquency that's when the late fee is applied delinquency does not shut off that's just saying now that they're delinquent that's when the $5 late fee plus 1.75% instead changing when the when they get a penalty this this ordinance is not changing that um nibi City residents do Ur a penalty if they are past the 20th of of the due date that has not changed that will not change um because of this ordinance so anybody who has an account that is past the due date of the 20th gets that penalty fee no matter no matter what so we're not suggesting to change that fee or when they receive that fee it is it's it's always after the 20th of the month um we are just um trying to change the delinquency period of when shut offs will occur yeah just because I'm thinking I know a number of people teachers and firefighters other once a month yes correct increase yeah I mean this still gives them a whole month like you can still be basically as of right now we give them three months to pay their bill this is just backing it up so they only will be delinquent two months and so if they do get paid on the last day of the month they can still pay um that month's bill and not feed C it be after the 20th true they would yes that is true yeah that's already how yes but that's not not yeah I'm trying to figure out what the original 30 days actually applied to yeah so if any sure person you say person if any person SS to pay the so in um um let's see failure to pay the statement shs bill and the place of payment and due date if a person fail to pay the water charges within 30 days of the of the date due so that only gives them 50 days because our so what happen 30 days after the due date that was referring to a shut off not referring to a delinquent yeah it might be easier to see all that when mean you know between now in second meeting is oh no I'm I'm breaking to the council not to you thanks for being so helpful uh but it might be easier to look at the unmarked code and tracking changes is wonderful thank you for doing that and then sometimes when you take out this part change 30 to 20 but at the same time we're changing shut off to delinquency and defining delinquency which wasn't defined before right then you know it's it's hard to figure out the the double switch correct so Thursdays Fridays um our public works department does not work on Fridays and so they cannot I mean they could but they would just be called in on an on call basis and so we do not like to shut people off obviously on holidays and you know on Saturdays and Sundays but since if we shut off on Thursday and they can't pay until Friday um it's just Public Works is off that day so yeah so I did to come up with that chart um I don't know if you you just saw that that was up um it shows the billing date is always on the 1 40 days from that date is when the shut off date would be and if it fell on one of those days I I moved it to the next available date which um most of those fell with within right on the 40 days so um we do have to yeah this chart right here um so we do have to give a little leeway um the most we would give is 44 days um because of you know if it fell on the Thursday we would have to wait until the next Monday so this just kind of breaks it down of when those shut off days would be yeah so I just want to say the things that I really like about this I've had the privilege of working with some people who are really struggling to take care of utility not just this and to keep those numbers down of what they need to come up with yes is huge it just compiles over for those that are struggling to pay as a black of funds for those that are struggling to pay because they don't stay on top of their routine that's a issue yeah but for those that simply don't that that struggle with lack of thums keeping it more manageable it's huge helping them change the sometimes the the whole that that digs it is yeah and in turn like like I said earlier um they do have to pay a percentage of their past due balance as a penalty and so if their past du balance is lower they with staff starting to look at the next Capital Improvement project in our water Master plans and new well master plan was approved in

200 and so with that we needed to figure out how to fund the next project if we could fund the next project so we really kind of started to dive into this we've also known this is on the horizon for a long time if you recall we talked last fiscal year when we were doing the budget the property tax tax and Treon taxation was so close we thought maybe we should hold off on doing that this year and focus on bringing our water rate and potentially our storm water rate up to where it needed to be so very similar conversation to be had as the police chief and we can kind of go into this as much detail as you want tonight I have a a pretty lengthy presentation that we put a lot of work and effort into we can we can hit that really hard we can just answer questions I can give you the Bri synopsis in this workshop and what we're really looking for is a couple of key things that we would like direction from the Council on how to proceed with it and then when we bring it back to the the general public is an actual agenda item we can really hammer down on this this uh presentation and go through every detail if you would like so I'm going to go a little quick just for the sake of time and understanding so if you want me to stop or have any questions please feel free to do so just a little bit of history of the DI City Water rate we have not changed the water rate essentially since 2005 we did do it in 2020 to create what is known as a tiered rate structure which means there's a base rate and then there's different tiers that you charge different amounts for volume and the the idea behind that is to really incentivize people to try to conserve by using less water they're being charged to lower tiers there's a lot of push at the state for this there's legislation currently you know being discussed at this time about trying to strengthen that and really utilize tiered rate structures to incentivize conservation conservation is a big discussion every year if you really charge the a big amount on those higher tiers then it incentivizes people not to use them now there's been struggles with that across the state where because when you do a water rate you have to show a need for it you have to show rationale for it and so cities haven't that really struggled with not having a lot of water have not been able to Jack that rate high enough to really incentivize conservation because they can't show necessarily show the need for in expenses but they don't have the water so anyway there's actually discussions about trying to make conservation just an a a blind item that allows you to be able to charge more so but when we did that the state came out and said I think believe in 2018 2019 that you had to have this tiered structure when we did that we really structured and try to not change what people were paying we increased the base rate we included 5,000 gallons with it so the reality of people's Bill didn't change a whole lot in 2020 so really what we're bringing in is essentially based off what was that we were charging in 2005 now obviously there's been a lot of inflation since 2005 and I just pulled these off a simple Google search with that the link there that con where the data actually came from but it shows the buying power over time since 2005 we really are you know per thousand we only have about $600 that we can actually go out and do something with you ask yourself well how if we've lost that buying power how will we continue to exist and it really comes down to growth we are able to increase the amount of Revenue into the system and keep the system afat because we have more people paying into the system even though that buying power keeps going down and down and down have a great night Aon so in 2005 we had just under 600 homes now we have about 2300 H paying into the system so there's more people paying into the system even though the buying power has got down so really what is the reason for the increase in the expense or why do we need more money and as the police chief indicated salaries have been a huge thing over the past four or five years we've seen incredible increases in the salaries and we truly appreciate that we love our public work staff and particular our water department is super strength uh big strength to our Public Works and they they're wonderful employees and so we've rewarded them we've tried to be very competitive we did the salary adjustments and if you notice their actual salaries when we did the adjustment with the big worth of work thing didn't change a whole lot because we were already you know paying them pretty well so but you know salaries just continue to go up and up and up and some of the other things that have gone up are water meters water meters have almost doubled in cost over the last eight nine years now we've been lucky uh history-wise we nibbly City was you know kind of had a way of charging because it was a replacement program and we were having new meters help pay for old meters so that cost has been up there in the past but they're just continuing to go up and up we've had some water testing requirements come up we've got talked to you guys about the lead and copper Rule and how there's a bunch of legislation and federal rules coming down about tracking lead service lines and where are they and now the discussion is now that you know where they are what are you going to do with them are you going to replace place them what about the customer side so there's a lot of questions about what's going to happen with water Federal requirements that you know trickle down from the state another big one that's changed is the water share assessments where're the water share assessment in the nibble Blacksmith Fork where we own a lot of shares went up substantially over the last few years and the other one the last one is the administrative transfers which is ironic that was brought up earlier by mayor our ad administrative transfers quite honestly are pretty big and what administrative transfer is is it allows an Enterprise fund to transfer money out of the Enterprise into the general fund essentially that means that the water department any Enterprise fund the water department the sewer department need to act as an independent business the L money that comes in should stay in that fund and be used for expenses in that fund but because we're so small and our staff at City Hall helps the water department so much we we transfer money out of the water department to help pay for their salar so I can get into the details of that but the bulk of the ministry of transfer really boils back down to the salaries and the adjustments that have been made so this is the the budget uh right out of the model that I'll show you in a minute but this is right out of our budget you can see all those red circles that are are increases over over the years some of those are pretty big numbers one you know nice thing is the the power cost because of because we have a good staff and because we use software to manage and operate the system we have kept that power cost down quite substantially over the years I'm pretty proud of their ability and what they've done there but you see some of those other numbers pretty large number increases so that uh wanted to show that this is the administrative transfers you can see each one of those line items is something that's not in the water department but it's something that supports the water department the SE Department stor water fund so we take the numbers we decide for example how much of my time has spent helping those utilities roughly 25 to 30% put all those calculations we come up with the administrative transfer so my point was it's it's a good it's a good sizable number every year that we transfer out I think we would be pretty upset if Logan was transferring that much money out of their Enterprise funds into the general fund but as a general that we do that to support those because of because we have such a smaller staff the water department at Logan City has much more staff than n city actually so that's why those are so big we also we talked earlier about the future Capital project needs the big one is the new well we're estimating about 5 and half million doll for that right now to come up with that $55 million we're we're going to have to go out and get a loan we're thinking about $3 million right now is what we'll need to to borrow such that we'll still have enough in Revenue to cover that debt service and also show days cash on hand the banks to authorize these loans will really look at those two items to make sure that we're financially stable and are have an ability to pay back the loan so part of that discussion boils down back to the impact fees that we talked about a little bit one could make an argument that a new well is for future growth and current and is is really a result of development going on in the city and while that's true it's it's uh the the way that the state looks at does the calculations to show how much how much your population how much do you need they're during those calculations there is show that we are behind what the state says we have so not all of that new well is really dedicated to impact fees some of that really should be covered by the existing you know citizens that you know according to the state way they calculate things show that we're a little bit behind where we should be so that also speaks to how important it is to stay up on our impact fees and to make sure that we are calculating our impact fees properly and charging those impact fees so that we can make sure that as much as possible that the development really is covering that impact that they have on the system so I the big kind of highlight there really is that you know our rate the existing water rate should help pay for some of that new we on top top of the new well we have some other capital projects that are not massive but they're they're still expensive that we need to go through and need to get done over the next three to five years you can see those listed there but as soon as we get the new well drilled we understand how much it's supplying how much it's going to cost where it's going to go we really need to redo that master plan when we redo that master plan we'll have a good Capital project projections we'll project the growth project the need we'll have all those things and then we can relook at calculate the impact fee those are important critical steps that need to happen but so wait can you go back one I can't help but I know it's getting late um we're buying a pig railroad pig 640 board so what that is uh b o r e I assume that's fine yeah sorry you got an engineer trying to so what that is is if you recall when we repaved 3200 South we did a lot of modeling and a lot of analysis about what to do with an old line old water line in 3200 South we had a newer 12in line and we had an older 8 in line the 8 in line had had problems it had had leaks it had uh major repairs so we decided at that time to eliminate that 8 in line and to replace that 8 in line we have upsized the line line from 250 basic we're trying to get it all the way to 1500 West and there's a gap there's a couple of gaps for development but also another big gap is underneath the railroad tracks in the Mount Vista subdivision so that's what that project is try to I'm good apologize any other questions there about those projects no sir that is just we we'll get to discussions about tank in just a second nice yeah lot of stuff with future capital projects to talk about at this time the only thing we put into our water right now is a very small amount of chlorine which we are very fortunate nibbly City has the pristine groundw that we were able to use and it just really takes very little treatment and the reason we put that treatment in there is not because of the water but it's because of the delivery system those pipes they're old they have I don't know sometimes the water doesn't get moved around in the system you get stagnant water and so that's why we put that little bit of chemical in there to make sure everything's clean and what we do is we watch you're getting me off on side topics I'm sorry but we watch that amount of chemical to know it's an indication of whether there's a problem we expect there to be a certain amount of that chemical and if that chemical goes down or is gone then we we we have alarms in our head start going off and we start looking for a problem we go around flush we test so we have very very clean great water here in the city uh some of talked about some of those the other thing that I maybe probably don't have a slide on to consider as we think about this is a repair and replacement fund currently our expenses are less than our Revenue so we are putting away some money so we're definitely spending less than we're bringing in but we have these big projects but the other thing that we have coming is nibbly city is relatively new we have a lot of new pipe in the ground we have some old pipe in the ground and right now the old pipe is functioning but the older it gets the more leaks it has the more problems we have with it so we have estimated that in the next 20 years you know we got about6 million $7 million worth of pipe that we're going to have to go through in place and that number you know we probably need to put some screws of that number and figure out exactly what that number is but we really at some point should be discussing putting money into a repair and replacement fund and holding that money for those large project those large pip projects CU because we're really not looking at those really hard yet now what this is I don't expect you to see any of this other than to understand and realize that there's there when when you had had discussions and uh questions for this police chief about why where's the money com we really analyze this we really looked at this we have a spreadsheet I'm happy to sit down and show you the spreadsheet there's a bunch of tabs across the bottom we took all the meter readings for the year we calculate what the bills are for individ uals which is a difficult thing to do with water because water's variable it's dependent on how much people use we have a wet year we make less money we have a dry year we make more so the water model is a little smoking mirrors magic if you will then say the sewer model because that's a fixed rate every month that each home is paying it's a little more easy to budget understand where it's going to be the water rate's a little more fluffy so we've done the best that we can we looked at all the current expenses we put in Prior year's expenses you can see the yellow down the middle there that's this fiscal year and then we projected out 10 10 12 years and the the the the moral of the story is that if we don't do something we don't meet those two criteria that the bank expect for us to be financially stabled for us to go borrow money we need days cash on hand and we have need to have the ability to cover our debt payment and so we really need to do something so how do you do that you can there's two ways really that that there's two items that the water rate is broken into you have a base rate and you have usage fee the base rate is what everybody pays if you drank one cup of water out of the nibble City system you're going to pay this base rate it's just access to the this the system base rates are good because they're predictable they are repetitive they're easier to budget they're EAS easier to figure out which is why cities like to try to do the best they can to push that base rate as high as they can to cover the the the everyday expenses of the city there's some things in our budget that go costs go up if we have problems or if we have certain issue but there's a lot of stuff that just has to be covered we have to pay salaries we have to pay for software we have to do some things so we try to push that base rate as high as we can to cover those expenses for when lean times come with we're selling less water so the rule of thumb from the financial experts that we spoke to is you want to be in the 40 to 60% right now we are about 32 so we are relatively lower than a little bit lower than industry experts would like to see so you can jack that base rate higher or you can to to make up the shortfall you can increase the base rate or you can increase the usage fee and that goes back to those tears and that's that's good because that really puts the financial burden on people they're using more water and so if you use more you pay more so it's it's this kind of this this Balancing Act of where you want to be and what you want to what you want to do and I will also say that I was going to say earlier there is no magic bullet here there is no one answer there is things that you guys have to look at as a policy and make decisions like there's just it's not a math problem it is a math problem but there's lots of variables that are dependent upon how what you guys want to do so there's no no Silver Bullet here you can ask any questions you want feel like my mic went out um yeah sorry so that's your two ways to adjust the the water rate really is to increase the base rate or adjust the usage fees so just to give you an idea we tried to do some comparisons we tried to show what other cities inside Valley and for the life of me I can not get PowerPoint to ever line anything up it looks way better say that uh so I apologize about I don't line up very well but uh you can see the different range of Base rates and I also was going to say it's good to look at other cities to see where you're at but you have to keep in mind that it is very very dependent individually on what the city's done over the last 30 years so it's good to look at but you can't take it for anything gospel if you see one that's really high you can't say well you know they're they're it's just so specific you can't look at it and and figure out for sure what you should do the usage different tiers we are relatively low compared to the rest of the valley some of the higher are up around the 650 for the upper tiers we we really are pretty close to a dollar we pay about a dollar per thousand gallons our tier structure right now is not very aggressive it doesn't really push a lot of conservation it's just kind of meets the check box for what the state wants us to do now I will say that there is current legislation that is trying to push the envelope of that and make us put a number in that tier for those higher tiers and spend that money on conservation efforts I don't know if that'll pass but it is being talked about and pushed so we'll see how that goes so our base rate is $115.50 and includes 5,000 gallons correct and I would say that's a pretty that's a pretty normal amount of water for indoor use that's how we kind of set that number it's rare to see very many help me Wendy here there's not a lot of people that go over that during the time yeah I mean it's it's pretty pretty standard I have a family of seven people rarely go over that 10 so that's kind of why pegged it where we did so Logan in the Logan's example there their base rate is $26.86 there's no usage they if you immediately start calculating on per gallon so they're if you use 1,000 gallons you're going to pay 2686 plus 1,000 times whatever their rate is for 1,000 gallons we include 5,000 in our base rate anything if I want to talk about I mean there's strategies on why we did that it was mostly to try to not change the rate back then but there's also you know you can talk about who that impacts more and and why whether that's a good thing so yeah I don't think I really want to say any more about that having to answer questions here's some rates that are outside cash County just to give you an idea they're quite a bit higher and my favorite one was Park City 57 bucks for no usage and their highest tier 40,000 gallons is not that much water I mean if you've got a normal size long you're you're hitting 40,000 gallons pretty pretty easy so but during the winter the average nly resident would pay about 90 bucks a month right now they're paying ,550 so that numbers in the right column except for base rate that's the cost per gallon uh it's cost per thousand gallons right 40,000 that's cost for 10,000 G you know it's per thousand per thousand gallons so per thousand yeah so like for example if you're going to use 3,000 gallons in Park City you pay 5773 and then 719 time 3 yep is what you would pay now if you used 6,000 gallons you would pay 5773 plus 719 * 5,000 plus 949 time 1,000 that making sense so 40,000 gallons plus they're paying $360 yeah per th000 gallons no $36 216 $36 yeah yeah I threw this in there just to show you that is that is a bunch of money bunch of money yeah when we just that's a great slide when we show this to the public maybe say cost for 10,000 gallons in the right call I gotcha gotcha okay I clean that up thank you so staff came up with minimum recommendation we understand the nature of police is going up Ems is going up there's just so many things are going up right now but we are behind on our water rate and we need to catch up and so what we are proposing similar to the 911 fee uh kind of a bigger bump this year in the base rate and then a dollar per year thereafter for at least the next five years this will move our B rate up to about 49% of our expenses and then we have a small increase on the tiered rate and again just to reemphasize how important it is soon as we get that new well done we need to kind of re look at all this figure out exactly where we are get our impact fee in place as much as possible now there was also another idea that this fairly new Tom it's funny because Tom brought up to my attention the same day I was sitting in a meeting that it came up later in the same meeting but people are charging a different rate for new development so they're they're charging an impact fee but any new development say like you have a new townhouse they're going to pay a different rate for a period of time and then it will fall back to the other rate now I got all I mean it it's kind of P my interest but we have a hard enough time keeping track and making sure people paying the rate they're supposed to be paying without that comp complication so I'm not saying that's hot on our mind but it's it's at least it's an idea to talk about or yeah it's exactly what it is and you yeah so you still have to do a lot of the same I mean you could do it but you're probably going to get sued unless you do a lot of the similar studies and calculations as you would an impact fee so I'm not saying it's worth I'm just saying like people are trying to get creative out there and water rates are on top of everybody's mind as water becomes more and more scarce and conservation is talked about more and more so what does that do I pulled a bunch of random residents across the city to just show you what that increase of $2 in the base rate and 5 cents on the each tier and you can see that uh is an increase of 8 to 11% on the few there 7 to 11 so you know you're kind of again it's it's almost the base rate does sort of penalize the people that use less water yes yeah so roughly doing what we talked about you're looking at a 7 to 11% raise for a normal-ish situation normal home out yeah that is for you to figure out I also looked at some

commercial doesn't seem to impact the commercials quite as hard they really just like there not that many commercial to really impact the budget they a lot of the commercials have not a lot some of the commercials have 2 in years so they pay a larger base rate but it's just there's so few of them that it doesn't have a huge impact on the budget that's something you could also look at is some cities will charge more for their commercial rates but I just again we have so little that I don't feel like it would impact the budget much and it's probably not worth upsetting them or trying you trying to we've talked about incentivizing Economic Development rather than punishing them so I don't really at this point think we need to move forward with any separate rate for commercial uh institutional would be your churches your schools I did reach out to some of the schools and in particular USU because they use a lot of water out at the South Farm at the advanced science building I didn't hear anything back from them it's a pretty small increase for them in the less than $200 I think one of those school on a church and want USU so anyway you can see that it's a the end that's the end you know it's it's small impact but again it's this is the middle that staff fills we should do and if Levi you'll jump on there's a the spreadsheet I can show you the model and the spreadsheet and how we can play with things so what we're asking you guys is is are we on the right track do you feel like we should be trying to bite off more do you think we should be biting off less would you rather see us attack the tiers or would you rather see us attack the base rate more we're kind of looking for guidance and direction from you on how you would like to do it this is our proposal this is well I'll back that up a little this is mostly my proposal I think the rest of Staff obviously would like to see it more see you know they like they have some projects things they they like to do but they have they recognize the you know political environment that we're in right now and this is an increase and if this works if we if we do this we have the ability to go get the loan to get the new well in place and start moving forward so again I I don't know if you care I can show you how the spreadsheet works if you want to sit down later there's a whole tab where you can can type in a usage and it will show you every city in the valley how much that's going to cost for comparison I just I'm looking for your guys Direction on anything you want to tell us on how to tackle this before we bring back a resolution and a post actual fee increase and also timing I am of the opinion we need to get this done quicker the better yeah for not careful we'll be doing like we're doing we are do fee increases and we might be running up against our fiscal year and wondering about property taxes at the same time right be a double wh right um one question does anybody any municipality that you know of and with State allow or does it just not make sense it does instead of a tier grade that is tiered with number of gallons through a meter is there anyone that's normalizing that by the acreage the square footage served by that meter you see what I'm saying I mean yeah what if I'm not saying it's a smart thing to do but with a rural Heritage and maybe somebody doesn't have access to secondary water maybe they have a now a half acre horse pasture right we were're allowed that so they we want them to keep that horse pasture watered um but that means they run more water through that meter and they get up into a chair grade to keep that pasture green maybe it's an acre maybe it gets there more quickly so you know the thought of normalizing the tear grate by the number of Acres served by that meter I've never heard of anybody doing that it's complicated yeah you guys see what I'm saying ahead yeah so I I think it's good because I have S questions the different ways we keep ra but I think what would be important to know first is what capabilities and resources do we have software wise and stuff to even implemented stuff like that or seasonal rates like is it even a thing that our current resources do certainly not the acreage that would be a super lab intensive for us right now yeah we' have a lot of programming I mean one time programming doesn't have to be changed every mon because the CH okay I'm fine you think about what we do right we drive around the city we read a meter that's been turning for a mon so power certainly demand based so that's

good yeah I I mean I don't actually do you think people what where are our usage sorry I'm jumping okay is there a time of day when our water usage is higher in summer for example do people water at night or do they water at day I it's with the day with the software that we have we don't know we're not certain but I am fairly confident that people are watering in the nighttime because the wells kick on at about 11:00 and they run and you can see the level of the tank does take a dramatic like uptick in the morning when people are kind of done watering and the well is still running so good so I have some indication that they're watering at night but I don't have real accurate dat data now backing up just a little bit to maybe what where n was headed and you mentioned with the power there are more sophisticated meters out there and there are more sophisticated meter reading technologies that are expensive but they are real time like that's one of the conservation measures that the state is pushing is the ability for a person to have an app on their phone that tells them how much water they've used this month and whether they're red they're green they're behind behind where were they compared to the last month and it's it's real time data a lot of the big water districts are trying to push that and do things like that but you're talking towers with radio communication that read it's a pretty pricey system So currently we do not have that technology that's not something we really looked into just to haven't thought that it would be worth the effort the n what what I would love to see but that's kind of geeking out on stuff is we would have a tear r that allowed extra water usage without penalty when mother nature set up weather conditions that needed more water on a landscape but I mean the the water usage during the irrigation season turf grass irrigation season from I don't know let's say April to October changes by about a factor of three depending on air temperature solar radiation wind speed I mean relative humidity it's so what we really want is people to modify their irrigation schedule with conservation based on what the actual demand is instead of automatic water sprinkler system set it together you know and middle of obviously grass gets a little dry until they go Crank It Up and they never crank it back down right so I mean we could get those EV transpiration numbers from that weather station out there by rideline and if we really wanted to geek out on this we could have a tiar bre depended on what landscape demand is and how people modify their irrigation usage based on the weather demand the weather driven demand and yeah that's ask the question I know there's different structures that we could do that cover what we need with the base grade right but then even like by Zone agricultural Zone but sometimes I see cities do because they're using so water what that are supposed to be doing and maybe that's a way to incentivize agriculture Incorporated the ni there's a lot that could be done but I wanted to know what our software capabilities were they would need to be improved drastically but also those things are great to think about but you really got to think of the bulk of nle City yeah is just so far from that and places that have one acre pastures or two acre pastures typically currently have secondary water yeah they can't afford it other wise yeah half half acre half AC of C grass is expensive how much is your water build in sum time people talk about or a I had every day either a typical yard in New City over a year this summer you're I think you're in a about the ballark of four to 500 bucks the max per month or the average per month that's what the you'll pay a year for year for the season you're going to go the total year yeah so I took I have a spreadsheet somewhere that shows a base usage which should be kind of your typical indoor and I subtracted the usage out a bunch I be on that same but I the I I can hammer down on this but I'm pretty certain a typical yard if you want to have a typical yard and do a decent job of trying to maintain green grassp and still conserve your you're going to be about 4 to 500 bucks more than somebody that's just paying the base rate for the entire irrigation season which means the whole year because right that's not bad no that tells me it tells me we should maybe increase the usage and not rely so heavily on the base increas yeah think shortterm see i' more aggressive care and are you saying as well that maybe instead of I think we looked at a scenario of increasing the base rate but leaving the usage at least after the first 5,000 gallons still at a dollar for 10,000 what if we yeah don't jack up the basee but but on all the usage not only the teered usage but all the usages we look at a higher rate for 10,000 okay I think that encourages conservation more so than a higher base although it's less predictable as you said I mean whether depend the perimeter now like guess you wouldn't call highest defend users in the summer most were institutional like Heritage Elementary which blows my mind because kids aren't there so that that means it's outside yeah there's no question that outside watering is is that's that's where we make our money yeah and that's where all I mean it's there's no question there's isn't it about 60% of the total culinary for irrigation when we when we uh when we cash in a surface water right or share from a canal company we don't have to trade an acre foot per acre foot isn't it like we traded one acre we traded 610 of an acre foot and we can pull one acre foot out of the ground because something like that it's about four times four times about four times more to irrigate than it is for a single home like it it's the a single home for example would be over the course of a year about 45 acre feet okay while an acre of irrigated land would be 1.8 89 acre feet okay 25% depends

so wait this sort of started a year ago in April when the HM Library submitted to us their annual Bill we asked for a little bit information we really kind of ran into roadblocks and some issues with why they were billing us the number that they were billing us and so it caused a lot of concern at that time but also I think it opened their eyes to really how they were doing it with silly and how they were trying to do it with her active account and the level of effort that they were going through to show how many active accounts they had was substantial amount of effort without a lot of here's the result and it could never provide a list that said there are this many number of active accounts in nii and I think they realized that I wasn't happy about that and so part of this problem might be my fault for them coming up with a different way to charge us for Library services but I agree with them that charging us per what they proposed was to char instead of charging us active accounts they would charge us for every basically just the number of homes in Ni City similar to 911 similar to with the garbage they would just take the number of homes they would times it by a rate and that's what we would pay into the system into the H library system for so that anyone in Ni could then go and be part of and utilize the services the iron Library yeah I don't think it's all your fault I think there's also iron council member or two I don't know that have concerns that that H is over subsidizing the library we're not paying our fair share right and you can see that in the number per active user active user at hm city is about almost 200 bucks where we're only paying 44 bucks and they just felt that that Gap was pretty large and that it needed to be narrowed so when you go to the per home in higher Ro it's about 100 bucks which ironically is I think coincidentally pretty close to what North Logan charges per 100 bucks per household so we're still 100 bucks to 44 but they've said they would drop it to it started at 30 they said they would drop it to 25 when they went to Wellsville so they there the proposal right now is 25 bucks per household in nible city is what we would pay into the high library system so we asked you know why what's the reason second question you ask 911 they're listed in the packet there was some things they would like to increase products they would like to purchase online services talk a lot about the salaries and a lot of the increases that's going on but when I'm sorry I'm kind of all over the place on this because I don't really know it's one of those things Mar and I had a lot of discussions on it's like I I I if we're just to accept this I got to swallow a lot of Pride because I got a lot of questions but I don't know that thing they are increasing it a dollar every year thereafter for five years and then like 50 cents after that for a year so the first year is about a 30 30ish per increase thereafter when we consider uh growth in the city plus their increase you're looking at about a 7% increase to our budget right so it's about a 30% increase the first year and then after that it's a dollar on $25 so that's about a 4% increase without growth right yeah I'm I'm showing about a 3% growth in number of homes three and a half so it's that first increase that I think it's a little hard to swallow maybe it's because they have ra the rates in the long time 30% increase in one year's P so do citizens they currently opt in or out of the re just yeah if you go to hirum show them prove to them that you live in nibi then they create an active account for you and they charge nible City now they also they charge $44 but if that same family wants an online library they charge nibbly another $44 and that's where it got fuzzy and not a low of backup to their billing uh that's a good question I don't think so yeah yeah I would have to look on that and as we as May and I discuss is we were hoping to have a workshop with a council member SL representative here to Workshop this discuss this before we brought back any uh resolution and I can't why I started to tell you that it's getting another I mean there's there we will reimburse your household by the $70 per household charge that hiring would charge you to go there and use their Library as a non-resident um so they hated that idea because that means there might be limited people using their library because there's a barrier even though the proposal was look they pay the bill they bring us the receipt and we reimburse it um again they hated it because I think what they want to be is we're a free library they want people to go to that Library as if it were free and not have people realize that they're someone is paying for a bus so if if we did a reimbursement kind of idea you say all right we're not going to do the local agreement anymore we just have an agreement with our citizens that they go pay the 70 bucks they come to us we repay them um we would have to have a the break even on that would be if 36% of our households use the H Library well they could if we said you know if if if a walked in the hbr library and we said and they said I want to buy a family Library C I said okay 70 bucks you're non-resident 70 bucks now that person brings that receipt for $70 the H librar is out of the accounting business they just say you're non-resident 70 bucks they don't have to count all the nii residents that use it spend literally they say four man months person months counting how many nibbly people use the hro library that's how much of a burden it is said well we'll leave you of that just charge anyone outside of hrum 70 bucks and we'll tell our residents they bring the receipt to nibble City Hall and we'll reimburse them 70 bucks and and and if 36% of our households did that we would pay the same amount of money as reimbursements to our residents as we would pay to hym library at $25 for garbage C does that make sense are you with me so more than 36% use the IR Library we pay more because we're reimbursing more people if less than 36% um went to the library we save money again the advantage to me is people recognize that libraries aren't free and nly city is paying for their access to the hym library now turns out by mere coincidence as we compare notes on this according to the higher numbers of how many people in nibi use their library and how they have been charging us but want to get away from it's right at 35% of Ni residents household use the G charts ni c g charts for about 35% of our household using the so I thought about that since we look at that number but of the number higher TOS we don't know what percentage of that is Families versus online the other thing we don't no the other thing they they she said was if an 18-year-old walks in there and his family already has an account doesn't matter he can request another account because he's over 18 they have to give him an account so now we're paying for the family we're paying for potentially anybody over 18 in the same house plus we're paying for online access so we could have three to four accounts for every single house so I don't know of those active users how many of them are actually homes or houses and how would we structure our reimbursement would it just be your family in a house would it be your online access an 18 if you're a nony resident and your family has a library C at hyro and I live at home and I'm over 18 and I also want to go to the high Library would they charge me another 70 bucks or works is that if you're going to live in a house for 30 years at least be a co-owner in that house you don't have to own the whole thing because of the economy of scam but at least be a co-owner in we've gotten from residents but on specifically on parking enforcement and Steve said he has seen a significant difference in the amount of vehicles that are out there which which the plow the snowplow drivers um are are thankful for so you know code enforcement officer is a pretty thankless job it's always described as but it it is it is I think effective at achieving some of the goals we're we're trying to achieve with that other than that I think I think I'll leave at that try to get home by my birthday it's my Bri's birthday for another 25 minutes okay so well I'll switch there was a little glitch in the 13 contract I think we worked want to get it on the agenda we'll bring it to council the next week what's the 13 and it's grand season right now we two GRS at least one to complete the bike track at City Center Park for purposes of the grant I'm keeping it the Ridgeline Park just so it doesn't get all confusing with our grant applications but the other one we're looking at is a CPR Grant through the same organization for to try to help rebuild the the softball field at and Park so we're hoping that one's pretty competitive I'm not really too high hopes on that but there's still some hope there um we have two interns that are um have entered our Recreation Bo camp we love our intern we like um it's Jaden Beach and Hanah so so far so good as far as I can observe but you get Scoop from chat and then Talent said please let everyone know that it's quite icy outside Char treading I just got a couple things quick um it's budget season as we've already indicated a little bit I know we're a little early but if there's something in particular you want to talk about something you want to tackle something you want to do please let's get after it come talk to me uh in addition we had some discussions it's bounced and changed over the years but if there's a particular department or something that you want to sit down and be a part of the early process of we welcome any and all participation that you guys want to have I know some staff uh appreciates that and feels like you know that you're showing support and things are working out but others just you stud uh conference um interesting I learned just last week uh Mr Val Potter former uh legislator is now staff for uh Senator Curtis on a federal level so that's interesting if you know him and a govern relationship with him you might be able to have some conversation pretty busy obviously with h it's new to him as well as the senator so he's out about doing a lot of things but that that was pretty interesting to me um to find out it is also the midle middle of legislative session I'm sure you saw a lot in the media and in the news if you have questions or concerns things you want to talk about happy to do so I'm doing my best keep up on there's a lot of moving stuff um does feel a little less weighty than last year as far as development discussions there's there's a couple Brewing big ones but there's some that were pretty big that have already been killed um so it seems like we're in a little better place as far as being told what to do with affordable housing than they have been in the past and development there has been some change with building permits and some shot clocks put on us for building permits but that's not anything too crazy um anyway I'm trying to keep up on kind of complicated but maybe it's okay I don't know I think if we make our town hall available to any of the federal Representatives Democrats fine they have to pay the fee okay and so they are governmental but not on our government list all right if you guys are okay with that I'm going telling they can run that town hall Town Halls are pretty popular at the moment by the way so we might
