go. Alright. Welcome, everyone. This is the Hyde Park City Planning Commission meeting, 10/01/2025. And we excuse Ned Hansen today. He is out of town, and all the other commissioners are here. Right. Open your remarks. Well, we'll just go with what we've done in the past, and I'll open it with a word of prayer, and then we'll have the pledge of allegiance. Our father in heaven, we're grateful this day for many blessings. We are grateful for our city. We're grateful that we could be here in service to our citizens here in the community. We pray that we might be able to know what we might do for our city to improve it, to bring it together. We're grateful for this land that we live in. We pray for our leaders at this time that they might be able to work together, come to a decision. We're grateful for all the many blessings that we have, and we remember them. We say these things in the name of Jesus Christ. Amen. Amen. Please rise. K. Alright. Let us go to the approval of the minutes. And are there any changes that anyone's aware of that needs to be made, additions or corrections or deletions? There is a yellow highlighted area on page two. Do we need to discuss that?
There were a few places that I wondered about changing them, but I didn't know if it changed the substance. What did you end up doing with those three that I submitted to you, Colette? K. When I highlighted it, I put a note in the side, but I don't know if those notes are still there. Does it have my comment on the side or no? Do you want me to pull that up on here? If you click on it, will it You can delete can Yes. Oh, there's three comments. I wondered if we yeah. On that first one, I wondered if it should say every instead of any application, I wondered if it should say every application.

And then the next one, delete can. Yeah. It's almost like saying they will include. You know? Mhmm. But Either will. They won't. Either will or they yeah. They can, but they don't have to is what Yeah. I mean, does that mean they may? Anyway, I didn't know on that one.

The item was heard at the DRC this morning, but there was too many things they still had to fix. And so they they were not ready to be presented tonight to the planning commission. Which is another reason why we need to talk about the previous items on the list
so that they don't wait till the next DRC to get it Yeah. Approved. Yep. K. Do we may need to make a motion on the change in the agenda? I don't think so. It didn't last time. K. I think this Just so everyone's aware, we are not going to be discussing item five c because there are still some items that need to be corrected. Alright. Is
Mikael here? Mikaela is not here tonight. There were not a ton of updates that she had to share at the planning staff report because the planning department has been busy trying to get the DRC settled and working on the code updates for tonight. So
K. Alright. So item four is complete. Let's jump to the action items, which is a public hearing for ordinance, twenty twenty five dash 22, an ordinance approving approving revisions to sections twelve and thirteen of the land use code shown in exhibits a through d. Marcus, could you let us explain that?
Yeah. I'll go through this briefly. This commission has heard this for this is what? The third or fourth meeting in a row and that we've talked about this. But for the benefit of those who may be here for the public hearing, All of the changes, there's a lot of changes, but they all center around a few themes. First of all is the city's development review committee. It's been a bottleneck and a problem for applications for land use applications that come through the city, and so a lot of the changes focus on moving the DRC from being a land use authority and having to do public meetings to just a reviewing body for these plans so that they no longer have to wait for a public meeting cycle to do plan reviews. That's most of the edits are on there. Like, exhibit a and exhibit d both deal with that. Exhibit a talks about it in the general land use processes. Exhibit d focuses on just the subdivision processes. The other changes that we're doing is for applications, any land use applications, we're gonna require title report, owner agent agreement, and a survey if applicable. Sometimes Utah state law says that we don't have to do surveys. So when that's the case, we'll go around that. Well, not go around it, but we will use that to not require the surveys. But what we found is in our previous land use history, there'd been a lot of times where people had made decisions and submitted applications for property that maybe you shouldn't have. And so we're just gonna start doing more strict verifications on people coming in to apply for subdivisions and rezones and whatnot. And then we're also simplifying the application process. There's a lot of language in exhibit a and exhibit d that talked about how all the applications have to be reviewed by a lot of different people, planning commissions, city councils. So we're cutting a lot of that back to simplify the application processes for all sorts of things, basically, any land use applications in the city. Either the other big change is changing how the city processes fees. So we used to say an application would not be reviewed until the city received a payment. We're changing that to say that we're gonna review your application for completeness, and then we'll take people's money because we had a few times where we get an application, then we have to issue refunds because an application is not complete or it doesn't go through. So you don't wanna be taking people's money until we know that they're ready to move through the process. That's the summary of exhibits a and d. Exhibit b really centers around one section here. There's a bit of a typo here. It says we're taking out all of section twelve dot thirty dot zero three zero. Really, we're gonna leave it there and just put it as reserved. So we're gonna keep that section, but we're eliminating these codes with parcel splits and predevelopment splits. And as we've talked about, this encourages people to do basically illegal subdivisions and then come back to the city and ask for forgiveness. And so with us updating all of our processes and applications, we're making the subdivision process a little easier. And so to stop muddying the waters, we're just eliminating this and telling everybody they gotta go through a subdivision process if they wanna split up their property. And then exhibit c is the final piece to the DRC revisions. This is the DRC ordinance that talks about who's in it, how it's done. We're eliminating this section right here that requires that we keep a public record of the proceedings to be filed with the city recorder, which is essentially minutes. And what this we're going to do instead is whenever there's a review of a plan, we'll attach those comments to the applications that are submitted and keep the records in in the application for us and the applicant to see. One question that I have for the planning commission that we haven't discussed that should be discussed after the public hearing is right now, the planning commissioner, chairperson, or designee is required to be a member of the DRC. And now that we have a city planner and a more robust city staff doing these reviews, the question that we have is, would the planning commission still like a seat at the table? So after the public hearing, that'd be a good discussion to have.

Twenty twenty five dash 22, an ordinance approving the revisions to sections twelve and thirteen of the land use code shown in exhibits a through d. And seeing no movement, we will close the public hearing. Alright? And then we'll open up to discussion. I think the other thing that we did was we or Mikael changed language, so it was the same throughout the code. So she per one thing was the Site review. Instead of the
Development review? Development plan. Yeah. Like, they have site review as a because that's what words we use somewhere else. Mhmm. So that one's kind of a side project to this one. This one's really focused on what we talked about. And as we are going, the next big round of updates is all about vocabulary and definitions, specifically making sure that we're are clear on what each thing means in the code, and we're not calling things by incorrect names. K.

It's ordinance twenty twenty five dash 21 r z, an ordinance approving a zoning map amendment for a portion of property located at approximately 520 South 100 West Hyde Park, inside Parcel 04 Dash 0305 Dash 0012, and a portion of property located at approximately 20 I'm sorry. 221 North 700 East Hyde Park, inside Parcel 04 Dash 005 Dash 0024, amending the approximately point seven acres from an r from an a to an r two zone to accommodate the Berry Hollow Ridge subdivision plat. That was a mouthful. Yeah. Alright. Marcus, please.
Yeah. So this can get confusing, and I'm gonna do a little bit of background that we don't normally do for rezones just to explain how we got here. So in the box, there's a folder that says additional info not to be considered when voting. So this is not to be considered, but for maybe some of our newer planning commissioners who don't remember, the Berry Hollow Ridge subdivision is located in this area of town, 160 North 700 East. The subdivision itself has already been approved, but our new city planner encountered a problem with the plat when it came to be recorded, and that is about our ordinance. Says that the subdivision needs to be all the same zone. So we're not looking at the subdivision plat or the number of lots or the infrastructure. All we're looking at is essentially the color of the property, if you will. Inbox here, I'll pull up this survey. What we're talking about is just rezoning the single triangle of property right there and about half of mister Elder's property where his home sits, and we're rezoning them from the agricultural zone to R two to match the rest of the subdivision. This triangle happened. There's a property swap with this owner here to try and accommodate the ravine and make the development a little more smooth. And then this portion of the property is going to be creating a new building lot in the subdivision. So the subdivision itself is not up for discussion. It's already been approved. This is simply a cleanup item to make sure that the plat and the subdivision follow the codes. K.
Alright. Then we will open up the public hearing about the rezone of these two pea pieces of property. Always wonder if there's a yes. Please come to the microphone.
This impacts Gary and his property. So can I can I just ask, Reid, does this impact having four billing months on the West side of the canal, or it's just above? Right? No. This is just changing my product, which is agricultural.
Where the hollow is. It's gonna be filled in with the valid company project. K. That is that is on the day in order to make it match according to city ordinance. It has to be resolved up by number two. Which is two two loss per week. Yeah. But that doesn't include It's it's what we already exist. That's what we exist as now. It used to be already 20.
So so the property on the west side of the tenant now that borders Jerry and I, that's That's still that's all r eight twenty now. So that's just two lots?
Well, it's R 820, and then it depends how you develop.
It's no more than two lots per Unless you do more than that. So you could have four lots there. No more than two.
No more than two on the two and a half acres. No more than two per acre. Two per acre. So that still could be full. Awesome. That's all. Yes.
Like we said, the last note, this
is the house we we we need to clean up. We need to open this. We just wanted to be aware of exactly what impact it could have on our properties as far as roads, drainage, snow removal, and all of that. If that's still two homes or if it's possibly four homes back there, that's maybe has some impact on us also.

Right. The subdivision itself has been approved. The number of houses there is gonna be the same. This is just It doesn't make any difference or decrease anything. Right. We're not changing the number of houses that have already been approved to be built there in the r two zone of bonus density. All we're doing is changing color the color on the map so that it's all the same color as is required by our city code. Can you pull up the subdivision and, like, kinda show the way? Give me a minute. I can pull up I I don't have it in this folder, but I can find it in a previous meeting.

are gonna be changed. Right. And nothing none of that's changing. We're just No. Property lines color on the zoning map. Exactly. Property lines
oh, just kidding. That's the other triangle. The property lines are not changing. K. What's changing is colors on the map, the zoning. It's just a zoning change heat. Right. So this this is going to stay the same.

Originally, we had a hiccup because this triangle is technically the wrong color too, but because that is not really part of the subdivision, we dropped that off and just had the property within the subdivision get is applying for the rezone.

Yeah. So the lot configurations is staying the same. The number of lots is staying the same. Yeah. It's just over there. The color. Right. It The number. Increasing any It does not It's not changing anything with the subdivision.

Yep. So Looks like they painted into a corner and forgot to paint that last little corner. Yeah. And, you know, it's
mister Elder has been very patient and nice with us as we discovered this with him, that there's this provision of the code that says it needs to be this way. So we appreciate his patience with us as we get this presented to you tonight. And it goes without saying city staff is fully supportive of this reach zone, and you can see that in the staff report that Mikel prepared for you. K.
I guess, really, at this point, we're supposed to make a motion and then discuss it if there's more discussion, more questions.

The next batch of items we'll be preparing is more code updates, like I said earlier about definitions and vocabulary, making sure that we are calling site plan site plans, master plans, master plans, and we're not mixing terms because we have that in some spots in the subdivision and other land use codes. They kinda get interchanged and exchanged. So we fixed a handful of those with these edits, but we gotta dive in and find the rest, which is what we're working on right now. Are there any things that were discussed in the DRC meeting today that will be at the next meeting? Potentially, yeah. So the hazard entities proposal, I believe you've looked at it was, oh, back in June now. It's a auto body shop that's gonna specialize in customizing Jeeps. They're looking at building a a building down kind of on Center Street, but the other side of the highway just past where the Public Works Building is.
And we have looked at this before, but we tabled it just so everyone Right. Saw where It got tabled. There were some issues with the storm drainage and the parking.
It took them a minute because it's a very difficult site for storm drainage. But at the DRC today, it was they had a pretty good solution. The engineers just need a little more time to check the math, but that one's probably gonna come back and be ready for a vote. Muir Village is going to be ready for a vote here pretty soon. Their hiccup was they decided to split their project. And in doing so, there was a couple of new comments that happened with temporary fire truck turnarounds and water looping to make sure that the fire flows were still there. So those will be coming soon.
