clears throat

the only red line item? there might be more red lines um come into play as this easement is verified. Um I know that there were as many as eight pages of red lines at the time that this application came before the city and I can neither conf I cannot confirm that all of those red lines have been um taken care of. Mayor, yes, if I might. >> When did the current owner acquire the property? I don't remember that was >> I don't know when the sale from the Chyros folks um happened, but I believe the applicant and the applicant's representatives are here and that's a question that maybe they could. >> We'll ask them in a minute. >> Okay, >> we'll give them time to speak. Um, Muel, can you explain to the council and I guess to everyone here what if we revoke the Arya, where does that leave them and what what is that? >> So, revoking approval of the subdivision means that they would have to reapply for this subdivision and that their plant and plans would have to be reapproved by the city with the current MXD code that's in place. Now, um, as you know, we closed MXD to development, um, a few weeks ago, preparing to adopt some new zones. And so, they would have to probably make some choices whether they wanted to wait for the highdensity zoning to be adopted so that they could do just residential or if they wanted to reszone to commercial and maybe do a commercial development. Um, or they could always appeal our decision. >> Thank you. Any other questions for staff council? Okay. Is there anyone here representing the area? Would you come and state your name and we'll give you a few minutes to tell us your side of the story. >> Great. Thank you. Uh my name is Stephen Hwitt representing uh Fuang, the owner of

the Arya. Um I also in attendance is our attorney, Mr. Wilder who may want to take a few minutes as well or at least make a few statements in um just answering a couple of those questions that did come up. Uh we acquired the property the end of April 2025. >> Yes. And uh shortly thereafter, oh no, end of March, excuse me. End of March 2025. We began our um storm sewer installation that following month and our storm sewer is complete and that's where we ran into our issues with with the sewer. So um uh I'm sorry. What was one of the other questions that you had for in spec that was specifically asked? >> That was the initial one. When did you acquire the property and when did you disco when did you discover that there was a >> So we were we were rep the property was represented as shovel ready and the reason we believe that as well as not only being um represented by the seller as shovel ready, it was a recorded plat with the county. So all the red lines, you know, so the city obviously approved it to be passed along to the county to be recorded. So each individual um unit already has a tax ID established by the county. And so as far as we're aware, the only red line to answer the question there, the only red line existing is that of the sewer. Um I do have some, you know, some statements I wanted to make sure I I presented, so I I prefer to read those just to make sure I get those out properly. Um uh respectfully I'm here to ask the city not to revoke this project's approval. The project not abandoned and it has not been ignored. It is fully approved, platted and in a recorded subdivision. Uh we have invested several million dollars in it, have active construction financing through First Bank of Utah, which not only handles the horizontal but also our vertical construction as well, which is all in place. Um uh we started construction on site in April 2026 and been working continuously to resolve the sewer access issue. uh that prevented us moving forward on the next phase of work. Um the project had received final plat on August 14th, 2024. The civil improvement plans were approved on September 4, 2024, and the subdivision myar was recorded with Cash County on November 7th, 2024. The subdivision includes individual tax identification numbers for each of the units. Um, and as I said, as I stated, when we um purchased the property, it appeared as if everything has been had been fully entitled and recorded and de and development ready to begin. Um, before starting work, we intentionally held a pre-construction meeting with the city and the city's third party investigation group, inspection group. Uh, and we did not begin work without coordination or authorization. The city and the third party inspectors were aware that construction was moving forward with our storm sewer and we began physical work on the site. uh we completed the on-site storm work uh which was viewed and approved by both the city and the third party inspection group. So this confirms that we had authorization to be begin the construction for what we have began to work on within a reasonable time frame of what is required of us as the development uh to begin the next logist the next logical and scheduled phase of the construction work was the sanitary sewer and as we um prepared to submit our application for approval it was denied uh until we were able to obtain that easement which we had then been made aware of in about that time frame. Uh there were some other works in the process of trying to get a lift station approved and and that would um be privately held on the property and maintained by the HOA that was kind of um shot down or or said or we were told that we would have to go through resubmitt with the county from the very beginning. So that obviously wasn't a wasn't a um an option for us to proceed with. Um so with that being said, we were told that we could we would be able to um continue at our own risk um you know with not having anything approved by the city or anything in in line and lined up with our um with our easement. Um we did not know that there was an unresolved off-site sewer um issue until this pretty much came up. Um we didn't simply wait, we acted first. First, we approached the owner of the property south of the the project and at that time the property was for sale. So, that was where the original um easement was um proposed to go through was the property to the south. They had the property on under um for sale and didn't want to mess with anything um until they knew what was happening with the sale or if they were going to keep it. Uh we then approached the neighbor to the west of us and we proposed multiple options, multiple routes, multiple um drawings. We had our surveyor um uh prepare several different easements uh um surveyed and platted and everything like that ready to be signed and recorded but um he was uh not um cooperative and he didn't have any reason to be as well. I mean it's not it wasn't on him to to to um to bail us out in any way whatsoever. Um luckily you know recently the project to the south they have decided since to develop the property themselves and so we have purchased the easement. Uh the easement that is in is in hand by the um city right now is the exact easement that's shown on the original um uh approved with um pending um easement to the south property. So it's exactly what was on the original drawings. Um the reason it's not recorded and that we have it there is um we had a we we are having to pay a substantial amount for it and that money is being held in escrow and you know and uh will not be released until the the easement itself is recorded and so we just wanted to make sure to see how things proceed here before we have that money released because it's not only have we invested several you know million dollars into the project so far this this um represents another investment of several hundred,000. So that's why we haven't um h that's why it's in that state as just signed and notorized right now. Um we've already uh we we asked that the current or future application that we are going to uh present for permit also be reviewed fairly um according to what had been originally submitted and approved and and recorded uh with the county. Uh the city ordinance does not require automatic revocation simply because time has passed. As we understand it, Hideard uh Hide Park Municipal Code 12.270.060 provides alternatives uh such as an extension, revocation or amendment of the approved development plan. The facts here strongly support allowing the project to proceed or at a minimum granting extension or narrowly tailor uh tailored sewer service amendment. Um tonight we respectfully ask that you know um the city um that the city decline to revoke the project's approval or recorded subdivision, allow us to proceed under the approved plans now that the sewer easement has been obtained. Um and also ensure that our application receive a fair um review from the city which which we expect that it will. We want to be a construction partner with Hide Park City. We want to complete the infrastructure, begin the vertical phase and deliver the project that has already been approved. Regation would not solve the sewer issue. The easement has now been secured. It would only undo substantial work and investment that we've already placed into the property. Um to give you an idea of the amount of uh storm sewer that has been placed, all of the um the storm sewer retention is held on site underground. And all that is in and it's not you can't see it if you just drive by, but it's a substantial investment of eight or $900,000 just in that work that was performed in that sewer retention system that's that's already there on site. Um we worked uh diligently to solve this problem. As I said, you know, we've been in the background 100% trying to um get this an easement. However, we were able to to make it happen. And with involvement of some other u members of the community, we we were able to get back in touch with the neighbor to the south of us to to get this to get this easement recorded. Um we respectfully ask that you just consider uh these statements and the new information that's come about with this easement. and uh uh we thank you for your time. >> Thank you, Mr. Huitt. Council, do you have any questions for Mr. H? >> Yeah, I have a question. >> Council member Row, >> um when you you stated that you found out about this after the fact, um did did the people that you bought it from fail to tell you? >> Yes. So that's what >> they represented the project as shovel ready uh shovel ready fully entitled and project recorded and um platted with the city you know preliminary plat approval already taken care of as already you know representing to us with you presenting with us the myars this the county recorded myarsars so that's another issue that that we're working on with with the seller I know and and that seller is a big problem with why we were unable to obtain in the easement. Um, a lot of the neighbors around there were very upset with them and um, at the beginning did not want to even talk to us at all because they thought we were still involved with them until they realized that that we weren't that we were a completely different party. Then they warmed up to to at least entertaining some conversation and and and some dialogue. >> Any other questions? All right. Thank you, Miss. At this time, we'll open the public hearing for the relocation of the Arya mixed project. Um, again, you'll have three minutes. I'll try to keep it to three minutes. Uh, Craig Winder, I represent uh, however we say it, is itang? >> I represent Swang LLC. They're the developer, the owner and developer of this project. I just want to make a couple of points that have some pretty significant well that have legal significance. Number one, we have a recorded plat. Um that matters. Uh a plat is legal rights. It is the legal reality once it has been recorded. I don't know how that plaque got recorded when we didn't have a sewer easement. I don't know how the city missed that. And we're fine with mistakes. Mistakes happen. We're fine with everyone's humanity because I have my own humanity that that you know I make mistakes all the time. But for city staff to turn around and then recommend revocation when they have played a significant role in my client's inability to develop this property. That's pretty antagonistic. We received this letter from city staff. It's looks like it was written by male Leightton and it states letter for revocation of MDX project approval. And then it says it it cites the appropriate ordinance where it says that the zoning administrator, I'm assuming that's male Leighton, shall review the MXD project. We haven't seen any type of review when we requested it in a letter and recommend to the land use authority in a public hearing either either an extension of the time limit, a revocation of the approval or amendment to the approved development plan. My clients have made very clear to city staff that they have actively pursued a sewer easement that they have had multiple contacts with the two property owners that that would make such an easement possible. The city's aware of that. They've been aware of that. The city's aware of the easement problem. The city's aware that my clients have intended to move forward but for that easement issue to put 8 to 900,000 of infrastructure in already. That's not little to no development and I apologize for being a little heated today. I represent several developers and builders who are currently working with the city of Hide Park. And I have to say that this level of antagonism is not unique to this project. And I'm not talking about the city council and I'm not talking about the planning commission. I'm talking about instances where a contractor will come into the city, hand an application in, and before it's even looked at, receive some snide comment that, you know, this isn't going to be approved. That is uncalled for. >> Thank you for your comments, Mr. Binder. Okay, with no other comments, we'll close the public hearing. make a motion that we give um a 60-day extension to um record their sewer um easement. I'll second it. I wasn't going to go for 60 days, but in this case, I'll I'll second that motion. >> Okay, we have Hold on one second. We have a motion by Council Member Alred and a second by Council Member FA to give a 60-day extension um for the RM mixeduse project. Um further discussion, Council Member Brower. Before we move forward, I think we need to make sure that it we take care of any possible red lines so that we don't have this go through again. I mean, in 60 days, you should be able to work those things out. One of the things that we heard tonight, so we were presented the easement today. On its face, it appears to be bonafide, but we heard tonight during the hearing that it's actually in escrow and hasn't been paid for. So >> that you miss it has been paid for. The money is in the money and the agreement are in. >> So if the >> call to order, please. >> If the if the easement is in escrow, it's not a valid easement yet. So, what we'd like to see is the escrow agreement so we know under what conditions it could be used. The second issue is since the staff hasn't had a chance to investigate it, it would be useful to see does this solve the problem in addition to Councilman Brower's questions as to the red lines. I think that's all appropriate and should be investigated um as a part of your consideration. I would suggest we amend it to include a possible >> other red lines that we don't know about >> something to that effect. >> Can we just do >> table it until we have more information >> till we have >> I think that we need to move forward give everyone a direction to move forward. So I would not recommend tableabling this just in my opinion. I do think that we need to have further discussion just in general. As long as I've been involved with the city and we've moved these developments forward with red lines obviously has led to issues. So we need to make sure ordinances >> are applied to developments as they move through the process so that we don't end up here again. So I think >> I I would agree with that. >> Yeah. I would like to see some direction given as to how we move forward. I don't think tableabling it for further discussion is appropriate because then we're just in the same boat >> pushing it down the road. Yeah. Um then to amend the motion on the table that to provide the current owner 60 days to have the easement recorded and all red lines sufficiently addressed and accepted uh by city staff in accordance with our code requirements. And does that include the definition of the escrow agreement? >> Yeah, certainly. If it gets recorded, it sounds like they've met their obligations. So, I think that solves that question. If it gets recorded and then that gives us a chance to verify, does this comply with what was intended in the in the plat? I think that would that would resolve that. >> Is 60 days sufficient time to do all the >> I think that's probably generous considering what you're looking at. >> Okay. I think it shows our intent too that we want we want to we're hearing what's happened, what's going on. I'm not blaming pointing the finger at anybody, but it's kind of interesting up and down ride for the owners of the city. I mean, and now us as a council. So, I think I think it's fair, too. I would say with the recorded being recorded at the county of the plat you would assume that everything has been met. However, I do think there was due diligence that could have been done on their part, but that has nothing to do with this process. Um, but making sure it meets our ordinance will in the future. >> I think the due diligence is on everybody's part. And I wonder why we continue to approve slats, they still have engineered red lines. And in this case, where we're requiring them to have a sewer easement that they have zero control over because they don't own the land. And if no one wants to ever sell them an easement, it could never move forward and we approve it anyway. I think we need to take a look at how we are approving all developments so we don't have these kind of issues in the future. But that's a different discussion than the motion that's on the table. >> I have a motion. >> May I inquire motion? Just just for my understanding is the motion that if they comply with those six those items within 60 days that the revocation is rescended. Is that what you're saying? >> Well, there's no revocation to resend at this. We won't revoke if they >> we we will not revoke if the plat is recorded with the sewer easement and all red lines are completed or resolved. >> So we have a motion by council member Fels >> and I'll make a second >> and a second by council member Alred. Do I need to restate the motion on the amendment? >> Okay. So any further discussion about the amendment? All in favor of the amended motion say I. >> I. >> Any opposed? Forgot all. >> Okay. The motion the amended motion passes. Do we have to vote again now? >> Now we vote. Okay. So before you have the amended motion, all in favor say I. I. >> Any opposed? >> Oh gosh, I gota wait. All right, the motion passes. So, we'll give you 60 days. We look forward to working with you. Um, okay. Now, we'll move on to item B. Consider a plat amendment for loan cedar phase 2 to accommodate for placement of utility line location and to provide sufficient easement. Marcus, do you have comments on it? >> Thank you for coming. >> Thank you. >> Yeah, I'll hit the high level. Uh the city planner is here. If there's more detailed questions, she has been much more heavily involved in this than I have. Um so there are Sorry, I gota get my stuff pulled up here real quick. Mac is this platinum midland cedar 2. This one Let's follow the agenda. >> I know. You've got two lone seaters. >> There are. >> Okay. I'll do that. >> Yeah. >> Okay. I apologize for that.

So, this is a plat amendment for the Lone Cedar subdivision. And essentially, this is relocating some easements to accommodate for the electric utility that got installed. It didn't quite follow where we thought it was going to follow and so we're just adjusting the easements to make sure that they follow the utilities where they actually got installed. >> Okay. >> Did I miss anything? Great. We the city staff recommends approval. >> Okay. >> Thank you. >> Got a question. How did the utilities end up where they were not supposed to go and how do we prevent that in the future if >> not supposed to go is a strong word because they're done by Rocky Mountain Power and maybe not where they were anticipated. the applicant is here if you would like to ask specifically of them. But the short version is through our plat process, we don't necessarily require Rocky Mountain Power to be at the table to say where their infrastructure is going to go. Typically, they figure that out with the contractors and the developers as the subdivision is being built. >> So, had it be adjusted based on being on the ground, whatever. And >> yes. >> Okay. Thank you. >> I'll make the motion we approve this. >> Okay. We have a motion by council member Brower for approval. >> I'll second it. >> And a second by council member Fels. Any further discussion? >> All in favor say I. >> I. >> Any opposed? >> Okay. Motion carries. All right. And we'll now move on to item C. Consider a plat amendment for Cedar Bluffs. The all reds to combine two lots to build one residential home. I would like to disclose at this time that the um all reds are my son. So >> just for clarity. >> Thank you. >> Um staff report. >> Yeah. So we have a few um of these lot combinations and plat amendments tonight. Um not really many comments. Our code allows for lots to be combined into larger lots and so this meets all the requirements of the ordinance and we recommend that it be approved. >> Thank you. >> I guess I should mention the planning commission also saw all of these and they and this was a favorable recommendation from the planning commission as well. I move that we approve the plat amendment for Cedar Bluffs to combine the two lots to build the one residential home uh with the name of the all reds. >> I'll second. >> Okay. We have a motion by council member Fels and a second by council member Brower. Any further discussion? With none will vote. All in favor say I. >> I. Okay. Motion carries. It's approved. Now we will move on to item D. Consider a plat amendment for Lone Cedar McKay um to combine two lots to build one residential home. Stuff any comments? Same comments. >> Same comments. This is also in the alone cedar subdivision, although it's not where the easements were corrected. And it's the same thing. Two lots going to be combined together into one larger lot. Uh no concerns. Planning commission had a favorable recommendation. Uh, city staff has a favorable recommendation. >> Thank you. >> I'll make a motion that we um let the mccayis combine two lots to build one residential home. >> We have a motion by council member. >> I'll second this plat amendment >> and a second by council member Fels. Any further discussion? Having none, we'll vote. All in favor say I. I. I. >> Any opposed? Okay, motion carries. We'll move on to item E. Consider a preliminary plat for Snack Co. Commercial Subdivision parcel 04 03000000009. Um staff, do you have any comments on this one for us? >> Um yes. I just have to find the right exhibit. I'm sorry. Okay. Council, before you is a plat and site plan for what we're calling the Snackco commercial subdivision. Um, this is one piece of a project that's going through multiple steps right now. Uh, the Snackco project is happening down in the industrial zone. Um, they had a site plan approval at the planning commission last week and now the next step of their process is they need to get a plat approved. There's a road dedication that needs to happen down there and uh some public infrastructure that will need to be dedicated over to the city. So, while they're getting their building permit rolling and getting construction underway, we're going through this process to get their plat finished up. So, land use authority for commercial subdivision plat is the city council. So, just a reminder, this is a preliminary plat. There's some details that are still missing that we're still negotiating and working through, but those will all be resolved in time for the final plat submission. So, the planning commission had a favorable recommendation to approve this um plat and city staff also has a favorable recommendation with the note that the things that still need to be fixed will be fixed for the final plat submission. And and that comes back to the council >> final approval. >> Yes, it does. >> This isn't going to be a case like before where we have redlined items and then we run into trouble. >> No. Um this is, I dare say, a much more simple case than our friends with the ARA subdivision. Uh we do not anticipate any sort of hiccups like that one with this project. Construction's already begun. Um, ground work is done. I've been by the location. Do we normally begin work without the approval of a preliminary or final plat? >> It depends. So, there's several ways somebody could do work on their property. You know, we got different kinds of permits, excavation permits, infrastructure permits. somebody could go out and move some dirt on your property um with a permit. Uh for a project of this size, it is a little abnormal to have um you know, you can kind of see on the plat the outline of where the building's going to go. So, our um the developer already kind of had a project in mind and was working on it. It's a little abnormal for it to have started already, but they're very excited about the project and wanted to get it moving. And so we've been working with them to try to make sure that we follow all the appropriate steps uh moving forward. >> The um engineering review says it's a final plat construction drawings review and you said that this is just a preliminary plat. >> So there that's a little bit of a mistake. The final level was for the site plan. So the construction drawings were reviewed at a final level. The plat is still in the preliminary okay stage. >> Okay. Apologize for that confusion. >> Okay. Thank you. >> I move that we approve the preliminary plat for SNATCO. >> I'll second it. >> We have a motion by Council Member Alred and a second by Council Member Brower for approval of SNATCO's preliminary plat. Any further discussion? >> Can you guys hear me? >> Yes. Um, so anyway, I think one thing that we're really trying to change is is certainly we want to work with the developers, but it would be expected when they bring in the final plat that all these red lines will be completely gone. Is that right? >> Yes, correct. >> Okay. So anyway, I I just think that's the standard that you know if the developers learn that then then they can be ready to get things passed through and we won't have any issues. >> Yeah. Can I make one clarification? >> Yes, Marcus. >> So um the situation with the Arya was they came in with what was represented as final final. We're done. Turns out it wasn't ready. there's immense pressure on the city to get that approved so they could get moving and get construction going. And that's where the conditional approval happened. This is different where it's a preliminary plat. We know there's things that still need to be adjusted and fixed. There's still more information that needs to be added for it to be complete. And so I guess that's the distinction. This isn't a conditional approval where we're going to have a bunch of red lines. This is an approval knowing that there's still more information coming and we'll make sure that the final product is resolved and ready to go when it comes to you next. Right. That's what we're looking for. >> Yeah. >> Yeah. I guess my concern is if they've already started building the property and they building the building before the final plat's done, then there will be really a lot of pressure on us to say, "Hey, we got a building here. We got to let us start using it, you know." >> Well, um I don't know if it helps or if you would like to, but the applicant is here tonight. if you wanted to address that question directly with them. I'm sure they're more than happy to come up and have that discussion with you. >> Yeah, I would just uh comment from would be great. >> So, uh my name is Skyler Jensen. I've been here a few times, but uh so the property currently has basically a building lot. The whole reason for the subdivision was really just to dedicate the roads to the city. So that was the only reason for the for the subdivision. Um so let's say that final putt doesn't get approved. We still have a legal lot to build on. Uh I'm not worried about it. It really it's just more of a detail that we need to go through to make sure that the the roads and everything gets dedicated to the city. That's really all we're doing. >> Yeah. So, >> thank you, Carol. Does that answer your question? >> Yeah. And I I mean, so Skyler I I mean I I mean, I'm sure you've probably been involved with some other projects in our city where there's been issues in the past, like, you know, maybe not to the to the level that we just saw, but anyway, we just want to have things taken care of before we get to that final plat and then have a bunch of issues. So, >> yeah. Yeah. And we're and we're we're totally on board. We want to make sure that everything's taken care. We've actually already addressed all of the red lines. We've already submitted all the information. The city has everything. >> Now, it just really just comes down to making sure that that gets reviewed and then so we can get it all moved forward. So, my my expectation is that we get this final plat review going on the next uh planning zoning um and then we move that on to to city council the following the following available week. So, I think we're there. I'm not I'm not worried about it. Um the city's got everything. So, we should be should be good to go. So, should be >> Okay, great. Thank you. >> Yep. Thank you. >> Thank you, Skyler. Mark Marcus, a question. We we had a concern you Skyler brought up the um a road. I know we had concerns with the same thing with the middle school where a road was constructed. Um we were not a we were not part I guess of that construction to confirm that the road met all the conditions or built according to hide park city standards. So, >> which one are we talking about? Are we talking about middle school or we >> No, I'm We've had that concern and now I have a similar concern for the road that you want to dedicate. >> We built the 200 West Road or 800 West 800 West. >> Um, but uh >> anyways, our dear friend Mayor Cox, old Marox. Um anyways, so during that process, this is a couple years ago we actually built that road. I think we did in 2024. Um but we did go through and this is before the city had a lot of I guess some of the um ordinances in place uh back then, but we did have Sunrise Engineer engineering do the inspections on it and we did build it per city code. Um, and part of the plat uh part of the information that we had to submit to do this preliminary plat was asbuilt drawings with submittals um on some of those details so that you guys have all the information. So, okay, >> I'm confident in that road. If you go down and look at the road, it's been there for a couple years. It looks good. I'm not worried about it. Okay. uh compared to some other roads that we've seen being built >> um that don't look as >> that is why sometimes we ask these questions. Yeah, just >> I've seen some pretty >> Yeah, some pretty good dandy there. >> Thanks, Skyler. >> Thank you, Skyler. >> Okay, council, I believe Mr. Harmon had his hand up. I don't know if you want to you recognize Kelly. >> Uh real quick, we talked about pending items. So, I'm just going to tell you what as far as our understanding that are pending items. Our water calculations and erus have been submitted. Now, they haven't been finalized. They haven't been approved by the city. So, that's one of the items. We've submitted it already. the financial guarantees or the uh improvements in the public rightway. Those are uh my understanding to be submitted prior to final plat. Those have not been done. And then the only other item that I'm aware of um is the sprinkler drawings for our landscaping. Uh that is also another item that needs to be submitted with our landscape drawings for final plat applications. So, those I just wanted to point out because we've had three different review uh reviews. And one thing that I think the city council or the city planner might consider is the review time that Sunrise Engineering has uh after a DRC or comments are put out. It's 14 days, but it's 14 working days, but it's not even 14 weeks. It's 14 working days as per Hyde Park's office hours. So what those 14 days translate into is almost three and a half weeks. And so if you if we're if we're down to the the third round of comments, you can see how this time piles up. So that's my re respectful request is that that is evaluated and that might help move some things a little faster. I know that there's a lot of projects uh in Hyde Park and in front of

Sunrise Engineering. There's a lot of work that has to be done, but just from our perspective, that would be real helpful in creating more of a of a open communication and a spirit of cooperation. That's all I had to say. And I won't >> I won't speak to this project in particular, but if >> if what was provided to the city was um more accurate to begin with or or the engineers. I sometimes wonder if engineers that represent developers have a different standard they use than what Sunrise uses because I see some very basic things that are not included that are clearly stated out in our policies that need to be provided that if we did a better job getting it right the first or second time, then there wouldn't be a a second or third or a fourth waiting for 14 working days. So, I'm I'm not saying that applies in this case, but I've I've seen it in other cases. self just like we've seen more roads constructed. So, >> okay. Thank you, council. We have before you the consideration of Snutco Preliminary Plat. >> Motion second. >> We have a motion and a second. Did we motion a second already? >> Yeah. >> Oh, yeah. You motion. Okay. Thank you. We're on track now. Um Okay. With that, any further discussion? >> All right. Then we'll move forward with a vote. All in favor say I. I >> I >> any opposed? Okay, motion carries and SNET code preliminary plat is approved. >> All right, now to item F. Consider applicants for the midterm election to serve the remainder of Council Member Atinson's term ending January 1 of 2028. >> So, take a fivem minute break so we can get some chair set. >> Okay, we'll take a five minute break. >> Where are >> they? are here. >> But now I got to remember where they were. >> Yeah, I think >> pretty sure >> midterm council election interview questions right there. >> Okay, we're back against that box. So midterm it says midterm council election September 23rd >> and we go to the box that says midterm election. >> Have we gone to the restroom, too? So I was asking I think Stephanie had particular questions she wanted to ask. about >> doesn't want to >> after and we'll just rotate. Are we going to change up the rotation? >> we'll follow a little bit. But they'll all answer questions. >> Yes. >> Okay. >> So it's not confus because it's confusing to keep. We did it that one time it was like >> it's not fair for that person to do them all. >> Yeah. >> and I think we'll have another question if there's not related versus you. If I feel like we may have a question if the council doesn't have a clear >> they answered a lot of questions in their application and how they educator. >> But I I don't think we should educate anybody. That's their job. That's not our job in this fair. Our job is not to be >> I still feel strongly we should not do that. >> It's so the point of your question. Yeah. Just ask the point because we don't want to lead anybody. They need to be able to answer just so we can decipher what they know, what they don't know, what their fault is about something. We shouldn't lead anything with with you. >> I was just saying break it down say like the point of your question and let them fill in the gaps and see if it fits with what you're fits with the education, the public. Yeah, I see that. Tell me they don't understand. >> I just think like cuz right here like these >> she needs to >> she does but we should just talk to her. >> Well, I feel like >> I know. Well, I was like, I hear somebody like she's 11 and I need six minutes. And I'm like, not six minutes. Like, it would be different if the other >> So, why are you going to pursue like in a public? I don't know about neighboring Boston. >> I don't want to. Yeah, I saw and I was looking at this question like I'm going to ask a question and I'll see Yeah, keep working. Okay, let's get uh Stephanie. >> Okay, excuse me. >> Should we go ahead and get started? Is everyone here? Stephanie is not back yet. We'll wait a couple more minutes. Oh, that's what I hate when you see yourself up there and you're like, "Oh, I don't like I don't like that."

laughter

>> You look fabulous. Don't worry about it. >> Look fabulous. >> Can I go back and grab Stephanie? >> Where is she? >> She's back here. >> Yeah, I agree 100%. >> Okay, we'll go ahead and move forward with filling the midterm city council vacancy. You can sit here. Yes. We'll invite our candidates to come and sit in the seats provided behind the podium. >> Left or right? >> Yep. >> Do you want to explain? Yes. >> Two minutes. Yeah, I'll explain it. >> All right. We'd like to thank everyone who applied and I just want to say on behalf of our city that we're lucky to have um such high quality applicants who have been involved and who know the process and who are familiar with things that are happening in the city. So I really appreciate everybody applying. Um we will go ahead and move forward with our questions. Just to give you an idea of how this will happen, you'll have two minutes to answer each question. Um each council member and the mayor, unless Geralt wants to ask a question, will ask one question. Um we will start with Kevin and we will rotate. You'll each have an opportunity to start. So Kevin will start and then Heather, then Bob, then Charlene. Um yeah, so we'll get started and um council member Brower, will you start question? Here's the first question, and this is this goes to all of you, but you're the first to get to answer it. Mr. Kevin, >> what's more important for our city right now? Building new homes, commercial space, or are rehabbing, expanding, better, utilizing, or existing homes and storefronts? >> Which is which is more important? >> Yeah. as a city, what should we be pushing for and why? >> Given the fact that we have uh you know some directives that come to us from the state of Utah that require us to to address middle and lowincome housing, you have to make some housing some priority. Uh you also have some available space. The answer is both or two or at least a couple of them because you have requirements to do some some building and some housing B that's being pushed down by the state of Utah so that we have a risk of our class C road funds if we don't act and work on some things that way. We also have some available property that's really prime real estate between Wolfpack Way and the highway and even on west of the highway that that serves as a great corridor uh for commercial real estate development right now. some mixed use. Uh there's some opportunity down there for economic development money to go to go go to work and bring in uh you know possible retail or some mixed use things down there more more uh commercial and more industrial down in that part of town. And so I'd say the answer is you you've got to go multiple directions because we're trying you know this the growth that we're experiencing is the growth of growth that we're being that most of the c the cities in the county are experiencing and really from one end of the state to the other. >> Thank you. >> Do you want to restate? >> Yeah. If anybody needs it question restate just ask. I'll have you restate it. What's more important for our city right now? Building new homes, commercial space, or rehabbing slashexpanding better utilizing our existing homes and storefronts? >> I'm going to say all the above. I think that falls in line with the question of what is smart growth and smart growth is a way that we strengthen our community without losing the what makes Hyde Park so special. Um, Hyde Park sits in a very unique position between two larger cities. House rooftops do bring business. We do need commercial. It helps the community, but we also have to look at low and high density um housing as long as infrastructure. So, I would say all three are important and that is why looking at the master plan and following the direction that the city has put forth and communicating with council and the mayor and the citizens of Hide Park. I think all three are required. Thank you. I I also think that all need to be addressed equally. Uh where we're under a directive from the state for low income and moderate income housing. We have a lot of inner uh lots that could be developed into th those type of structures commercial that we have down Wolfpack Way and and below uh could bring in retail stores and uh and businesses and that

snorts and clears throat

would help do the the city uh really good that way.

sighs

Thanks. I would echo what everyone

clears throat

else said before me. All of the above are important. I do think that um making sure that our growth is done smart and properly is really important. getting new residential growth as well as commercial. Um, smart to me means it meets five criteria specifically. Number one, that we preserve our open field in the small town charm because that's what draws family here, but it's also what keeps people here. We don't want to lose people that we already have. Second is prioritize owner occupied uh development. That gives us long-term community stability because the people moving in have a stake in the city in their future. Third thing to make it smart, we need to prevent an increase in traffic congestion. So that has to do with the three rules of real estate which everyone knows are location, location, location. So where we put anything that has extra cars, we need to really consider that because we don't have any artery roads and that's a huge issue. So we need to make sure that they've got access to the roads that they already go to for school, for work, and to go shopping. Um fourth, we need to add commercial. We need that financially for our budget. We've got two perfect uh commercial areas. Wolfpack Way, you've got foot and car traffic. I can't imagine anyone who wouldn't want to be right there. And the north part of Hide Park, 4,400 North, you need rooftops for commercial. Good news is Smithfield's putting in rooftops. So, we should piggyback on their rooftops they're putting in there residentially and put commercial on our north side of the town and that gives the rooftops needed for the commercial that we would invite there. Um those are the two best areas. So, I think we can do all five of those things with smart growth. I think is critical that we pay attention to all of them. Um, so it's a well-rounded approach to growth, I think. Thank you. >> Thank you. Um, council member Alred question. >> Oh, did you not want to ask one? >> Well, I'll go last. We'll see what Geralt decides what he wants to do. >> Okay. >> Yeah. >> You're the first. >> Okay. Um, we do not have formal assignments as a city council anymore. So, it leaves us time to tackle pet projects that we might have. Some I admire are that Dave has started a safety committee and also works with trials and parks cleanup and other things. Tiffany has started a front porch and get healthy Utah and has b been involved in the parks also. Do you have a project that you would like to do and what would it be? >> That is a really good question. I am not aware of all the city's side projects that the council has started. I am a little passionate about the beauty pageant, but we already have that in play. I think I would go I I don't know. We had that beautify that area, you know, making Hide Park beautiful. I think there's a lot of areas that we could gather the youth and beautify the city. I think that would be a great project. I don't know if that's existing. Again, I don't know all that you guys have your hands in. So I I think I would have to honestly evaluate what's done and then see where there's a need because I'm really not aware of what all of you guys have your hands in. So that's what I can say honestly. >> Thank you. >> I'm already involved in the safety committee. So I think that's a that's a very good place to be. And uh there are many safety concerns that we have throughout the community. And the more that we address them, the more that uh we make it a safer place in which to to live. But I'd be open to any other kinds too. Thank you. >> Um, side project. I've had my fingers in it. I'm in my second year of helping with the city youth council as a parent adviser. I'm really enjoying that with the hide park days and all their different activities that they do. I enjoy that. Um, as to new projects, again, I'm not aware of everything that's going on, but somewhere that I think there's a need and maybe it's already filled and I'm not aware of it, is to have a formal C program in the city of High Park community emergency response team. There are state and federal funds available. Um, then I would like to see us have a C trailer available or trailers plural available and have community um drills. And if we have CERT, community emergency response team, there are specific people in each neighborhood that in a disaster or an emergency um they're responsible for that specific geographical area. And I think if we have that set up, um we can, as a friend said, we can sleep when the wind blows. When we have a disaster, we don't have to go, what are we going to do? Because we already know what we're going to do. We're divided into, for lack of a better term, jurisdictions for CERT people that we have specific people are assigned for those areas. we've got medical people have been trained and we would have equipment if we seek out the funding and grants um that are available from the state and the federal government to create those community programs. So that would probably be one of my passions. >> Um parks and trails have always been an an interest of mine. I'm kind of up on the parks and trails quite a bit, but that's not a primary concern. I think one of the things I'd like to see more involved with is to be involved more with some economic development uh efforts. Uh maybe have a committee together as we go out, try and work with Marcus and some of the city staff. I know there's been an effort made to try and be bring business to the community

snorts

that economic development focus and and try and fill that Wolfpack way in and those types of things. I also like to see us having more open houses with uh with the community. Uh we're we're kind of seeing with some of our last uh public hearings that I think we have some misinformed public and a lot of times I it would be really good if we could bring people in really let them see and understand and know how water gets out of their faucet because people really don't understand and they don't understand what it takes to get a road fixed and those types of things and and try and and do some open houses and resolve some conflict between government and and the community. Uh I'm already involved a little bit with uh e preparedness. I'm serving right now on the uh uh as a licensed radio operator every Tuesday night. We're in, my wife and I are in the building uh service working on the emergency operations center for the city and we have radio contact testing every Tuesday night and that reaches out to everybody in the county and so it helps in in the case of an emergency or a natural disaster. And then I still had some concerns about moving traffic east and west in the city. We have plenty of north south roads, but if we have an earthquake on the on the east bench, how are we going to move people down to the the highway and out of town? So, some things as far as that goes. >> Council member Fel, you're up first. Which of the following would be your primary approach to meeting the demands of a growing city while balancing future city budgets? Number one, increase the city's tax rate. Number two, decrease the number and or quality of amenities and services like public safety that the city provides. Or number three, increase city revenues through increased housing density. My priority would be the third one to increase the the public uh building permits and things like that to to do it. I think uh we we are all taxed as much as we really like to be. Well, we we don't probably really like to be as much as we are. And so I I think it would be to uh use development, get uh get the the businesses and uh and work on that. >> Thank you. Um, I would say I think if I remember the options, I'd say a little bit of everything. I think we need to add density because we uh we don't have a choice. We're going to grow. We also have mandates from the state that we have to fulfill. And again, I think that needs to be done um in a smart way. And I mentioned, as I mentioned before, I defer to what I said in the prior question. Um, another thing I would recommend is that we evaluate our existing contracts and look where we can have shared services or and put contracts out on a regular basis for bid to make sure that we're always getting the best possible um, bang for our buck for tax revenue that we're spending because those funds are limited. And also, um, I would say I want to make sure that we are getting we're a small town right now. Once our density is filled, we might go over 10,000. But as long as we're under 10,000 population, there are state and federal funds that are available, multiple programs at the state and federal level that we can apply for that you don't qualify for once you hit that 10,000 level. So, I think we're in this really sweet spot window of opportunity to grab those grants, low interest loans, potential principal forgiveness based on, you know, economic factors. But there's a lot of money out there and I want to make sure that we're registered for those programs and that we take advantage of those in this window before we hit that 10,000. I think that will really help us with our budget. >> Would you restate that again? >> Be happy. >> Just long enough. I'm getting old. >> No. >> Your primary approach to meeting the demands of a growing city while balancing future city budgets. Number one, increase the city's tax rate. Decrease the number and or quality of amenities and services like public safety that the city provides. Or number three, increase city revenues through increased housing density. Okay. One of the challenges you always have with increasing taxes is the city really doesn't receive that much in tax revenue. uh you know as as taxes are passed at the county level uh most of that uh goes to the school district and we get down to somewhere around 11 or 12% that comes into the city anyway. So that's not really a primary source of revenue in my mind. Uh it's difficult to reduce services uh based off the experience that I've had in the past with the police commission and the fire departments. We've got good contracts in place with police and fire and they're coming to us at pretty reasonable value right now anyway. So, it's going to be really hard to to cut those. So, that leaves you down to try and increase some revenue and other resources. And and one of the best ways to do that in my mind would be to increase the sales tax revenue because we're going to receive a lot more of the sales tax than we ever would have uh from the property tax. So, some economic development uh efforts and trying to get some business in here that are selling and and increase that that sales tax. And then I we've had some good comments about grants. There's always grants. I tip my hat to Mayor Cox because he was able to go out and find a lot of money for the city and there's more out there. So, that comment was very appable. Thank you. meeting the demands and budget for the city can be very overwhelming as we've all um are aware of that. I I think that growth should be considered successful simply based on not just in not just based on the increase in its tax base. It should also be provide enough ongoing revenue to support the surfaces and the infrastructure that comes with building. I do think we can provide an economic growth while still being thoughtful about the pace. I do think um creating good neighborhoods and scaling businesses that will bring retail and dining and professional services. I do think the sales tax is not a bad idea to look at. I do think safety is number one, though. I'm all about comparing and getting open bids, but I've sat in enough city councils to see what the chief provides and all of his due diligence and all of his records, and I'm very impressed. And I think safety should be number one, and cheapest isn't always best. So, you've got to keep that in mind. Um, I don't want to change the character of our community, but I want to strengthen the local econom um the local economy. And I think that starts with planning and zoning and just making sure we um identify appropriate locations for neighborhood and commercial and mixed use. And I think I'd probably lean more to number three that you said. I can't remember the exact answer, but they all kind of they all kind of encompass each other. Thank you. >> Okay. Geralt does not want to ask a question. Is that correct? >> Right. Yeah. I think it'd be better for you guys to answer ask >> since we're here in person. Okay. Thanks. >> Yeah. Yeah. >> All right. Well, I will ask our final question. >> All right. So I'm going to ask starting with Charlene, describe your two highest priorities for change in our municipality in the short term and what about the long term? So maybe you're two different scenarios. >> Um okay, changes in our municipality. Short term, I would say I'd like to see um a formal public information campaign. I think number one is social media. I think we need a someone specifically assigned to social media and we need to do that better. Um, so we need public communication and public education because the public doesn't get mad if they've had a say and if they've fully been listened to and if they've been included in the process. So I think coming up with some formal plan of communication and education other than what we have because if we keep doing what we're doing, we're going to keep getting what we've gotten and so far people aren't hearing the messages we're trying to send out. So the communication channels we're currently using I think aren't working really good. So we need to tweak that. So social media would be the biggest thing that I would add. Um I would say surveys and digital open houses and everyone goes no no one ever shows up to open houses. I would propose we do not just a time and a place one time open house but an extended openhouse here that people who don't like digital and social media certain part of the community they can come here look at things and they can have um physical feedback. There should also be a QR code for digital savvy people who want a QR code to fill out a survey and to respond. So both a digital and a physical openhouse surveys and social media. I think that way we get the most of our people who time wise. Longterm um long-term change I like municipality is the zoning changes we're working on and getting smart growth. um making sure that we put the things in the right places, that we evaluate what changes we want to do, that any changes that we make, we should make the changes that have an undo button first. Like if it's a contract change, we change the contract to save money, we don't like it, can we change it back? If so, that should be our first priority. Any change that we want to make that has no undo button, that should be our very bottom priority in our changes as we try to work through all of our zoning and all of the growth issues that we have for our city. Thank you. Thanks. I think on the short term we need to continue to take a good look at our water resources and our our use and approval of of the water. You know a lot of times the water is as mentioned and you know we got oftenimes we hear the comment well we have plenty of water but do we really? Uh I think on the short term we've got to take a good look at at as the projects come in, do we have the water available? What's our water resource looking like and because water is going to be gold? We've heard that from one end of the state to the other. Uh and with this last summer with the challenges with water, I think we have to take a good look at that. The other one is short-term is transportation impacts. Uh, I've already mentioned that, you know, we're having a hard time already moving people off of the east bench down to the highway. Uh, our east west corridor is is non-existent basically as far as as our transportation. If you're trying to go north and south between North Logan and Smithville, it's incredibly good. But if you're trying to get up, you know, if you're trying to get down the canyon road and then down to the highway at 7 o'clock in the morning when Green Canyon traffic's on 3100 South, there's got to be some alternatives and I think we need to take a look at something like that. And a long term uh we need to take a look at creating more income for the city like I mentioned before and we need to take a look at what impacts and what ex what what expenses arise uh from our development to the city and it's been mentioned great ideas control our expenses but you know if we're going to run a business we got to either increase our income or decrease our expenses or both and we as we take a look at the existing impacts on our neighborhoods and our schools and churches. Uh I think it's really important for us to try and take a good long-term look at at the character of the city and you know do we need to look at when our developments come in do we need to look at heights or you know those types of things where we've got neighbor do we need to be using some transition zones? >> Thank you. Can you repeat the question? I'm sorry. >> Not a problem. Describe your two highest priorities for change in our municipality in the short term and what about in the long term? >> Okay. Last week, actually, I mentioned social media in planning and zoning. I have worked with the public in a public job setting for 30 years, and communication is number one. It can be your quickest. Negative publicity, and negative news travels quicker than positive news, as we all know. And so I think communicating with the public, I also think social media, you know, some people like email, some people do Instagram, some people like the QR codes, some people want it printed. And you know what? We have to do it all. We just do. I don't see how else to get around that. And even when we do it all, there'll

be another idea. And I just think getting communication, I love the idea of informing the public more. you know, we represent Hide Park and I love Hide Park and but I know that there's rules and regulations that we need to follow. So, I think public communication and educating the um me the citizens of Hide Park would be my short term. My long term, which I wish it wasn't would not be long. I've kind of been working on it and is the parking our parking codes. All of our codes, but parking specifically. I mentioned I'd maybe look at beautifying our city. Some of our streets are not um they're just crowded with cars and trailers and our code right now where it sits doesn't even talk about RVs. We don't have a parking code that has any stagma and I don't want to see our city get run down. We're not a county anymore. We are a city. we are growing and there's safety issues that rely with that and a lot of concerns. So, that would be my long-term goal, but I would love it to be a short-term goal and have that happen quickly. Thank you. >> Thank you. The short term would be to to make sure that we utilize the services that we have to the best ability that we have have them right now and that way we don't have to expand a lot. Uh, I like the water, uh, transportation and communication. My long term would be to involve more community members in things and inform them more in the communication portion of it. That would be my long term. Thank you. Okay, I think that concludes the question portion of our interview. Um, we'll give the council a minute to reflect on on their notes and their thoughts. Um, hopefully you've had time to read everybody's application. We thank you for filling them out. That was very helpful. Um, I will say I am grateful to all of you and I appreciate your responses and many of the things you mentioned reflect I feel like my current goals and the goals of our council and so there's only one seat open but there's many ways to serve and so I hope that you all still look at um the opportunities available and let's visit about that because there these are some things that are in process and we want to as many of us together to make these happen would be great. So, we're going to move forward with our vote. Um, Council Member Fels, we'll start with you. >> I'll just reiterate what Tiffany said. I'm glad there's four of you doing it. I wish there were more people here because two of you are currently serving and two have previously served and I'd sure like to have other people uh get engaged. So, thank you. Um, my vote is for Kevin Flint. >> So, one vote for Kevin Stephanie. >> Great. I I want to reiterate that too is grateful that for very qualified individuals and I'm grateful that you um would be willing to step forward and and serve Park. I appreciate the answers on your um applications and This is not easy. This is a difficult vote. Um, I would vote for Heather. >> Thank you, Kirk. >> Um, you know, for what they said, I mean, filling this out and it was helpful for me. Um, I know it's a lot of work and I appreciate that. Um, the the thing that I look at right now is I've been where you are and and that's not a fun position. But you know what? I'd rather be where you're at than where I'm at right now

laughter

because that's not a fun position because we got great candidates and and uh I think you could almost flip a coin and go that way. But I and we all know that isn't the way it's going to work. And so, but again, thank you for your showing interest and and filling out these things and and don't forget us because we get some good people coming up to help us. Just good people that show interest. So, anyway, um I would vote for Heather. >> Thank you, Kirk Gald. Um, yes, I appreciate everybody that's come in and and put their name on out there to to be chosen and from and so as I I actually kept some a score sheet here on the answers and and uh I just really tried to be very openminded about everybody. Um, but my vote I think I was going to go for Kevin. >> All right. Does that mean I have >> So,

snorts

in the case of a tie, the mayor does get a chance to break the tie with your vote. So, mayor, it's a little unusual, but you do have an opportunity now to break the tie with your vote. Or I guess she could pick one of the other two that haven't been picked and then we do another process. Is that correct? >> I mean, I'm not saying that she has to pick one of those two. She could still >> correct. >> Yeah, she she >> or does she have to break a tie? I feel like >> Oh, yeah. I let good clarification. Um, so you you still get to vote for whoever you want >> and then if it's still undecided, we have some exercises we can perform to break the diet. >> But but wouldn't the Excuse >> They are accessible for any age, any ability. >> Marcus, if if I could just for my the mayor generally wouldn't be voting. >> Correct. The only reason she's voting now is because >> it's two. >> There is a tie. >> So, is she voting? >> I think I'm voting between your choices. >> That's what I think. Otherwise, you wouldn't think >> you wouldn't be voting. If you were to vote for one of the other two, then you wouldn't >> then it wouldn't matter, >> right? >> I agree with what you're >> all right. The city quarter says yes. She knows more than I are the rule, right, Da? That is what we're looking at. All right. And again, I appreciate all of you. You obviously have valuable information, have contributed greatly to our city. So, don't go anywhere. And there's an election coming in 2028. So I hope that you're all on the ballot because you'll make a difference in our community. So now we're going to move forward with the oath and swearing in right for office >> and and that would also imply there's an opening on the >> planning and zoning. So submit your applications. >> We will do it by application similar to this process. >> So they will submit an application for planning commission. to take a picture. >> Okay. >> But I want and then we'll present her name. >> Okay. >> Christian Hoops. Do you know Christians come and do this? >> Yes. >> Oh, yes. Sorry. >> I don't want to be in the picture. >> How do I move out of >> swear domly swear I will support I will support obey and defend the Constitution obey and defend the Constitution of the United States of the United States and the Constitution and the Constitution of the Ice and I will start my office as city council member as city council member. Okay. Welcome, Council Member Taylor. You can come up and take your seat if you want. We're just going to adjourn the meeting, but yeah, if you want to, >> you could move to adjourn the meeting if you'd like. If you hurry before before somebody else does. >> Move we adjourn. >> Of course you do. I'll second that. >> Okay. A motion and a second to adjourn our meeting. And thank you everyone for coming.
