Cache County Fire Protection District Board Meeting 10-07-2026

2026-10-06

Chair0:00

We're getting this weekend on both sides of my mouth. Thank you. Yeah. You gotta just pick what you're assuming. You're not more aware of it while it's some beautiful weather outside. Day. Yeah. I think that'll be fair. I think just in time for the weekend. Alright.

Welcome, everyone. Public notice is hereby given that the Board of Trustees of the Cache County Fire Protection District, CCFPD, will hold a regularly scheduled meeting at five p. M. Cache County Historic Courthouse Council Chambers, 199 North Main Street, Logan, Utah, 84321 on Wednesday, 10/07/2026, begin... Beginning at 5PM. Call to order, review and approval of the agenda.

Steve0:48

I move to approve the agenda. Second.

Larry0:53

Any discussion on the agenda? From Larry. That was a motion from Steve. Second from Larry.

Kathleen1:00

So we may need to address the public hearing aspect of the agenda and just postpone that till we've given sufficient notice. I'm still trying to find the the actual code on that, but but we may have to suspend that or just delay the public hearing.

Larry1:17

Why don't we... Since we put it on the agenda, see if there's any public comment about it tonight. And if if there... At least we can say we fulfilled it if if there isn't some additional... I I looked at our minutes of the last meeting, and the minutes of the last meeting had a specific motion that, we set a public hearing on October 7 at 05:30.

Kathleen1:43

Yeah. I just...... Been done. The question is is whether that's sufficient notice or whether it had to also be posted at the public hearing. Is that correct, Linda? Yeah. I I think that there's... The the actual notice requirement is not just announcing it in a meeting, but also posting on the On the phone? Like, the website. On the website seven days before the hearing.

Larry2:06

The Utah Public Notice website.

Kathleen2:10

If... Larry, do you have the code section about that? Like, what the I'm just gonna look it up. I think It it it is seven days before... For a public hearing. For public hearing. Is that seven calendar days or seven It's calendar. Calendar days. Yep. The the county

Larry2:25

stands corrected. It will confirm that. I'm I'm unaware of that procedure. Just to confess, I I don't believe the county's been operating that way. Have we, Catherine? Dave? Yeah. We have. Do you post the public hearing on a website

Kathleen2:45

one week before? I think Catherine was saying that when you notice it in the meeting... Sorry. When you when you make a motion in the meeting that then staff knows to then post it on the on the appropriate websites. Like, the... And that's just something that we need to just clarify from here on out. It's not... This is just making... Well, no. It's really ours too to make sure that we're that we're kinda just directing that. That's our job. So this isn't an expose. It's just... Let's just make sure that we're that we're following the right procedures. So I would I would say that we remove the public hearings. I mean, we can take public comment. It just won't suffice to meet that public hearing requirement. So I... I'm not opposed to allowing anyone to speak, but... So maybe we we leave the agenda as is and then redo it. Neither public hearing is time urgent.

Larry3:37

Neither of these are gonna make any difference whether this is done now or two weeks from now. So I I don't see any reason why we shouldn't accept that as a motion.

Kathleen3:48

Okay. I I move that we remove the public hearings from the agenda.

Mayor Butler3:53

K. And

Larry3:54

I second that motion. Let... Let's let's... Okay. Well, let's go home. We need to No. We need to we need to vote on that. Well, the But we need to set to the approval of the agenda?

Chair4:14

Yes. We have voted on that. We have a motion on the table to accept the agenda. Right. So this would be... An amendment. An amendment. Right. So we discuss the amendment. So we vote... Yeah. We discuss and vote on the amendment. We'd remove both the public hearing and the consideration

Larry4:29

of those two matters.

Kathleen4:34

Yeah. Yeah. So six and five. Okay. So that that is my motion. So maybe we can vote on that unless there's further discussion.

Chair4:50

How do...

Kathleen4:52

I motion to amend the motion to accept the agenda, and my amendment is to remove the public hearing and the number six, the consideration of actions. I second the motion. We can just call the question.

Chair5:11

How do we vote? All in favor?

Aye.

Any opposed?

K.

Larry5:17

Okay. So now we're... Now we should vote. Now we vote on the amended...

Chair5:23

On the amended agenda.

So now we're voting on the amended agenda. All in favor? Aye. Any opposed?

Larry5:31

Now we're to other business. Correct? Correct. K. I would move that we schedule a Public hearing. Public hearing on resolution twenty twenty six dash o five and twenty twenty six zero four at our next meeting. And I would propose

Chair6:00

that

Larry6:02

we schedule that public hearing on October 20.

Chair6:11

Let's see if that day is a Tuesday. Tuesdays are hard. Many of the mayors have council meetings out, don't they? We have our... Oh, you have

Kathleen6:19

yours on Wednesday? Because we have to do... Yeah. We... Ours doesn't conflict with that day. Oh, okay. I'm good Wednesday too. Tuesday to Tuesday. Tuesday. I've got city council on on twentieth.

Mayor Butler6:29

At what time? Time is your meeting. Yeah. Oh, I guess if we do it during the day. Yeah. Mine's at seven. Could we do five?... The public hearing. Oh. Yeah. It should be after work hours so that the public has Yeah. Reasonable. Reasonable. I've got a thirty minute, forty minute drive from here.

Chair6:44

Well, I mean, you could drive fast.

Kathleen6:47

What about the twenty first? Do we have... That's

Larry6:53

a brag day, but

Kathleen6:55

I don't think there's anything scheduled What about on the day. What about the twenty second? Because Providence has a conflict on the twenty first. We have city council on the twenty second, I believe. So... And we have a NOAC meeting on the twenty second. What...

Larry7:11

Could we schedule it at lunchtime?

Chair7:14

We can't have a public hearing during work hours. It has to be after so the public can attend.

Larry7:20

How about... We... Let let me just say that we try and struggle to set a date, we have to have a tax hearing before October 21. Oh, that's right.

Kathleen7:32

What about... Let's see.

Chair7:36

We might... If we have a quorum, we might have to miss some people. Yeah. That's true. If we have a quorum, we we can hold it. What about... Let's... How... Who can do it on the twenty first? We're down to the twentieth or the twenty first. I can do either day. I can do the twenty first.

Kathleen7:54

And... Well, I guess who can't do it on the twenty first? Just... He's got council meeting... No. Mine's mine's the twentieth. So Kathleen cannot on the twenty first. Okay.

Chair8:06

And then... So are we just missing one on the twentieth and one on the twenty first? Mhmm. So that's dealer's choice, whatever works. He says it's seven. If we meet at five and it is... If it's just the two things, maybe... No. I could be here. I just have to... I'd have to leave. He'd have to leave. He says... If we meet at five and his council meeting's at seven, we could let him leave at five... How early can you conduct a public hearing? Do they have to be after five five? After five. Has to be... Well, why don't

Larry8:36

we schedule this meeting at five and the public hearing at 05:10? That's good. Sounds great. Yep. On the twentieth. That's... I believe they can they can go. Okay. So...

Kathleen8:54

That's a motion by you. I'll send it out to you.... For you? Yeah. I can I can? We'll... Any discussion on that? Good?

Chair9:02

How do we vote on that? All in favor? Aye. Any opposed? So fire board meeting, Tuesday the twentieth at 5PM sharp. Public hearing, 05:10PM sharp. Okay.

Mayor Butler9:19

I see.

Larry9:20

While we're together, a couple of other things. We haven't had a NOAC meeting since our last meeting, so there's no information to report on on that. Mayor Rudy, we... Justin is the secretary to SOAC. He could give us a report on what's happening in SOAC.

Chair9:43

Thank you.

Justin Long9:49

Alright. Thank you, Chair. Again, my name is Justin Long with the secretary of SOAC. I think things are going pretty well. We have, good participation on the South End. I think every city has been represented at almost every single meeting. There might have been a a couple missed here or there, but good good participation, maybe 20 to 30 people at each meeting. So really good discussions. Most of the emotions have been carried unanimously, so we're kinda working through things incrementally. There's still a couple of big decision points that kinda need to be figured out that we're kinda chipping off and trying to get some answers on. We have a pretty active technical advisory committee now that's up and functioning on the South End made up of six or seven of the fire chiefs and a couple other, professionals that we're kinda waiting for them to get through a couple of points to help us make some other decisions, some things like that. But I think in general, things are going well. We're moving in a good direction. Seems to be good cooperation, and things are moving along. So happy to answer any questions.

Steve10:45

Mayor Miller, why don't you tell the group what's happening? So right now, and you're probably aware of this, the technical committee that we asked to be organized is meeting even as we speak right now Okay. Justin. So I don't know if there's been... Was somebody called to kind of be the note taker, the secretary of the technical committee? Do you have any idea?

Justin Long11:06

I I don't. Sorry. I wasn't invited to that meeting, but I don't know who. I'd... I'm... The fire chiefs, Wellsville fire chief, Paradise fire chief... Help me. Who else is on that? Firearm... Dave Nelson,

Larry11:19

and Dave Nelson and George. Brady. Well, no. Oh, there he is.

Justin Long11:24

Yeah. Chief George, and then, Casey Snyder. Sorry. Barry Locke. Barry Locke. Yep. Okay. Yeah. So, I mean, they're they're mostly, you know, fire professionals that make up that committee, but

Steve11:37

I'd be happy to attend that if, like, but nobody asked me or told me to. So... I I think AI could take our minutes for us fairly easy without taking more of your time. You're pretty busy.

Larry11:52

Justin, I might add, to foreshadow, I think, what motions we did have at our last SOIC meeting in terms of recommendations for this board without being too detailed. It in fact, to reduce administrative personnel from the tentative budget that we saw here. I'll leave that without detail. And then the technical committee is specifically working on, EMS paramedic issues for us to make a recommendation on how we staff that in the South. Again, that that'll be in a more formal report. But... So you guys in the North know what we're working on. That's that's where we... That's how far we got in our last meeting.

Chair12:44

Thank you. Any other questions? I'll just report that NOAC, we met, is a... Just a tentative budget review. That's basically what we've done at this point. This point and kind of gone over a couple of things. Not everyone was able to attend, so we have... We formally have a a full meeting, full staff meeting scheduled for the twenty second at 6PM. So Can can we get that sent out? Yeah. Jeff Jeff was... We just finalized that Okay. Prior to this meeting. So he's supposed to be putting out an invitation. So... I skipped over a three, agenda item number three, approval of board minutes from the 09/23/2026.

I move to approve the minutes from 09/23/2026. Second.

Larry13:38

I I have one correction that I think ought to be made since we've... There was a correction needed on the public hearing, but it's it's of no import now because we've reset them. But item number 12, it it should say, legal counsel is handling the official name transition, not to either, but from Cache County Fire Protection District to Cache Fire Protection District. I would ask that that change be made in the minute. So moved.

Kathleen14:20

Second.

Chair14:22

Any discussion? Any other items? How do we vote? All in favor? Aye. Any opposed?

Larry14:30

So that's the

Chair14:34

amendment. Amendment. And now we need to vote on the minutes. Is there any other...

Larry14:40

How do we vote? Aye.

Chair14:43

Aye.

All in favor? Sorry. Aye. Aye. Any opposed? Alright. Any other business?

Larry15:01

Yeah. I think it it probably be helpful for all of us to look at the the the district timeline that I've prepared. This is really not changing anything. It's nothing we need to approve. But I think if you look at the time line, you can see what needed to to keep on track with respect to our, fire district tax levy. We've we've already done number one, which is the notification that was done, and I have a receipt in file that we've timely notified the auditor and the state tax commission that we were going to make a levy. The next thing that is is is to have a tax hearing. And the tax hearing had to be before October 21. Hearing as well. And that we provide the notice before that as stated in line two that we have to have a separate agenda item. There's a statement that you have to read at the tax hearing And that's the second page of of the stuff I passed out is I've just prepared that, the... What has to be read. I think, Catherine, you're kind of familiar with that pattern. Yep. You just have to read this statement at that meeting. So so that happens, and then there's there's some posting of of advertisements and things that have to occur. And then we're scheduled to have our property tax at at... After that's done, then, before the end of the year, we have to pass the tax increase. Typically, what you do is once you finish with the tax increase hearing in the same meeting, you go ahead and pass the tax increase. But this kinda sets out all the dates that we need to comply with.

Kathleen17:25

Executive Danes, we've been kinda in the thick of tax increases. Is this where you're going, mayor Butler? I was just about to ask

Mayor Butler17:32

is is the... So this next meeting is gonna be the one where we have the hearing for it. Is that correct? Where we what? The the next meeting is gonna be your... The public hearing for the tax increase? No. No. The the truth in taxation hearing is November 16. November 16. Yeah. Oh, okay. Well, that has to be its own meeting. It has to be its own meeting. Yeah. We can't pass anything in the... It's advertising. That's all that we'll be doing on the sixteenth. Okay. But on the on the twentieth, that's not that. We can do other things. That that was my question right there. I I didn't know when that was. Okay. That's what I was wondering. Yeah.

Kathleen18:10

That one can be different. Like, that one can be included. I think that's

Larry18:15

right. The... No. The twentieth? The twentieth can be just another agenda item. Yeah. Because it's just a public hearing. You have to have it itemized on your agenda as a as a specific item. And we'll see that that's done.

Chair18:30

And I think we could even have a meeting, but it would have to be a separate meeting. We'd have to adjourn from the hearing.

Kathleen18:37

Oh, nothing on the same night. Yep. Okay. We have to do it the... Not this year. It's different. It's early. Okay. Well, we won't have a meeting.

Larry18:44

Cities and Disqualified.

Kathleen18:46

Yeah. Okay. This week's disqualified. Now it's, like, completely different. And I think the county is the one that tells at least cities what day they can have that tax hearing on. So You schedule it with the auditor because you can't have more than one on the same day. And it was published on the notice that was prepared. Yeah.

Larry19:05

The notices of the tax increase are finished, and they're they're at the printer now. So we're we're on this schedule. We're we're just fine in terms of the way it's it's moving along. The thing that we need to work on, I I think the tentative budget in the North, NOAC, is pretty much figured out. And I think the tentative budget with respect to the cities in the South that are not participating in EMS are pretty much done. But we've got that one portion of it that's entangled in, the EMS in the South that we're still struggling with to get that budget done.

So as as as we work through this schedule, I'm I'm in real time kind of looking at code on public hearings. Special districts and special service districts, it turns out, are different than municipalities municipalities, land use, and everything else that's ten days for a public hearing. If we were creating a new district or annexing area into a district, that's thirty five days. We're not doing that. Budget hearings for districts and our special districts and special districts and special service districts look like they're seven days, and they can't start before 6PM.

Okay. Thank you. So we have to go back and amend our

Mayor Butler20:43

We'll just... I think we can just say 6PM. Well, that... That's for budget that's for budget hearings. Alright? Is that what you said?

Larry20:51

That that is for

Chair20:56

Yeah. That's imposing or increasing a service fee is... Okay. So just the changing the name one, we're fine to keep it fine. Yeah. That's just as normal.

Larry21:07

Oh, we we don't... Thank you, Larry.

But... Well, I think what we should do is run the schedule that you're showing us past Mark Anderson, our attorney, who has time to actually think about this stuff instead of being... I've been... I've run this... The schedule

through Mark Anderson on the name change. Yeah. He didn't give me instructions about the public hearing date.

So I'll bring that up with him. Yeah. And any other public hearing notices, if he would check us on that, I need that help. And then LaShelle will keep in touch with you.

Kathleen21:45

K. Okay. Text me that code section.

Larry21:54

Or tell me. AI is getting better than it used to be. How's that? Well, what's what's your code section? I tell you, I I I asked Google, what is the required notice for Utah special service districts for public hearings? Okay. And then and then there's a... There are several code sections that it goes into detail that Okay. When I, again, in real time, read those code sections, it seemed to agree with what AI was... What what the summary was telling me.

We'll we'll plan on seven days notice for any public hearing. So we'll get the notice out that we're having a public hearing on the name and so forth, and it will be at 06:00 so we don't run afoul of that time. Did a 05:10, it'll be six. Okay?

Mayor Butler22:47

Wait. Hang on. That's not this next one. This next one can stay at 05:10. It's the it's the, public hearing for the tax and budget

Larry22:57

that has to be after six. Resolutions, we don't have to have it after six. They just have to be after five. So the name change that we're doing, that's not required. No. We're good. We're good at 05:10 on that. So, again, that's something I'd run past. Ask Mark. Yeah. And I would give discretion to the chair, to set the times according to Utah code and let us all know and let the public know through the public notice website. Same schedule, unless it's daylight savings time. No. I'm kidding. I'm kidding. Wait. Are we going on

Mayor Butler23:35

that? Are we going on that? Are we

Chair23:40

not going on that? Going on that?

Alright. Unless we're missing anything.

Larry23:47

I think we're done. I think we're done. Move to adjourn.
