CACHE FIRE PROTECTION DISTRICT BOARD MEETING 09-02-2026

2026-09-02

out of the Weber fire district tax is 1.3 million. It's 1.3 mills. I know it seems like the same number, but but I think it's important.

»Okay.

»What page would those change?

»That's at 12451 the time.

»Oh, okay. Any other

»and we're not we're not picking on you. I promise. This is important for us.

»So we appreciate what you're doing. Thank you.

»Okay. With a motion and a second. How do we vote? All in favor?

»Any opposed? That carries. Okay. Proposal for consideration of action.

»Um, let me just say I I thought it would be helpful, there's 11 of us, if I tried to reduce each of these things we're going to consider to a written resolution. So the um in our agenda it didn't have a number for the resolution to add additional members to NOAK and SOAK. So I I used the next available number which would be 06. So let me pass out what I prepared to be resolution 2026. And I think the way I do this is to put this on the table to have a discussion. I I make a motion to adopt this resolution and then I get a second and then we can discuss the resolution. So I would make a motion with respect to the additional SOAK and NOAC members to pass this resolution and I'm seeking a second.

»I'll second it.

»Okay. With that being on the floor, I I think I can just explain what this is. Uh we had some discussion in our last meeting about needing operational and technical people. The discussion evolved and we decided that the best place to implement that would be at the operations level. So that was in both the no act meeting after our last board meeting and in the SOAK meeting after our last board meeting they discussed that they agreed that those committees would be better served by adding operational people to the committees. So, um, the SOAK recommended that they include all of the fire chiefs in the south plus Casey Snyder. Uh, the fire chiefs are, and I just have the their positions here in the thing. But the the fire chief for Hire, Tony Staffer, the fire chief for Wellsville is Travis McBride. The one for Mendon is Barry Lockach. Paradise, Ashley Smith, and then Cash County is Brady George. So, SOAK's request was we add those people to the SOAK committee as non- voting members. No act um suggested that we add u retired Cash County Fire Chief Rod Hammer, retired Cash County Fire Chief Jay DS, Lewon Fire Chief Jake Johnson, Newton Fire Chief Greg Jorgensson, Trenton Fire Chief Lance Kingston and Trevor Egan who is the Clarkston fire chief Casey Anderson the Smithfield Fire Chief Excuse me I've got those reversed. First Clarkston fire chief at Casey Anderson, the Smithfield Fire Chief at Jeremy Hunt, then the Cash County Fire Chief Brady George. So we we provided public notice that we would consider adding these non- voting members to each of the committees, Noak and SOAK. And I would so move

»second.

»We've already voted. We've already

»we've already got a second. So it's on the table. If anyone want to make amendments I I think both Noak and First of all, we haven't contacted all these people. So some of them may not be willing to serve, but we thought we would uh get your approval to extend the invitation. I move that we call a question.

»Uh I guess I probably need a second.

»You call the question.

»You call the question as

»end.

»Okay.

»All in favor.

»All in favor? I I

»Any opposed? That carries.

»Oh, okay. The next resolution is to set the cash fire protection district levy. Again, I've done the same thing. I printed it up in a formal uh thing. Let me just say there's a process you go through to set a levy. You you have to uh advertise it. You have to have a truth in taxation notice and you only actually set the levy after you complete those processes. But to do the advertising, you have to propose a levy so that it can be advertised before the public hearing. Uh we we brought this u discussion to both NOAK and SOAK. Last year the counties operated a fire department that this year is what I should say it's operating a fire department. Our budget was 3.9. When we redid the county budget we estimated it would be 4.2. too just with the change in u insurance coverages and the change u in wages. So the recommendation of both no act and soak was as our first levy we just start with what the county was collecting and so the recommendation was 4.2 million. Now that's our decision. They're they're just making a recommendation to us. But we need to do something because on September 8th we honor about that date we have to start the process of printing the notice. So we have to put something out. So both of Noak and SOAK are recommending that and I would move for adoption of this resolution. Second. Any discussion? MO.

»How do we vote?

»Say all.

»All in favor?

»Any opposed? Carries. So

»resolution number three is uh to recommend to the cash county that they implement a municipal services levy. All we're doing here is making a recommendation to the county council. Um again I have written that up in writing so that we all know what we're doing with this one. Um, I guess I'd make this resolution and pick up a second so we can discuss it. Catherine.

»Oh,

»okay. As it's on the table, let me just explain what we're trying to do here is is ask the cash county to equalize the the taxes between the unincorporated area and what the cities are charging. So this this would be a a levy only on the unincorporated area. It would be an effort to mimic what the cities collect through their taxation so that the county is collecting the same amount. This is this is funding that would go to the county and then the county would use this as part of the money to provide for uh services in the EMS and fire category for the unincorporated area. Um the the effort was to more or less match what people pay in the cities and that kind of varies from one city to another. Um it it looked like a uh you just have to do an approximation because you're estimating and approximating, but it looked like we needed approximately $750,000. So my suggestion is that we make that recommendation to the county council that they consider first making a levy and second that they implement that amount. Now that is a decision up to them but I think our recommendation should be on record. SOAK and Noak looked at the numbers and made the same recommendation to us that we recommend this level to the county council.

»George, I'm trying to remember. I believe last night that we we recommended 800.

»That's what I was going to say. I think that the north

»You're right. You're right. Soak recommended 750 and no act recommended 800. I failed to get that into the resolution. I I will correct the resolution by reflecting that in fact no act recommended 800,000. So Mayor Peterson, I'll I'll accept that as a as an amendment to the printed resolution. And uh if I could have a renewed second with that number.

»So George, the process will be that this will go on to the county council with the recommendation from this body is that will be the levy which will be advertised. It will be no more than 800,000 whatever that mill levy is. Is it 34?

»Well, I I don't know exactly what the mill levy. Part of the reason is what what I'm advised to do is not get into trying to predict the levy. Predict how much money we want to collect and then let the the people do the math to to generate that number

»when it's advertised.

»Yeah.

»Okay. Okay.

»I I just have to tell you I feel real strongly about this. We we have for years and years misallocated services versus taxes and I think we really owe a duty to do that. At the same time, I'm cognizant that this is would be a major tax increase for the unincorporated area, but it it been 20 years that the cities have been carrying the bill for the unincorporated area. And you know, we we want to treat the unincorporated area fairly, but it it's really hard to justify in Mendon where you're providing the services to your city residents and charging more for that and then you go outside the city and the

»cover more area.

»Yeah. Mendon's Mend actually in its fire area has more taxable value outside of Mendon than it has within the city. So, and and Paradise has I is it twice or three times as much area outside the city is within the city. And the misallocation there is just but it does involve I mean if you do the math this increase is going to hit homes at 100 to $150 a year based upon what their taxable value it is a significant change in how we've been allocating this expense but I think it's justified. Uh question, please. Um looking back at the paper trail, um we've for comparison, we went from 3.9 to 4

»about a 7% increase on the on the proposed mill levy in the district. It seems like We're going from we we had we had for this the last spreadsheet 813 I had 337 at 344 mills in the south and 203 in the north which which comes to about 575,000 600,000 but We're and so maybe a 7% increase if it was a uniform increase throughout the county, but it looks like 800,000 would be a much larger increase than what I had thought about before.

»Yeah, that you're you're actually comparing apples to oranges there.

»The the numbers you're referring to as being those are their allocations of the 3.9 million. Okay,

»that that's not

»the one that we're dealing with here. We're dealing the one that's equivalent to what the cities are charging through their own uh

»cities plus the 3.9 or 4

»in your case. Yeah. Yeah, that's right. I'm I'm I'm satisfied.

»If you just approximately I know we do this by dollar amount is Can you tell me approximately what what mill that is? It it looks like it it's um in the 370 range. What one of the reasons I'm having difficulty with it is all of the numbers I'm using were really originated in ' 05 and some of the numbers didn't include the state uh assessments. Uh I I think the proper way to do it is to talk in dollars and let let the the ratio come out. But it it is larger than the amount they're now paying. The amount they're paying is a part of the 3.9 or 4.2. This will be larger than that amount by about 15 or 20% that that the cities it it's not going to total 800 mills Larry. Okay.

»It's going to total more like 750 between the two assessments.

»All right. Okay. That's that answers my question. Thank you.

»Any more discussion?

»How do we vote? All in favor?

»Any opposed? That carries.

»Okay. Okay. Here's here's the next one. This one's just housekeeping. Um, the fire district was put in place in 2000 or 1960. At that point, they used the county name. It was called the Cash County Fire Protection District. Since that time, the legislature has got concerned about confusion between a county entity and a district entity. And I know we have the same confusion when we talk about this. The state has decreed that we not use the name county in a special district. So, this resolution is just to start the process of fixing our name so that we would be called not the Cash County Fire Protection District, but the Cash Fire Protection District.

»I'll second the motion if that's what that was.

»Any discussion? Call the vote. How do we vote?

»All in favor?

»I. Any opposed? That carries.

»Okay. The last resolution I'll present today is is recommending that we divide the district into divisions for purposes of trustee selection. I have a second so I can discuss that.

»I'll second it. Okay. We we had this in mind when we um made a effort to get this board appointed that we would like to have really we're looking to try and do two things. We don't want to have a district where all of the people are appointed from from the larger cities or even from one city. So we'd like to have geographical representation. We'd also like the rep representation to approximately represent the amount of funding that is coming from each each division. in in looking at at how to divide it, it seemed best to take the six largest cities and create a represent uh trustee position for each one of the six largest cities. So that's North Logan, Hyum, Smithfield, Hyde Park, Nibi,

»Providence

»and what

»Providence

»and Providence. So each one of those would be a division. And then to take another division which would be the unincorporated area and the smaller towns. If you put those together that's has roughly uh first of all it does a good geographical division. In addition, we thought it would be helpful to have one person that represent the entire district and and that is uh could be the county executive. It doesn't have to be. None of these positions are designated as an elected position or the mayor or whatever, but as the appointing individual, that's what I've chosen to do. Um I think in the future that may not be the case. For example, if Steve Miller comes to us and recommends that instead of him being on the uh board of trustees, he'd like this person to represent the citizens of Hyum. I think we'd be listening to you, Steve. And so I think that's something that will happen. But I think to get started, this is a good way to do it. In addition to my position which represents the entire district, I suggested that we have um one person that represents the entire south end of the valley and one person that represents the north end of the valley and that works out to be one of two county council persons. uh the north. Um I was thinking of having Dave Ericson because of his experience and same thing with Kathleen on the south. So that's where I came up with the 11 divisions whether these are geographical divisions. They're not by title. Some special service boards in the state have these kind of districts and just continuously appoint mayors to serve in that position, but they're not required to. And that's that's what we're proposing be set up. If this is our decision, this will be embedded into our bylaws when they're finished. But I if someone has a better suggestion, I would tell you that the 11 of us fit into these categories because they they were thought of when we proposed your appointment.

»Uh George, is this a conversation? I know that there's a rewriting of the bylaws being taken place right now. Mark is examining some of the things that weren't um uh corresponding with state code. Uh is this a discussion that is better when we look at the entire bylaws or

»actually the it we put a lot of stuff in the bylaws that um really shouldn't be I mean this actually has to be approved in a different way than the bylaws. It can be reflected in the bylaws. But this this actually it's kind of curious. The statute tells us exactly how this has to be done. It has to be done by Cash County. And the way it has to be done by Cash County because Cash County is the appointing agency. and and the way Cash County then operates, I'm the appointing individual subject to the advice and consent of the county council. So, so the way the state statute tells us to do this is this board makes a recommendation to the appointing authority which is defined as me and then I take it to the county council for their advice and consent. So it it has a different uh way of being approved from the bylaw. We can embed it in the bylaws but it has to follow that cycle. The the county is the appointing body. So when you divide it into divisions that appointing body has to be involved in approving it. So if if we pass this, it's simply a recommendation to me and then if I agree with the recommendation, I have to take it to the county council and have them approve the divisions. So that that's why it's not just the bylaw, but we can embed it in our bylaws.

»So George, tie that back into Katherine and and Dave. What's their role? You you brought that up. Where do they come into to that.

»Well, I'm I'm recommending u a division that is the south and the north.

»So, um I actually recommend to the county council their appointment and then the county council give me the advice and consent to appoint those two. Now I'm just like in your case if if you recommend someone from hire Steve I'm the appointing individual because I represent Cash County. What what would actually happen is you'd make the recommendation to me. I would say yeah I think that's a good person and then I would go to the county council to get their advice and consent. Then I would complete the appointment that you'd recommended. So the it's it's a little convoluted how it works. But

»back to my question, where does Katherine and Dave come into this?

»I I recommended that Katherine be a trustee and she was approved with the advice and consent of the county council. And I'm putting a a district in here that she fits into very nicely because it's the entire south. So that's the geographical area that Katherine fits into.

»George, would that that's the unincorporated south that she

»No, it's actually the entire south cities and the unincorporated area.

»All right.

»The

»the unincorporated area of the south is part of your specific.

»We put the small cities and the unincorporated in in one district.

»All right. It it is convoluted. That's a state statute. I I quoted if you look at it a little bit, you'll see some quotation marks in the resolution. I'm quoting the state statute. So, so you're recommending this to me, then I recommend then I I if I like the division that I proposed to you today, then then I present it to county council probably would get over there the next meeting they have and ask them to set it up this way and come back with approval, I would think. to approve these divisions,

»right? And and the the second part of this is to approve the divisions and then you can see I've allocated you into your divisions is the second part of the resolution. So just for clarification, it's separate from this board and those board members can change. So say in four years like two years my position I represent Smithfield my position as a board member on this board changes but that is that a separate person as well or is that tied to the same

»it it if for example you're you're serving for four years in your elected office but your office here is two years So, in two years, we will have to either reappoint you or appoint another person to represent Smithfield. And I guess I understand that. I'm just Is this could this be is there an instance where this could be two separate people?

»No.

»Like not the mayor? No, I'm saying like you represent the South, all of the South, but you also represent your job here, right? Would that ever be two different people?

»Yes. Yeah, it could. There's no requirement that an elected mayor or a county council member or for that matter the county executive be on the on this board.

»Just for clarity.

»Yeah, it's it's done by geographical district. Um, let me just say my feeling is, and I think anybody's feeling that looks at this situation will recognize that the cities are not going to participate in this if they're not in control of their own fire departments. And so I I think it's it's just obvious that that you're going to have to have the mayor do it. And frankly, I can't imagine If Steve Miller tells me he wants to be reappointed, then I'm not going to do exactly what he asked me to do. But if he says no, the way we're handling it in harm, I'd like my fire chief to be on here, that may create a question because of the prohibition of having anybody on the board that's employed by the district, but that's something we would have to face. Tony actually works for hire. But the question is, is an indirect relationship with the district problematic? And we haven't really got an answer there. We don't need to have an answer until that issue arises. But let let's take a a person that Chief Hammer in Lewon. You could make a suggestion that he served abuse it, brother or Mr. Bodley. you could make that suggestion to the county executive and take it to the county council and see if they want to make that change.

»If if I may, let me just make sure I understood your question. When your term expires, we we'll pick on you since you started it.

»Yep.

»Um we would have an appointment to the geographic district representing Smithfield, one person,

»not two,

»right? We wouldn't we wouldn't add two to the district of Smithfield. We would either reappoint you or appoint somebody else. The same for all of us.

»Is that is was that the question you

»Yeah. I just wanted to make sure there wasn't one for district.

»It sounds as if it's two separate people. I'm just making sure that it's not.

»Yeah. I mean, if if a district is a city and the city council and the mayor recommend an appointment, why would you not

»take that appointment?

»I'll have to ask three members of the county council.

»Never mind. I'll let that go. a little dicey there because the county council doesn't make the appointment. It's the county executive subject only the advice and consent. So, they can reject his nominee, but they can't put a new person in there,

»withhold their consent.

»Yeah, they can withhold their consent.

»I I think that was an answer to your question though about why wouldn't we support that? I'm I'm more comfortable having these divisions than just leaving it up in the air. So, I would I would call the question. I would move that we approve this resolution making that recommendation.

»Second.

»Any further discussion?

»How do we vote? All in favor?

»I. Any opposed? That carries. Okay. Next item, if I got this right, is G. Discussion and appointment of the swearing in of a clerk and treasurer for the Cash County Cash Fire Protection District. Um, in in this regard, I would I would suggest that for a nominal fee, we can have uh our county auditor, Matt Funk, serve as our treasurer. I think that's an easy choice and it won't cost us and we don't need to to worry about training or anything for Matt. Matt's back there. So I would I would move we appoint Matt Funk as treasurer of the Cash Fire Protection District.

»Second.

»Any discussion to that? How do we vote? All in favor?

»I.

»Any opposed?

»That carries. I I don't know who to suggest as clerk.

»Michelle's been doing our minutes.

»She has and doing a very good job of them, too.

»I think that's Is that a motion?

»I I move that we

»I move that we appoint Michelle I don't know your last name. I'm sorry. Right.

»And right. Thank you. As the clerk for the Cash Fire Protection District

»and as a part of her duty, take the minutes.

»Take the minutes and and post um yeah post oures notices.

»Um Janine can help you with that. But um

»this way it's formalized and hasn't been kind of jostled around. So

»and I'll second Katherine's motion. Any discussion to that? How do we vote? All in favor?

»Any opposed? That carries.

»Okay. Agenda item H. Completion of the state auditor's training for special district and special service district board members.

»On this, I don't know how many of you have gone through this, but it's an online thing. You you have to do it. We have a year in which to do it. Um,

»many of us have already done that with our elected.

»Have you already

»Well, how long does it last?

»Yeah, that's

»I think it's an annual.

»We can ask.

»It is extensive. It's not just like Ultma is super fast.

»Yeah, it's different than

»Yeah,

»this is special district stuff.

»Special district one.

»Yeah, it's it's intense. It really is.

»It's easy. This is more involved. It probably like an hour.

»Yeah.

»Whereas like

»Oh,

»did you do it?

»We

»I did it for cash mosquito abatement district. I think I did it here, too.

»We had to do it for this board.

»Okay.

»So, I would be surprised if you have

»But we have to do it. So,

»so why don't we have the clerk figure out how we do it and let us all know and also the time period in which we have to

»do that. if if you wouldn't mind doing that for us. I I've got a question about the purchase of crime insurance. Can you Matt, can you help us with that?

»Matt Funk Funk, Cash County auditor. State law requires you to have crime insurance. Uh the county um gets our crime insurance um from I believe the trust and it's just part of our of our insurance coverage.

»So can you give us the information as to how this board does that?

»Yes, I could I could hook you up.

»The fee that we pay?

»Yes, you need to get talk to the I I think it's the trust. Well, is the trust going to be your insurer as well? In that case, we just need to find out who your representative with trust is. uh and reach out to them and

»if you would would you help us by checking with them and I I guess at some point we're going to have money. We don't have any money right now, but as soon as we have money we can buy our crime insurance.

»And that's a good question. I think right now we're operating under what I call the first interlocal. We had signed an interlocal the county had with the with fire district earlier this year where the county is basically covering your expenses and I think that we would just

»all right

»as part of that interlocal cover.

»So we don't need it until maybe next year is that

»um sometimes um particularly um sovereign citizens or constitutionalists can get excited about this coverage. I would think just to forestall that discussion we probably ought to get that taken care of sooner than later. I would be happy to uh facilitate that.

»Thanks, Matt.

»Thank you.

»Um, just an update. I just looked that up and everyone has to do it once, the service district training, and then you just have to do OPMA thereafter every year. So,

»once per lifetime that's what this says.

»Doesn't change ever

»within a year of appointment. So, maybe you have to do it like for each district you're on. You can look that one up.

»So, can you just send us a link? that

»I'll send it to you guys. I'm right here.

»Okay. Any other discussion on

»crime insurance?

»Crime insurance. Okay, next item, next meeting and upcoming upcoming business, discussion and consideration of the next meeting date and setting public hearings for resolution 2026-04 and resolution 2026-05. Is there any immediate business that needs to be done before

»I don't I don't think so. I think I think we could put it out a couple of weeks at this point so that we get our county council meeting in um the public hearing notification is longer than a regular meeting. Is that two weeks?

»I think it's 10 days.

»10 days.

»So September 8th is the day we need to have everything

»for the three levy,

»right? And and I I believe what we have done here is sufficient for the fire board.

»The municipal services levy is a county thing that needs to be done. But I think we've done what we need to do to put in place the the proposed levy. Is that correct, Matt?

»Matt.

»Um I believe for you have to submit a report. You have to make a report

»to the county

»to the county council. That's one. Uh then two, you have to um submit or send a notice of of evaluation to every property holder that would be impacted by this. My advice would be maybe that you piggyback along with county. The county is also sending out notifications. So I would reach out to the county treasurer Craig Mallister about uh doing that. Then you two weeks before the general election, you have to make a public statement uh to the county uh to the citizens. The county is doing ours on October 13th. Um then you have to have a budget hearing. Uh the county's doing ours I think on October 27th. And finally, you have to have a truth in taxation hearing. Um I believe that's after the general election. The county is doing ours in November. Um, and finally, you have to make the county aware of all of those dates before October 1st. And I brought a paper along with you all with me. I'll give that to you later. But so there are four or five more milestones that you have to hit.

»The the milestones of making a report to the county. I covered that in in our resolution O2. It's it there is said that the cash fire protection district report this proposed levy and its purpose an amount to the to the cash county executive and cash county council is required by Utah statute. So my my intent was to take this statement and take it to the county at its next meeting so that I fulfill the purpose. I I think we have to tell them what we're proposing and the purpose of it. Uh and so I was going to do that.

»Okay.

»Um I'm not sure. I think I do that before the truth and taxation hearing.

»Oh yes.

»So that I was going to try and get that out of the way on the September 8th meeting. Catherine,

»are we talking two different things? You're talking about the the levy on the unincorporated. No, no. This is the this is the the municipal services levy is simply our recommendation to the county.

»So, it has to have the mill levy, the percentage, the dollar amount and the intent spelled out for what it will be used, right?

»Yeah. And the intent and the dollar amount is spelled out here and then they will run the computation on that.

»Okay.

»Yes.

»Okay.

»Yeah. Now, if we try and predict the computation, we're just going to get ourselves in trouble. So, I predicted the dollar

»on the mailer,

»right? So, you've got the mailer you've got to do. And this is all, by the way, governed by Utah statute, truth and taxation statute in section 59 or title 59. Um, you've got the mailer, you've got the public notice, you've got the budget hearing, and you've got the truth and taxation hearing. And I'll work with George to make sure that we uh make sure we hit all of those milestones. Okay.

»Okay.

»I move we adjourn. Are we at that point?

»Well, we need So, are we going to set a a meeting or No.

»Yeah. I think we probably ought to set a meeting. Do we want to

»kind of say like it was first?

»We had kind of a standing

»kind of did and then it kind of fell apart.

»We got busy.

»Yeah.

»We had a meeting schedule. I think it was like the first Thursday of every month. at noon.

»At noon is what we had as a schedule. If we're able October 1st,

»I think we um I think it would be helpful to have another meeting in two weeks. The the NOAK is is pretty well set. There's there's a bunch of issues in SOAK involving the provision of EMS service that I'm I'm not sure they'll be ready. G George, do you think and Steve, do you and Larry, do you think we'll be ready to to kind of figure out what we're doing in the SOAK by that time or do you think we'll need more than two weeks?

»Have we set the next SOAK meeting, Justin? Can I ask Justin because he's the secretary for so

»it's a week from Friday.

»A week from Friday. That sounds right. So it should be after that for sure.

»A week from this Friday.

»September 11th.

»That's the correct date.

»September. Yeah.

»So 16th would be two weeks from today.

»Yeah. Why don't we set a meeting the 16th if if soak doesn't have anything to report. Mayor Rudy, we could just cancel the meeting because I think we've done what we have to do at this stage.

»I'll be out of the country until the 18th. So, um,

»be your meeting.

»I'll be here. So, I I could conduct the meeting if we needed to.

»Sorry, what date did we say? 16th or 17th?
