Welcome. We're we're happy that you're here joining us today, and, we're gonna go ahead and start with opening remarks by council member Dave Erickson.

I'd like to do my remarks in a form of a prayer.

Our father in heaven, we're indeed grateful at this time to be able to gather together in such a wonderful environment, wonderful and clarity will come to our hearts, and the decisions that need to be made. We are grateful to be able to live here in this wonderful, very blessed. So many things. We're grateful to be of support to others, and have helped others. We will, be able to understand everything that comes our way. We pray for those that are have been in harm's way to protect our freedoms, pray for them, their families, their losses, sacrifices for us. We're grateful to be able to celebrate, to celebrate such a wonderful time in the two fifty years of existence of such a wonderful country that thou has been behind, and supported and influenced. We're grateful for those that protect us each and every day and those that give of service to each other. We pray that we will realize that recognize them. We cherish them. Do this in the name of Jesus Christ. Amen. Amen.

Mister Miller has really taken to heart honoring our country. He's an 89 year old gentleman who has produced some really beautiful artwork, and coloring. And we thought it was appropriate to honor him with a declaration and to have him come before us and have our county It's cool. Chair present him with a plaque on behalf of Cache County.

I have a number of things I'd like to kind of walk through with you. Okay. I met

yesterday with Dane, would you maybe close those doors real quick?

I met yesterday with the mayor of Millville and their city manager, and, Matt Phillips and I walked portions of the road as it enters and goes through Millville. We discussed what kind of work would be done on the road. I've asked Matt to prepare a cost estimate for us. We are due to do some regular maintenance on the road. If we looked at the road, in some areas, the shoulders have been damaged either by use or maybe by the sewer system that we put in. I anticipate I'll have that estimate, and I will bring you the estimate, and we will have a discussion. We we do have a cog project that's pending that is the whole road, so we're we're gonna have to kinda manage that in connection with it. But that's what's happening with respect to County Road 238. Also, I'm setting up a meeting with River Heights on the subdivision as well. On Clarkston Mountain, we've received an estimate from the appraiser. Kurt, I believe that was 5,000 doll $4,000 to do the appraisal. I hope that comes out of your budget, Dane. But it's it's a nominal amount. If if if I think it would be important to get that appraisal done so we have that valuation. So Dane and I will arm wrestle over whose budget it comes out of, but we'd like to go ahead with that. I don't know that we need a formal council resolution. All we're doing at this stage is simply having appraisal done. K. K. Alright. Perfect. There are other stages where we need to give public notice and so on and so forth, but this stage is just to get an appraisal. Once that's done, we will share that with you and with the landowner.

K. Anybody have any questions from the executive? K. Thank you for that report. We appreciate it. K. Next on our agenda is the Bear River Health Department advised interlocal agreement. I'll turn time over to Jordan Mathis.

Thank you. Jordan Mathis, director of the Bear River Health Department. Given some of the changes that we've gone through in the integration of behavioral health services in our three counties, it necessitated some minor changes to the interlocal agreement that you all approved last February. Not last February, because that'd be February 2026. February 2025 is when it was approved, by the three counties. I don't know if you want me to walk through the substantive changes or if you had a chance to look at them. They were all marked in green. I can explain some of them if you'd like and why those changes were were brought about. Whatever you'd like me to do, I'm prepared to do whatever you would like that would help you in

making your decision. You know what, Jordan? I don't see anything green on my copy. Oh, was it? So maybe maybe

Real quickly, on page three and two point one, we just changed the formation to rather than reaffirm to affirm and and added February 2025 as the formation. That was when the the health department was made a united a multi United Multicounty Health Department. The biggest changes that we had were under duties. As we reviewed that, we we hit on some of the behavioral health duties last time, but we didn't add the specific duties under code for public health. And so we put those back in there, and then we also expanded some of the duties under behavioral health to make sure that we were being very clear for it's very clear to me and my brain, but for my predecessor to whoever replaces me, would understand what that what those duties and responsibilities are. So we we expanded the duties section quite a bit just to be a little more explicit and broke it out between public health responsibilities and behavioral health responsibilities because there's two separate codes there. Questions there?

It's not super critical. We were shooting for July 1. What this allows us to do is to execute a contract with Bear River Mental Health. That does need to get put in place by July 1. I don't know that it we what I'll say is, and and maybe mister Murray can chime in. We were already given the authority to contract in the last one, so I'm not that concerned.

If we waited In regards to my ability to execute that. There are some minor changes with regards to the behavioral health director that are involved in this that we would just need to wrap up pretty quick after that.

But that could be but that could be ratified that second week of July pretty easy. July 14 or next week. I'm not gonna be in front of

Rich County until July 1. Okay. So we have some time. Yeah. I I would rather see the the completed version of k.

Maybe this one's there. Under organization four, we we made some minor adjustments to the membership of the Board of Health. And what you have there is we split it into voting members and ex officio members. The voting members stay the same and the voting members are still nine members that are appointed by the legislative bodies of each county according to the population. It adds two ex officio members, one of those being the Cache County Executive. So whoever holds that office would be an ex officio member. And then we've been working with Utah State to have an ex officio member of Utah State. They're in talking to the president's office, they would like to have somebody from their emergency manager be that ex official member because they both look at student side of things and and being the largest employer in Cache County also look at the employee side of things. So they have kind of a a double vision there, and look at the impacts that they're having on the community. So that's the position they're looking to potentially have serve in that.

Jordan, in your version, is that under four point two point two? Because we don't have anything in ours about ex officio members. It's four point two point two. Four point two point two is blank on our version.

So I'll go to six b. In in statute, it allows for and the language is transferred from there into the interlocal agreement. It allows for the, the appointment either directly or by contract for a behavioral health director that would oversee that would oversee both mental health and substance abuse programs, the delivery of those programs in the community. Given the integration work that we've done, last year, I had you appoint an individual directly worked for Bear River Health Department as we look to integrate those and and put that under one contract with, Bear River Mental Health who will be called Bear River Behavioral Health from now on. My proposal would be that the the council give consideration to appoint by contract Trevor Cook, who is currently the executive director of Bear River Behavioral Health. Just to note, the interlocal agreement and the language there reviewed by the county attorney's office was very clear that if that position changes, as a not for profit agency, they can hire whoever they want as their executive director, but that does not necessarily appointment by the three counties. That's in code and that has to that has to exist. We've also transferred that same thing over to the contract so that they're aware that that's the case. So that's how we would we would work that. But my proposal to the council right now is that you consider, Trevor Cook to serve in that function.

Alright. I have a question. A motion or something? Or Yeah. We'll we'll do that, but I that says the term there's no term. He just is there until the their nonprofit makes a change, and then that we would consider a change.

Yeah. So the it it would be subject to it would be subject to the the current contract, which has eight more years on it. Okay. That's what that's the contract that we would sign. And then, we we would have to go through a bid process at the end of that to determine if there's any other entities in our community that could provide the scope of services that we need for comprehensive behavioral health services. They will most likely put in an application and at that point. So it would be for the term of the contract. Thanks for the clarification.

Good evening, council. Before you is ordinance twenty twenty six dash 27. The ordinance in question deals with electronic meeting procedures for the county council. This is, for the most part, largely an effort to essentially consolidate the council's rules, but there are some also some rule changes involved as well. Before I begin my presentation, I'm gonna pass out a flow chart that will be referenced later in the presentation, but it's really helpful to look at.

Is this how you do it?

So Oregon's twenty twenty six dash twenty seven, got a little typo up there. Sorry about that. It proposes an enactment to county code that governs electronic meeting procedures of the county council. Why is this necessary? It places electronic meeting procedures with other county council meeting procedure provisions in chapter 2.16, the county code. In short, it puts all the meeting rules together in one place. In the event of an emergency or if a question about meeting procedure arises, all relevant county level rules are in one place just for reference. So, here's a little bit of context. In response to the in, in the excuse me. In response to the COVID nineteen pandemic, the Utah legislature actually, the bill itself was authored by mister Val Potter, who is here in attendance with us. It passed HB 50 o two, which amended the Utah Open and Public Meetings Act. It initiated some requirements and expanded some allowances from local governments to have rules and procedures for electronic meetings. The county council adopted resolutions twenty twenty six, 27, and twenty twenty two dash 12 to establish electronic meeting procedures, but these didn't add or meant to existing rules in county code. So essentially, you had different sets of rules that were floating out, not in reference to all the regular rules. So Cache County code chapter 2.16 is the main repository for count county council rules and procedures. Right now, it does not contain any provisions related to electronic meeting procedures. So the ordinance itself, it would establish clear guidelines under the open and public meetings act for conducting county council meetings remotely, establishes that the anchor location for meetings, which is more or less where the meeting physically happens, the county council is the Cache County Historic Courthouse, which is a building that we're in now. It requires a physical quorum at the County Historic Courthouse to approve a standard electronic participation by majority vote. Let's say that mister Garrity is on a business trip. Let's say he's in Ohio, and he would like to attend the county council meeting. He has a a work thing that he he can't miss, but still wants to participate. He would send in a request, and that request would come before the county council. You all would have to vote to approve, mister Garrity's or anyone else's attendance. And once that vote is approved, then those other council members can participate remotely. It this this ordinance itself would grant, remote council members full voting and participation rights once of it once the electronic meeting format is officially approved.

In the event of an emergency, in

the event of an emergency, it authorizes the county council chair to completely waive the physical anchor location requirements during health or safety emergencies via a written determination. That is a rule that is currently not enacted by either of those resolutions I referenced. This would be something that would definitely, I would say, help in the event of emergency. And it also provides a backup mechanism to use the if the county executive declares a state of emergency and he designates a temporary seat of government, this would also allow you to use that temporary seat of government as an anchor location. So a lot of this is technicalities, but if you are going to be wanting to follow the rules during an emergency, this would more or less give you that authority. And something that was not put in my presentation itself, was the question about, public participation. There is a provision in the ordinance itself that does talk about public participation, that says if it's, requested by the council chair or any other council member has to be approved by I believe it's also majority vote, or if it's required by state law, like, for example, during truth and taxation. So it also addresses that as well. Here's the flowchart. It's a little blurry to see, but do any of you have any questions?

I I have two. So one, just for clarification, I'm gone. I request that there's a public or an electronic meeting that can be approved at the beginning of the meeting, or does it have to be approved in a prior meeting? It has to be approved

at the beginning of the meeting that you want to join. Okay. So if I'm gone on the twenty second, it

and I can still participate if voted yes. Yes. If we vote yes. If we yeah. Yeah. Depends on the issues at hand, are you? And then the other question is, it does say that notice of the meeting is a required twenty four hours. Is that happening by default because we're saying, yes, there's a meeting, it's live streaming on YouTube, or is this a separate requirement where you have to notice that it's specifically an electronic meeting twenty four hours in advance? It would have to be a separate notice, the the second answer. There would have to be a separate notice for an electronic meeting. So someone who's gonna be gone should know twenty four so then you could notice that there's a twenty that there's an electronic meeting. And even if they voted no, you're still covered because you noticed that the work okay. Yep. So basically, what I'm gathering is at least 24 notice is kind of the absolute minimum requirement. Yes. And I guess, another part of that question is by designating it as an electronic meeting, does that mean that if there's a public hearing that participants can participate electronically, automatically, or are those two things separate? I was gonna say, I believe as it's written under the ordinance itself, the two would be separate. Okay. And that would that also have to be voted on as well separately then? I believe so. So, like, one vote to say Keegan can participate remotely and then another vote to say the public can participate remotely? Okay. Yes.

I think that answers my question. I do also add that I believe the twenty four hour notice part, if I recall correctly, is a requirement that's actually from the open and public meetings act. That's not me just making something else out of there. This is you trying to gather those things. Yes. So when it's true to taxation, we're required to allow public comment. We don't have to You don't have to vote for that. No. That okay. That's just automatic. Yes.

So if someone is attending remotely I'll just throw Keegan again. He can't be included in the the vote for a quorum, though?

Not for the initial. So there has to be a physical quorum at the location. Yeah.

And then that unlocks the gate essentially that For you to participate, though. Okay.

And I know that at the beginning of the pandemic, that was a really, really big concern of for, you know, using Zoom or Google Meet if it was very secure or not for organizations to use. I believe, though I can't testify to it, we do use a lot of Google, occasionally use Zoom. In terms of security, I think we we're pretty covered with that, though. Yeah. Well, you have the same situation of if you open up to public and somebody stands and says who they are, do we know who they are? Because we don't have a vision of them. There's so much we can do. No idea. Do we wanna require video

Evening. I'm Brian Nava with development services. Tonight we have a ordinance twenty twenty six dash 32, establishing a temporary moratorium on the development of utility scale data centers. Need for a pause, our current county code for, zoning development and construction standards do not contain clear definitions, or regulations, to manage industrial scale digital installations, adjacent to any of our agriculture agricultural or residential areas. So what is this ordinance? It's a hundred and eighty day protective pause. And this will give, planning and zoning time to prepare permanent code text amendments during that moratorium. During this moratorium, Cache County will not accept review or process any applications for data centers in any zone. Also we will evaluate if we will allow data centers, what codes do we need to add or code that prohibits them altogether. And during this time, we'll workshop and keep everyone in the loop, including planning commission and and county council throughout the whole process. That's kind of all we've got for this moratorium to present to you. Do you have any questions

concerning this? I just want to state publicly, and I I said this for the newspaper too. We have not received any interest that we're aware of of somebody wanting to put a data center. So this is not in reaction to Yeah. Any kind of inquiry. This is just us trying to get ahead of something that may or may not even come, but we want to be ready if it does.

And and this is only for the unincorporated Yes. Properties that is not Does not include municipalities. Does not spill over into all the municipalities.

That's their business. Yes. Sure. Yeah. I I will add that I did meet with the chair of the Logan City Council, and they're doing something very similar. Yeah. They realized that their code isn't caught up with some of the potential demands that could be coming. So I think it's just a precautionary

Please do. That added to that, that we have an exam of the board that's gonna govern any such application.

It would be our planning and zoning Planning and zoning? It's our planning and zoning commission would be the ones to examine that. Yeah. It would come through it would come first to our development services then through them and then to us for final. And it would have to be probably a zone change, which would always come to us in the end. So it's that's the process that would happen.

I'm not sure how I drew this short straw to present on the airport, but this has been a lot of work that, Keegan and Dave and Mark and all of OMP have put in and the executive. So just to give some background to everyone, back in December, there was discussion with Logan City about Logan City withdrawing from their participation in the airport. They they did pass a, resolution through their city council that withdrew, but as we looked into all of the FAA regulations and our grant requirements as the airport authority, we realized it's not so simple just to have one of the parties of the airport authority withdraw. And a reason for that is the airport authority is an interlocal entity separate from the county or the city. So it's its own legal entity, and they are the ones who have applied for all of these FAA grants that have a lot of really strict regulations on how that money is used, who controls the money. And and so we went to work with Logan City and with our, ordinance and policy to come up with a way that keeps the airport authority intact but has the same outcome that we are seeking when Logan City was going to withdraw. And one thing that's important to know is when you're talking about airports, even if the county is running the airport because it's located in Logan City, Logan City, under FAA regulations, gets a lot of say in in what's happening with the airport, and so they were going to have to continue being involved. So what we've proposed is an amendment to the 1993 interlocal agreement between Logan City and Cache County that created the airport authority. And what it does is it retains Logan City's involvement within because it's within their boundaries, but it removes their financial liabilities, which was what we were going for when they were withdrawing from the airport. And then it restructures the governance of the airport, really to to try to get in line with the there's an an audit or a report done a couple years ago about the airport's governance, trying to move the airport from something that's a financial liability for the county and the city to something that's self sustaining and is an economic positive for the community, which I I think it is even with what the the county has to put in. But the the hope is under this this new form of governance that there's gonna be an enterprise fund that's that they're going to be required to start, and that's going to eventually become something that's self sufficient without any taxpayer money going into it. The county will take the financial lead in the meantime. So if there are appropriations, they will come through the county councils through our normal budgeting process. You can move to the next slide. So so what the the new interlocal agreement, the amended interlocal airport authority sponsor board. When we're talking using the term sponsor, that's a a term of art that's used by the FAA, for whoever is ultimately responsible for the airport and is on on the hook to make sure all of the the laws are being followed. And that that is the two entities that created the interlocal entity. So that's going to be composed of seven members, three members of the Cache County Council, one of which would live in Logan City, the Logan City mayor or their designee, a Logan City Council member, and then two county elected officials. So whether that's the county executive, the county auditor, the county clerk, two county wide elected officials would serve on that. They would approve the the airport's budget, the airport authority's budget. So the overall budget of the airport, not what they're asking for for the county, but what their overall budget is for the year. Enact bylaws appoint and remove people from the operational board, and they can overall override any action taken by the the Airport Authority Board, which would be in charge of operations that would violate any law or any FAA regulation. That's the oversight. They have to make sure we're not violating any grant conditions. The other side of that is the Airport Authority Board, which is in charge of operations. The it's going to be people who have some technical aviation business expertise to actually run the airport like a business and move it to where it'd be profitable. So it'll be six members from the general public and then one county wide elected official. They're responsible for the daily operations, technical oversight, maintenance, contract leases, and hiring of any personnel they need. They'll be stat appointed and staggered four year terms with a maximum of three consecutive terms to to limit the amount of time someone can spend on that board without being replaced. And all of that, it it might not be exactly what was proposed in the the report, but it's it's what we came to be as close as we could to adopt those recommendations.

The next slide. And I have a question about that, Dean. Yeah. The the management board, who is the appointing authority? Is it the the

The the sponsor board? Sponsor board will be the appointing authority to the management board. K. Thank you.

Could I just say something real quick? I think when we were talking about this, we were if we if we are comparing it to a business model, we were using, you know, the analogy that the sponsor board would be like shareholders and the authority board would be more like a board of directors, if that helps.

Yep. Thank you. So just to go into a little bit, because we we're here on the precipice of this agreement ending, and we've kind of walked that back. So it's valid for the new interlocal agreement. We valid for a minimum of ten years and then not to exceed fifty. So it's if everything's going really well in fifty years, that's when we're gonna have to come back and and take a look at this again. I think as we've gone through OMP, they there's a realization that we'll probably need to come back and look at the interlocal agreement once things start running to see if there's things that need to be adjusted. And then just to talk about dissolution a little bit, because I I think that that's something it'd be good to put on the the public record of dissolution of the the airport. So in one scenario, that's where we were we were almost with Logan City, that it would dissolve and, Cache County would continue running it. Logan City would be out. That's that's one scenario. In the in the agreement, it's must be run for at least twenty years. And the the reason for that is when we accept FAA, loans or grants, the requirement is that and some of them, it actually is in perpetuity. It has to be used as a if you're using this as an airport or you're taking this money, it has to be used as an airport. You can't take this money for the runway and then turn it into a road or something. Otherwise, it's twenty years from the last time you accepted money from the FAA that it has to continue running as an airport. One of there's a a case out there where, city of Cincinnati had two airports. They're international airport and then a smaller airport, and they wanted to stop running the smaller airport. And it took them twenty years of not accepting FAA funds, but having to pay to run the airport to get out from under without having to pay back the the funds for that. And so that's something I think everyone, hopefully, in the future, takes into account that we have to keep running this as an airport as long as we're we're taking FAA funds. And that would even be with the intent to close the airport where the city and the county both say we you know what? We don't want to to run an airport anymore. In that case, the assets would be split fifty fifty. I can't imagine a situation based on the the volume of flights at our airport that would ever be the case, but I just wanted to put that out there. One thing I I did wanna mention, I I got Andrew and George a copy earlier today, and I just heard from Logan City. The format that that Logan City had proposed for this is what's in your packets. As we talked about that in OMP, I I'd proposed something different. There was a more of a standalone document where you didn't have to refer back to the 1993 agreement. I incorporated all of our changes so you did not have to look back at 1993 where it's a standalone document. I I heard from Logan City that they're okay with that, from their attorney. Logan City will still need to to go through their process with this. But, really, what our this resolution is is you're you're agreeing with the content of the the interlocal agreement, and you're giving the county executive the the authority to go sign that agreement. There there could be some some small edits that are not that are that don't go into any of the substances we're trying to get the formatting and things right, but that that I I there's no problem with giving him the authority to enter into that. Him and, Logan City's mayor can can work that out with the attorneys, but this is really the the content of this and the structure is what we're we're giving him authority to approve. But but the version you have would be different than this. It it's it's different in this. If you look at this version, it says this amend it's it's actually a little bit confusing because you have to refer back to the 1993 agreement to see what this is actually amending. What what will eventually be passed and has has been passed on to the executive now is, it's it's all a standalone document. You don't have to look back at the the previous interlocal agreement. Everything from the previous interlocal agreement will will be replaced with this with the exception of the legal description of the airport. That that is the only part of that agreement that is incorporated.

Is there a time sensitivity on this one?

So Logan City's council is not meeting again until the middle of July. And really what they the city government has a little bit different. Their their mayor has the ability to to enter into these agreements without the council. They don't have a they don't this isn't implicating their budget at all. So so mayor Anderson can enter into this, and we can work through that. Their council is going to need to pass a resolution rescinding their withdrawal from the airport. As we talk through it from a legal standpoint, I I think that's more symbolic because the FAA isn't going to recognize their withdrawal because we didn't go through the withdrawal process with the FAA. And so the the time sensitivity is is more just to say we we have this in place, but the airport can continue functioning. I I do think we need to as far as the airport board, we need to hold off on meetings meetings of the airport board until we can reconstitute these two boards and get get that going, which is is a burden on the airport because we have we've had some time without an airport board meeting trying to work this out. But but we are the effective date will be retroactive to July 1 is when their their withdrawal is effective. But Logan sees attorney and I have have said we'll keep that as a retroactive date to say this is when it started, and we can start working on getting getting board members in place and having meetings.

So so this interlocal agreement will, in effect, complete their withdrawal agreement? Like, it'll take the place of the one they signed that was

not valid? Yes. So This will this will do the same thing. So so they'll need to pass a resolution just saying, actually, we're not withdrawing, but but this will replace. This will be the agreement between the cities. Because because right now, the the official agreement between the cities is still that 1993 agreement. This is an amendment, the first amendment to that agreement. But Logan City does need to go through the process of making it clear that they are not withdrawing.

I I had one question too. On page one, it says, the parties intend that the airport authority continue the ownership and management of the airport as a distinct legal entity separate from the city from the county and city. So which air it just says airport authority. Is that the

the So the air so there's the airport authority, which is the legal entity, then the airport authority board and the airport sponsor board are are part of the governance of the airport authority. So I I guess to to put a So they're both both boards? Yeah. They're they're part of the airport authority. The airport authority isn't it's it's almost so say the it's the county, the county council, and planning and zoning. They're two different, boards within or governing structures within

So the airport authority will own

and manage the airport separate from the county and the city? Yes. And that that is the status quo. That is what currently exists. And I I think maybe to add to that, like, in the section about budgeting, on section six, I guess it's would that be 13? It's number 13, but called section 10. Number six, it says the airport authority board shall establish and maintain an enterprise fund for airport operations and services that are financed primarily through user fees and other airport gen airport generated revenues. So I think the objective is that they are a self sustaining entity. Of course, there'll be a lot to untangle. You know, they'll sustaining entity. Of course, there'll be a lot to untangle. You know, they'll have to take county property or vehicles or whatnot, and we'll have to sell that to them. You know? So it's under their ownership. But, yeah, I think that's the that's the vision long term.

K. What other questions does anyone have for Dean?

It just seems I read in there is that they'd meet once a year. The support board?

The the Sponsor board. Sponsor.

seems like a little closer would be better, but I think it was a minimum of once per year. It is. Yeah. So it's just setting the making sure they they need at least once per year, but I and that that's it'll be members of the council potentially potentially three people will will be three people, potentially you or Keegan or Sandy that's on there. So you can you whoever's on there can

can advocate for, we should meet more often than that. I think the minimum was, again, to use the analogy of a shareholder meeting, it'd be like, you have to provide a prospectus once a year. Yeah.

I just like to compliment everybody that worked on it, because I really liked it. I thought it was well put together and everything Gotcha. Thing was included in it. Any like, the dissolution and all of that, I'd I'd really like to compliment all of you

And the progress was it was incremental and it was methodical as we develop through it. It I thought it was it's been kind of exciting to, you know, to to be part of that and and bringing all that together. It's I can see some quite dynamic things happening now out there when when the thumb gets pulled off and they're able to run it run it independently is that well, semi independently and and like a a good business model would probably be created there.

So This will be the only county operated airport in Utah. All the other airports are Cities. Sponsored and run by cities. Yeah. So that that's a that's kind of an interesting aspect that we've chosen to do it by county in this valley.

this isn't a hill I'm gonna die in, but I just wanna mention that doctor Jones did specifically recommend in the report not to have elected officials on the airport authority board, and we do have one. It's one of seven. But as mister Murray mentioned, there was some deviation from the recommendation, and that was probably the most glaring example of that.

So what was his reasoning for not

because well, I mean, just to be blunt, because politicians often don't know about engineering challenges or aviation or aeronautical issues, and sometimes they're they're influenced by other factors that may not be in the best interest of

You mean, like, self interest?

That could be one of them. But, yeah, we're we're potentially a airport authority board that doesn't have an elected person could just focus on the economic impact.

I think having an elected person actually makes it better, because you've got a representative of the people

with skin in the game, kind of. Well, and keep in mind, we do have a sponsor board that appoints those people that will have three of us on it that oversees that. But yeah.

Let me just respond to that by saying it it doesn't say which elected officials. And I think the critical thing as the sponsor board looks at the situation is to make sure that the person that we choose from amongst our elected officials is someone who has some skill, is someone who has some skill apart from the ability to become a politician and get elected. We have a number of elected officials who have real skills that would be welcome on a board, not because they're an elected official, but because they have other skills. For example, Matt Funk has a set of skills that any airport authority board would welcome having him on the board. But I do think it's wrong to appoint someone because they're elected official. That that's the distinction I've made here. I agree. And and I I acknowledge that that we we have five or six elected official. Surely, we can find one of them that has skills that are appropriate for the airport authority board. And quite frankly, we can amend this if we decide later on that we don't like that. I think this is a transition period where we've never had this operate this way. We do need to keep our thumb on a little bit. I don't know. We wanna take our thumb off, but I think we need to make sure this is gonna work and work how we intend it to work before we completely unleash controls on it. So

But there's only one thumb. And there has been two, and that's that's kinda created some inefficiencies. Only one thumb. Only one thumb. Well, the way it had Cash County I mean, it's it it's I think we're

I think we're narrowing things up. I really would like to sit down with the county council and talk about the airport authority board because, I I think the way it's set up, correct me if I'm wrong name, is is I'm going to nominate one of the elected officials. So I'm the one consent from you with respect to to that appointment. That comes from the county, not advice and consent from the the sponsor board, but advice and consent from the county.

And that is the language in the agreement too. That is an advice and consent. Yes. Perfect. And I'll go on the record saying I agree with the executive that it is possible for a politician to have real world skills.

I wasn't here for last meeting, but I saw the two COSAC initial approvals. So, you know, there was an effort made a few months ago to go on the radio for someone I think Eric went on the radio, and they sent out the mailer. I think the the efforts to promote the program were very minimal in cost, but I think that raised some awareness. So, might consider doing that again in the coming months. Airport board, we just covered that, so I think that's a a good milestone. If you'd indulge me for a second, I just I wanna talk about rec center and kinda where we're at with that and a proposal that I have. K. Is that alright? It'll just take a couple minutes. Absolutely. So there was a presentation last time. I I wasn't that was again, I wasn't in attendance, but I watched the video. And, just to do a quick recap, there were three proposals put forth, which was potentially one rec center in a central location, two, a north and south, or three, a north, a Logan, and a south. And I don't wanna speak for the council, but it seems like nobody was interested in doing three that k. So I think maybe one or two were entertaining, but we have BCBO that I think is somewhat confused on, the guidance that's coming from this, I I guess we're calling it advisory board Steering committee. Steering committee. From what I understand, the steering committee was never officially appointed by either the executive or the council. I think they were self formed, and this is not a criticism of them because I think they took it upon themselves to study issues and But I think it it be It causes some confusion for the for BCBO, because we approved the, RAPS tax money to fund that, but they're looking for direction from a board that isn't actually appointed by us. And I don't know that it the representation is geographically equitable either. I think sometimes one city might bring more people to it, and so it it gives the appearance that maybe there's more support because for for one idea, because there's more members from that city there. So, I guess, just to cut to the chase, my proposal would be that we look at that board and and officially appoint members. Maybe it's a seven member board that has more equal geographic representation, and it it could also have many of the members that are on it now. But I think that would help BCBO understand that, okay, this is a county sanctioned board, and they're advising. And I would also recommend that there be probably two of us on that board. I'll say one more thing about this, and that is, I think there's interest in getting this on the ballot to let the public decide, if they wanna fund it, because it would need to be bonded. But I think if we want to do that, put our best foot forward in that, I think we need to have a clear vision of how it's how much it's gonna cost. Nolan brought up a good point that I saw on the video, which was people need to be able to take into consideration what's happening with the school board, what's happening with the fire board. So they're going in eyes wide open of how how much costs are gonna affect them. And I think Mark made an excellent point of, if we don't give people a clear vision of what's gonna happen, then if it's voted down, that could be used for the next twenty years as people just don't like rec centers, but that's probably not an accurate representation of the public's wishes. So my proposal would be that maybe next meeting, Andrew works with me to put together the language of what that board would look like. Then maybe in a following meeting, we start talking about what members would be on it, and then we give them, them, let's say, six months to make a recommendation on a location and maybe how it should be managed. Those could be some of the topics that that are discussed, but we can get into that later. But that's what I would like to see happen. So and then potentially, we look at getting this on the 2028 ballot during the presidential election.

Just so you know, Keegan, I've I've been to every steering committee meeting except one, I think. And I think we're way beyond appointing a board, and I think they the people that have been working with BCBO BCBO has a present has a proposal ready for for two locations. They're they've already got they've already scalped out at exact locations and what they would cost. They're ready to give a cost proposal and bring something to that that committee is ready to bring something to us as a council to say, would you vote to put this on the ballot? And I and I think they're I think they're ready to do that. I I don't think there's an appetite amongst the people there to go back to the beginning and and appoint a new board, and wait until 2028. I think by 2028, they'll they will have all done something different, which might be the answer. But just just so you know that, like, I I've I've been to those meetings. I spoke to Whitney after the last meeting. They're ready to bring us a proposal with actual costs that can go to the voters. And I think the committee is ready pretty there's never been a consensus on that committee ever, on that steering committee, but there's been generally at the last meeting, the la one of the last comments that was made was, well, the council just needs to take charge of this and make it happen. Like, the council approved the study, the the money for a study for this group that wanted to study it. And I don't know that we ever, as a council, said, yes. We would like to have county wide recreation. Like, that was not a vote we took. We vote to say, yes. Go ahead and study it. If you bring us a proposal and if the people want it, then we'll support it. But

And what I thought you had said was we need time to inform the public on maybe what this looks like, you know, maybe renderings of the essentially, what the facility could look like. And quite frankly, I don't think November is enough time to do that. So I wouldn't support putting something on the ballot that quickly because I don't think it gives the public enough time to make an informed decision Will be and to then to take into the consideration the things no one mentioned. But but there are a lot of fundamental

issue that that really doesn't get addressed, Sandy, in that, and that is what what the fundamental discussion, as I understand it, is the county would bond to build these things, but then they're operated by the cities.

The county would have to have an interlocal or an MOU kind of a contract with who runs them. And and just how will you enforce that contract?

Yeah. I mean, I just fundamentally, somebody's gotta convince me that one person owning it and another person running it makes sense. I can tell you one thing, and that is if if our county government is not capable of taking on the 50 to a 100 employees that would be needed to run three centers, we we can do it. We we don't have the structure or the capability to do that. So you're dependent on building expensive facilities and having and and nobody talks about how much money it talks takes to run these. And when they do their projections, they talk about these dollars and those dollars. Well, if those dollars and these dollars don't come in, who's on the hook for three centers? I just have to tell you, somebody needs to get realistic about what a recreation center finance would look like. And, Betty,

I just don't see it yet. I've George, I am totally in agreement with what you're saying. I'm just saying this group that has been meeting, they were they put themselves together, made their own steering committee, and they've been meeting for a year and a half. They they took the money that we approved for the study, and they've been listening to VCBO. VCBO has drawings. They have contracts, contractor costs. They could give us everything needed to put on a ballot if that's what we decided that we want to do. But as far as going back and doing the new Show me show me a city that will sign on

to be responsible to us to to pay the payments due on a bond, on a recreation center. Show me a city that will sign their name to that. Yeah.

I just like to think to put an interlocal agreement I mean, because realistically, you'd have to figure it out by August to get it on the November ballot, in my opinion. So so we don't even have consistence con consensus here if we support one or two. So that I mean, that's the absolute lowest

baseline, and I'll I'll be real frank with you. Consistency support one or two sounds like one or two. There's a whole lot of people who say zero sounds a lot better than one or two. Sure. And and frankly, and and tell somebody I mean, North Logan keeps saying, why can't the county ever get anything done? We're gonna build it, and you're gonna operate, and we're on the hook for the money and you can walk. So, well, we'll sign an interlocal agreement. Have you ever thought about what it really means to enforce an interlocal agreement with a city that doesn't want to pay? Yeah. And I How do you do that? Do you get a judgment against it and go seize or fire engine that we own? Or do you what what do you actually do

to make them pay? And can we put an agreement like that together in a month and a half? I just there's no there's no way. So

I There is only one way to do it, and that is to have them be responsible on the bond. And I haven't heard any of them lined up to say we'll put our name on the bond.

In fact, there's several cities who already support a robust recreation program

like Smithville. Support of you putting your name on the bond. I I I tell you there's great support for that idea.

And I'm not pushing and have never pushed for a county wide recreation program. I'm just saying where that committee is, if you start to ask them to back up and let's appoint somebody there. It's they're called What

do we offer them, Sandy? I mean, what benefit having the county involved in this is there? Why why is that a good idea? There I think more people pay for it. Yeah. Oh,

woah. Yes. What do you know, Dan? Yeah. They don't know how to use it. They don't know how to use it. Multitude is out of use. I think that's one way to look at it. But another way is, like, why would you establish a county library system? Why would you establish a county wide waste management system? What well, for efficiency and economy of scale, and because most people don't even know where the boundaries of a city I ran for Logan City Council, and I still don't know the exact notches where North Logan starts and Logan ends. Like, the average person doesn't know, okay, I'm leaving Logan. Now I'm entering North Logan. No. They just look at, here's a rec center in the county that benefits all of us. And there's a lot of people who do want that as mayor. There's a lot of people who do want that as made manifest by the Okay. Study that's been done and the questionnaire that's been done. So I'm saying, if we're trying to be good stewards and represent our people who want something, let's give it the best shot and say, if you want it, here's how much it would cost. Here's where it would go. And really, I think it's only realistic to have one. I'll just go on the record saying that. So I think even if it's a hypothetical exercise of saying, look bored, you get one rec center, you get $50,000,000. If you want water slides, if you want that figure out what you want. Let's put it together. Let's show people pictures of it. Let's explain what other all the other taxes they're paying. Let's talk about how much it's gonna cost to maintain, and you can go in eyes wide open with this is what you want, and this is how much you pay. I think we owe it to our population to do that, and that's what I'm saying. And I'm saying, I don't think it's realistic to do that in two months. So if if we appoint people and they wanna reject that appointment, because they're so fed up on they're done with it, or Nibbly wants to say, I'm gonna just I know they have a, what, annual budget of $2,000,000, and for example, the the North Logan soccer facility is 70,000 square foot, and costs $6,000,000 ten years ago. If they, with their $2,000,000 budget, wanna say, we're gonna build something, they can build a $10,000 facility, and they can move forward on that if if that's their prerogative. But I don't think we put our best foot forward. I don't think we've had, equitable geographic representation. So all I'm saying is, let's give that a fair shake. And if people don't wanna do that, that's fine. But I am saying, this is how I would approach it, and I'm putting that proposal forward. So we actually are moving forward I I think with a plan. The idea to study it, a great idea.

And if we put it to a vote, all we've done is consider frustration because we haven't come down to what you said, who's responsible,

who's running. We have to figure that out. If I can speak up, because I I I'm kinda where George is at is one, there's a lot of legal questions here. So we're talking about interlocal agreements, and I I don't know how you enforce that. Like George said, I think that has to be part of what's being voted on. Caesar City offices. Caesar City offices. But but I think a lot of the issues that we've been dealing with in the county over the last ten years while while I've been here are where we've kind of the county has taken a lead on something and they kind of get stuck holding the bag. Yeah. And then you it's a convenient place for people to point fingers and say, oh, oh, look. If county's dysfunctional but, really, we're trying to to hold things together that were put on the county that really shouldn't have been there in the first place and responsibilities that that aren't there. And so I think we need to take this well and make sure that if the county is taking this on, we have everything in place that we're not gonna be stuck with a $100,000,000 bond and then operating costs in perpetuity for a building that's just sitting vacant because we can't afford to run it. I think

no. Keegan, I'm I go ahead. I don't have any objection to studying the issue, but I my vision for the county is to try and take selected things and do them well. And the airport is a huge responsibility that we've taken, and and it's it's a it's an opportunity with Blue Ocean in front of it. It's wide open what we can do with that. If we spread ourselves and our energy too thinly, we won't get anything done. I just from from what you the capacity you have in our government is somewhat limited. We don't have a large staff contingent to do these things. If if you go over and and look at the cities, they're better staffed than we are at the county at doing a whole number of things. North Logan, for example, is better staffed and more capable of accomplishing a goal like this than we are. We we have broad responsibilities that that we need to take care of. Anyway, I just I'm sorry to take enough time. I do have one thing I'd like to do if you have three minutes. I meant to have Kurt talk a little bit about what we think should be done with subdivisions and and a a study that we'd like to to do. Do you have five minutes to listen to that? Is it all in one city or what? No. It was it was a few individuals who decided they wanted this study, and they asked the county if we would fund the study, and they said yes. And they opened it up, said anybody who wants to come be a part of the steering committee can, and it was mostly two cities that showed up to be Which which two?

North Oregon and Nibley.

Oh. And Smithfield has been quite active just recently. I I was I just wanna make clear, I'm not advocating for to push this to put it on the ballot. I'm just saying the steering committee is pretty much to a point where they're I I just don't know. And and I I agree with what you're saying, Keegan. Like, if we're gonna do it, and I don't know that we should do it. I think that the role of of county government and I've said this all along. In every meeting I've ever been in, I'm here to just listen. And if anything goes to the ballot, it has to be spelled out to the penny what it's gonna cost people. And that was my contention all along is that whatever goes to the ballot, whenever it goes, it needs to be to the penny what it's gonna cost so that people make an informed decision. And I just I just think that they've they have never come to a consensus. You've been to those meetings. They there's never been a consensus. Well, if if we choose one location, then the other people are gonna vote no. If we choose two locations, Logan might vote no. It's it's kind of a mess. And maybe I I feel like sometimes, I feel like we as a county can do a better job of leadership in some ways. The economy of scale, fire, and public safety, we should be making that a priority. And and those are the kinds of things that that are very important to everyone to to have public safety and fire safety. I don't know if this is in the realms of what we need to do as a I don't know if this is the one project to take on as a whole county at the time. So Well, we we

we funded a $150,000 to study it. So I I sure hope we're not saying we shouldn't have done that in the first place. No. I think we absolutely did a good job of studying it. VCBO has done a great job, and there's some really good information

about logistics and demographics and what it would cost and what the construction cost would be and what potential locations are. They've done a really good job and answered a lot of questions for the people that are really, pushing to to have that information.

So I I I I think that the RAPS RAPS is supposed to be recreation, arts, parks, and zoo, and so it is part of what RAPS is for. And I think this absolutely was an appropriate use of RAPS money Yeah. And then with that information. And from what I understand, they're not the VCBO isn't saying, well, we've looked at it, and you guys really don't need it. Right? So Oh, no. I think they're saying, like, you I mean, they're saying you probably need three. I I don't agree with that personally. I don't think there's a financial appetite for that, but I do think it would be a shame if they said we recommend at least one, and we're like, cool. Thanks. Take our money and see you. It's like, I don't think our voters,

our people wanted that outcome. No. And and literally, it comes the bottom line is it comes to this council to say,

we accept your proposal. We will put it on the ballot. Yeah. So I think it's an opportunity for us to lead out. And so let's be leaders and make decisions. And sometimes that means offending some people. We say it needs to go here. Other people will say that's we're driving too long and but a decision needs to be made. So let's get closer to that.

Ready, set, go. Deputy county executive. Powder Mountain, you got the memo on that. I don't have all of the agreements yet. I'm a little frustrated I don't have them, but they are pending. We'll have them to you as soon as we can. So agreements, we've come to those agreements. They just need to be memorialized in writing. We'll get them to you as soon as we can. On subdivision issue, for the last month, we have about twenty five or thirty hours invested in just meeting with individuals and small groups to get ideas about what they're doing in other counties or how, how subdivision ordinances affect them. And just, it may result in nothing, but at least we're getting, we're getting in-depth, viewpoints from people who are involved in the development business and in the in the growth and we've had we spent time with Jordan. We took him to lunch and and got a lot of good information out of him. That's the kind of interviews that we're doing.

So if you got any questions Yeah. Kurt, I have a question. So how granular are you getting into, like, cross sections for the roads? Are we talking curb and gutter? Are we talking water? Is it Yeah. Everything? We're talking everything. We're talking about there are really two categories that is

we've been talking about the philosophy of of having growth be in the cities and how that looks. We talked we talked to cities. We talked to health, water, with that. Those are the kinds of discussions that we're having. And then the other the other pressure that we've got is then we've got our rural developments that are unincorporated, developments that are not being proposed next to a city. All of those things are being considered. I don't have anything to report to you. I don't intend to have anything to report to you yet. It's just We're just in the sit down and have discussions and get ideas. I've learned things I didn't and and heard ideas that I'd never thought of before. Things that are going on other places, that are really effective. We'll we just need to talk about those things. And in the end, hopefully, there'll be some recommendations. Maybe we'll get a a really good ordinance out of it. But in the meantime, those discussions are turning out to be really interesting.

We're we're trying to memorialize and so that we can give you some feedback on, but they may lead nowhere. I Kurt, I think the observation you made about what's causing pressure in the undeveloped in the unincorporated county was an interesting one. Why don't you just share that with them?

What we're finding is that the that the unincorporated areas, the more rural ones that aren't next to next to cities, the pressures aren't being driven by developers. The pressures are coming from the property owners themselves, and we just need. And we're having discussion on on Thursday with part of the planning commission with Nolan to discuss if those things we think those are the, those pressures are the same here as they're feeling elsewhere. Those are just the kind of discussions that we've had. I really hope that there's something that'll come of this and that we'll really like a solution, but we don't know for sure that it will come there. But I think without doing this and getting a feel for and getting in-depth feedback from stakeholders who are affected by, the ordinance we pass, I think that there's a there's a real possibility we'll come with come up with something good. Or if we didn't listen, we'd come up with something that was was harmful without realizing it.

Good. Oh, yeah. I I think that we're on such a cusp of growth that in twenty years from now, I want people to look back and think that we got something right, that we that we've managed that growth in a way that is still gonna be good in twenty years.
