Hey. We are gonna start our meeting. Thank you to everyone who's here. We appreciate your attendance, and we are glad to see you here. The opening remarks are by me. Let me take a deep breath here for a second. I just have been thinking so much with our the recent July 4 and America's 200 birthday. It's it's just been a really good reflection time for me, especially when I was in school. I studied the foundations of the constitution. It's something I'm really passionate about, and I just want to express gratitude for the country we live in and the freedoms we have. And I'm really, really happy that we live in Cache County. And with that, I will offer a prayer. You'll all join me. Our father in heaven, we are so grateful for the many, many blessings that we have, and we're grateful, father, for the opportunity that we've had to celebrate the birth of our country and for the great men who and women who fought so hard to give us those freedoms. We're grateful to live in this valley and for the beauty that we have and the neighbors that we have and the culture that is here. And we're grateful that we get to be a part of helping to govern and to make decisions that will help make this a better place for all who live here. We ask thee to be with us tonight. Help us to be kind and help us to have wisdom and thy guidance in all that we do and say. And we especially ask the father at this time when the world is in so much turmoil that that would bless the leaders of nations and states that they would be use wisdom and good judgment themselves and that that we might be able to find more peace in this world. I have a single matter, and it I'm gonna turn the time over to mister Webb to discuss the status of two of the interlocal agreements we're working on with Powder Mountain.

Kurt Webb, deputy executive. Two of the ones that we're working on currently are the agreement with the sheriff's office that's done on an hourly basis. It's been approved by both, Weber and us, and we just thought we would keep you updated. If you've got any questions on how that works, I'm open to that.

Do we have a copy of it that we can read and look at? Have you received that currently? We can we can distribute and will. Okay. Thank you.

The other one is the health department and and I can get Jordan to weigh in on this. We were we thought we would have it. By now, we haven't, have we? Do we have Weber's comments on it? Yep. We we've got it from the health department. We do not have it from Weber County. Council. Yeah. So that's all we're waiting for is for their approval. And that's on a fee basis. So it's not costing us anything. They're reimbursed for on a fee basis for the services they perform. We just recently got I'm extending this just to say for your information. We just recently got a proposed interlocal agreement from the development services department. Met just this afternoon with Eric and the, representatives from our development services department. We're not happy with what they've written, so, we will be working on that. Thank you.

The other portion is just to advise you that we had another couple of meetings with committees on the fire board and they're working through the various issues. There are a whole raft of issues still to be dealt with, but there is progress being made on that. We also received, Dane's opinion with respect to, the Nixon Nixon Gravel Pit. Sandy, I think you and I got the copy. I think it ought to be circulated to the members of the council. And Did I get it? Perhaps we'll want to deal with that in a, executive session.

I think that's probably a good idea.

I do know that when we met last when we had our appropriations and we discussed the the fire district and Nolan had some questions that you asked him to write down, I really like that idea because he had some of the same questions that I did that we've talked about. if if dealing with questions orally, Nolan, you you ask it and you you're not sure I've got the complete answer, and I'm not sure I've got the complete question.

Jordan Mathis, director of the Bear River Health Department. Here again to talk about the interlocal agreement. Hopefully, everyone was able to see the correct edits this time, and that was my fault. I apologize for that. But I will run you through real quickly those edits. I'm gonna focus mostly on the the major edits. There's some real minor ones. We just in section two on page three, we just threw in the date of when we became a multi county United Local Health Department. The United Local Health Department is important because that's one that gives us the responsibility to oversee behavioral health services. In in the last rendition, we outlined some some duties for behavioral health. We we failed to put in the public health duties. So that's what you're primarily seeing there is anchoring back to state code for both public health duties that are outlined in state code, and then we also expanded some of the behavioral health duties that are outlined in state code as well. Do you want me to read through those or explain any of those to you? Those are all really just linking back to responsibilities in state code.

because I'm gonna read something. I'd want something else that misread to me. So Okay. It's not bad time story. Alright.

That that is the biggest change right there as far as total number of words changed is is just really being clear on the the state code. In under section four in organization, section 4.2, we add two ex officio members to the board. One of those being the county executive for Cache County, where Cache County has a separate form of government so that we have both the the legislative and the executive branch representative for each county. And then where Utah State is the largest employer and also a huge community within our community, they're going to have an ex officio member appointed. In talking to the president and his office, they've decided to have the emergency manager serve that that function. So it'll be the emergency manager moving forward. And four on page seven, four fourteen, one, two, three, this was just a a minor change, but a really important one. That that last part that says as necessary. This keeps the door open. We learned a lot in our first year going through this process and contracting with Bear River Behavioral Health. It it allows for us to change that contract with them as necessary, as we deem necessary. And and without having to come back to the the governing bodies of each county, we it gives us some delegated authority to change those things as necessary. Then we did add an ex officio seat to the bay the what we call the BHAC, which is the Behavioral Health Advisory Council. Remembering that the Behavioral Health Advisory Council is to advise on the planning, organization, and operation of behavioral health programs. They act as a function of the county, of the counties. And and so that advisory council however, we found out as we started to to work on that council that the expertise on on the requirements and code for an area plan really did need Bear River Behavioral Health to be at the table in those discussions because they've been doing it for so many decades in our communities. And so we were kinda blind in a portion of that, And we need that expertise, but we also can't have them having a vote on the advice that they're giving back to the counties on how to run the programs. So, yes, they're gonna be in the conversations. They're going to have that. But the any votes on any advice that comes back to the counties from that advisory council will not involve a vote from them. So they will have an ex officio seat. And then

in

we just have the the requirements for the behavioral health director who you appointed last time. That individual or their designee will serve as the ex officio member of the BHAC. That was that's tied to the last one. And then the only other one that we felt was important as we've gone through from a fee for service model for substance abuse treatment in our area to a capitated model under Medicaid, that required the the department to contract directly with Medicaid. Whereas, Cache County was the one actually contracting with Medicaid before on behalf of the three counties under the former. It this delegates that responsibility for us to execute that contract with Medicaid. So that's what five two two two indicates is that we will take responsibility for for contracting directly with Medicaid for that and then communicating back to the counties what the Medicaid match requirement would be, and coordinating with

the three counties on that budget request for for us to meet that match. Jordan, do you anticipate because of the capitation and that change from fee for service that our 20% match might be higher? Or, like, what do you anticipate with that? We we think that they'll there may

so let me tell you in complete transparency. Right now, Medicaid is charging us more upfront because they don't have exact they don't have great numbers. And so we got some sticker shock when we first got the first bill. We fully anticipate that to level out and either stay where it's at or be right around where it's at. Possibly through a managed care model, the theory is through a managed care model, that you could actually see that go down because you're gonna weed out some potential non necessary treatment in the Medicaid system. So initially, I think we're gonna we're all gonna say, woah, the state's asking for a lot. What my understanding is in our conversations with them is they will reimburse us. If we overpay on the front end, then they reimburse us on the back end. But we were we were really I had a little buyer's remorse. I won't I won't lie. I'm like, did we do the right thing? And then when we got into it, they said, well, this should come back. And and really once we get some solid numbers, the the thing that we're struggling with is every other county in the state has been doing this for decades. And we're jumping in. They all experienced it when they first jumped in and were jumping in really, really late in the game. So I I'm anticipating that it actually will either level off or go down a little bit.

Well, no. I don't need to introduce myself, but Nolan said that didn't wanna muddy the water. I'm gonna muddy the water. I hope you're gonna do more. Rather than muddy. So, Sandy, you have

to make a decision.

That's why you wore a tie, so

So I have to give the state a response of what we're going to do as our percentage. And so in box number one on the left, So this is what all the other counties are doing as far as a percentage. And so you'll notice the Cache County, we're 85% title 8% title 7% title three. So if you wanna just be like everyone else, you leave it the same and we move on and then we get that money. But let me post some things that I've learned in the past couple of days. So SRS can be sometimes confused also with p with our PILT money. They're both given for by Sheena Goodsell from the State. So as we look though, highlighted in green on that box number one, there are many counties that do zero. Now, the reason that I would entertain that we would want to change from eight to zero is is that if you if you look on page two let's go to page two in the kind of the salmon color.

Right. Who you oh, you're gonna tell what secure

just give an overview of what SRS is. Right. And and and hopefully, we can get there. So it's SRS is the Secure Rural Schools Act. And if you have this training that was in your packet from pages 25 to 50, it gives a really good training on there. So if you have a chance, thank you, Andrew, for presenting that. It's much more thorough. But this is kind of the highlight type things that we have as a county to make a decision tonight so that I could respond if we're gonna change that percentage. So as you look, other counties are doing zero in Title two. And Title two is, if you look, special projects on federal land. Those have to be approved specially and distinctly. And in past, we've had Josh. I talked with, Matt, and we're not getting title two funds. So when we're earmarking 8%, we're basically giving it to nobody. Yeah. So my recommendation on our meeting today is is that we change that 8%. And if we give a raise, proverbially, title three is county funds. And if you look on page three, those are typically going to our search and rescue type stuff. So that's whether you choose as the county elected official to send those to search and rescue, or if we choose to move them over to title one, which is typically roads, which I've highlighted and circled, which we have a big expense, and our expenses are always bigger than any money that we get, I would recommend that we move that 8% from getting nothing to getting something. That's what my whole output that we're trying to do. So if you like averages, we could leave it where it is. My recommendation is you move it one way or the other. In the middle of page one, it just talks a little bit about what it is. So these are forest service, and it's money that comes on a seven year rolling average. So it's collected from forest service. And this is a copy from Sheena, which is from the State of Utah, which is estimating what next year's amount is. So 287. If you look at that page on 25 to 50, you'll see that there is one county that has an estimated nineteen oh eight, 25%, which is, some not some of I can't remember where it is, perhaps. But anyway, they get a huge amount, but we don't have that option. So it's not an option. There's your $300,000 total number, Sandy, that you're talking about, but half of it is already being distributed to the school district and then half of it goes to the county. So the the election that we choose tonight will be the distribution that we'll get next spring. That's an important component. But the PILT funds, not to confuse or muddy the water, will be money that we're gonna get, which is payment in lieu of taxes. Those will be coming at the end of this month. So I'm trying not to muddy but separate. These funds that we're talking about first are monies that we're gonna get next spring. That's approximately $287,000. So, again, the reason for the timing of that, I think, is important is when the federal government's fiscal year is, So that's why they we have to make these. And we don't have a Josh that's doing that. We don't have a Matt that is really understanding. So my recommendation stands. I think you need to have a discussion on whether we move that first over or to the right or the left. The other thing that Sheena taught me is the state and the government can sequester or hold back about 5.7%. So that's where there are always estimates. I apologize directly is not spelled the way I've got it and there should be a closed parenthesis. It was late this night, last night when we when I kinda worked on this. Page two. So PILT, just to bring information rather than a PowerPoint, now you got something you can take. So these are our PILT monies. So it's not really directly the SRS and stuff, but these are the monies that we've got in box two for the past since 2021. Notice that it's been about a 100 and, you know, 7% of four percent of 4% of 3%. It's declining. So I just estimated that our PILT money, for this year will be about 28,000. We don't know yet. They don't know yet. Sheena didn't know yet. She's still gathering information. Back to the first thing, again, roads is important. And so I would encourage that we think about roads. And then on the right side are the actual funds that we've received historically since 2022. Notice no title two. So I think we're giving those away if we allocate that. So page three, if you're interested, I've kind of covered it, but page three is just talking about where we as the county have used those. And you notice in the box on the right, our our we always have more road dues than what we're doing. So information, my recommendation is that we have a discussion whether we move that 8% either to title one or title three, and I would start that as a discussion if you guys could have that, please.

Craig, you said we don't have the option of going back to the nineteen o eight original allocation. How come is that?

Okay. Original allocation. How come is that? Because I know some some counties do. There's only one county that does. Only one? Okay. Only one. And I think that was a decision that was made a long time ago. Okay. It's it's a it's you could either do all or none, and and we we want some money because this is well over 100 and somewhat thousand dollars. And also, before we start the discussion on what to do with that money, I just wanna say that this was something

that was a big discussion at NACO when I was at NACO in February in Washington, DC, because the federal government had withheld SRS money for a couple of years and NACO lobbied and got them to release it from '24. And and so they're trying to make it be something that's ongoing, but for right now, they reauthorize it every year. And and NACO's pushing pretty hard to get the counties so that you can rely on that money.

So Again, if you wanna go more in-depth, you can go to that training that's that's 25 pages that I'm sure you all read. Mhmm. But it's good. It is actually good. Mister Gettle.

So two questions.

How did the eight get entitled to? And if we decide to change it now, does that stand or we gotta do that every year? Each year, Sheena will send me an email. It just changed that they allowed that allocation in the last couple years. She didn't know when it changed, but she concurred saying that because I asked that direct question, are we just losing money? And she says, I would move it over. So I think So if we move it, that will stand going It will stand for this year, and then that would be the going one that would come forward for next year is what we have done in past. Yes. Okay. My recommendation would be title one. One of those.

Okay. I did look at this PowerPoint too. I have a question about it. This might be the most jargony, acronym laced presentation in the span of a few minutes I've I've been a part of, but it does say if the county share of the state payment is more than 100,000, but less than $3.50, that's where we are. Right? Based on the estimate. Yes. It says the county must allocate 15% to 20% of its share to title one, two, or three, or a combination

or sorry. Just title two and three, or a combination of both. And then it says the total percentage allocated to two and three must be no less than 15 and no greater

conversation with Sheena, and that's why table one, that and that is what's very different. There are some places, Grand, that are doing a 100%. Carbon that's doing a 100%. Davis is doing a 100%. So So is this actually a rule, or is it a guideline? I I I didn't write Tell me I didn't read this for nothing. I'm I'm glad that you read it because you brought more information because that's why I called Sheena several times to ask those questions. But she was the one that gave me the recommendation that if you're leaving it in that middle, you're just throwing the money away. Yeah.

So what it looks like is that the other counties are adding those two together and putting them in title three,

which which is where you're getting that title three. But again, there are other counties that are doing a 100% and none. So that's where I wanted to give you what other counties you're not on an island making this decision. Right. I think 93 is not a 100, but I think that's a safer bet than going I think I I think going title three to zero would be a mistake. I think search and rescue, I I appreciate the the those services, but I think we have a I always hear us talking about roads.

Yeah. Mhmm. Nobody has a 93. Does anybody want to only a 100. No one has 93%.

You could be the only one. For special anyway. And and you're you verified with Sheena that we can do that. She said that we do not have to she said, I just we need the county to give an election of what the county wants to do. Okay.

And I've also discussed with Matt Phillips and also with Britney. And I think from the auditor and the finance, we need to also look into this a little bit further. Because page three, the PILT was being confused, and so I think there's always some good things that we need to still learn on this too.

So this will be a bit confusing to explain, but do bear with me. So three weeks ago, the council, Appropriations Committee met and decided on an original amendment. So that was the version that was posted, and publicly noticed. That's the one that is available in resolution twenty twenty six dash 21 tonight. However, yesterday, the Appropriations Committee met again in a special meeting. Essentially, the amendment that's before you in 26 dash 21 is now moot, and both me and if I would like to also say the auditor would like to recommend that you don't pass twenty twenty six dash 21 because the resolution you just set a hearing for would contain the updated amendments. And the reason why you can't just pass the new amendments tonight is Utah state code under title 17 says that you have to publicly notice the budget amendment for five days, and we haven't done that. So long story short, don't pass twenty twenty six dash 21. I would just wait until two weeks from now to do 24.

So we will not hold the public hearing tonight on that, or do we still need to hold the public hearing?

Well, if you want to consider or vote down twenty twenty six dash 21, you would still need to hold the public hearing as a formality. Or at least that's what I would recommend Okay. Even if it is ultimately moot.

Because that's what the public was noticed, so therefore, they have the right to comment on it. Correct.

We got that passed. K. Eight c, I'm gonna turn some time over to Andrew to talk about the, resolution twenty twenty six dash 25.

Alright. Good evening, council. The resolution before you is resolution twenty twenty six dash 25, establishing the Cache County Regional Recreation Center Feasibility Study Committee to oversee and direct county wide recreation initiatives. Quite a mouthful. So a little bit of background and the resolutions objectives. So the proposed resolution itself would establish an internal legislative study committee of the county council. It would to essentially guide how discussion and what the county has hired for consultants so far regarding study initiatives for a county recreation system. So Cache County entered into a contract in January 2025 with VCBO. I'm not sure why there was random bolding in my presentation. I apologize. This came as a result for more of a community demand for indoor pool and turf activities as well as other ancillary recreation activities. It was coupled then with the then announced closure of the Logan Recreation Center, but some situation has has changed with that. But, anyway, essentially, this resolution will put together a specialized committee that would direct the consultants that we've hired up till this point. It's been rather a bit of an ad hoc committee, and it's made some progress. And I'm I'm not trying to discount that by any means. This would just be formalizing things and essentially setting a goal, a structure, and and going from there. But, yeah, looks like my PowerPoint did not convert over rather well, so I apologize. So under this committee, it would direct VCBO to essentially who are essentially doing that, the feasibility study and give input to them. This would evaluate what the county's needs are, what its current facility pass capacities are, for its multiple, mostly city facilities, the physical constraints and and long term, factors of of a county wide recreation model. And the committee would also be charged with the objective of delivering a feasibility report. Specifically, VCBO would be the one putting the report together, but ultimately, this resolution would outline specifics such as things like a potentially estimated budget, some potential locations, what what a countywide recreation system would even look like. So this is all very preliminary. This is not saying the county is going to establish anything right now. Again, this is all just preliminary study. The committee itself would have a a defined composition. So there would be one to three county council members on it. No more than two of the members can represent any portion of the county seat. That way, we have at least one council member. If there is two or three, then there's at least one outside of Logan or in the event there is three. I apologize. But then there would be advisory members. This would be split up geographically so that the whole county is involved. One would be from the county seat, which in this case is Logan, one from the unincorporated count area of the county, two from municipalities of the North north of the county seat, and two from municipalities south of the county seat. So that way you have a a good geographic mix. The duties and procedures of the committee itself, committee would select a chair, perform all other duties as needed, assign, how do I say it, elect other officers and go from there. The meetings themselves would be open to the the public under the o p OPMA. And, again, the role of this committee is strictly limited to investigative advisory and planning activities. This would not be taking official legislative act action, from this committee. And at once the committee would be established under this resolution, the committee would give regular progress reports to the county council. But, ultimately, its deadline to deliver a finalized report would be at 03/21/2027. So there is some some timeline to this instead of wind up, let go, and hopefully something comes back at some point. So, anyway, does anyone have any questions or concerns?

Does this resolution

outline the appointing authority? Like, who appoints those members? I I did not specify that. So since this is a internal legislative committee, I felt that it was most appropriate for the county council to appoint via resolution the members of the of the committee because this would not technically be executing the business of the county in the way that, say, like, the planning commission does. This would just be something for the county council to be advised on.

I'll just mention that I had some people talk to me today who felt this was something the council was doing to set there was gonna be a recreational scene, and there was concern about taxes and everything else. the money that funded the study was approved from RAPS tax. This was before my time on the council, which which the r stands for recreation. So this is money that's specifically allocated for this that has already been allocated to a study. I think the purpose of this is just to provide more clarity and direction for the group that was hired to do the study, so they can have geographic representation in the advice that they receive.

And hopefully, more clarity as it comes to it. Like we talked about, who's responsible? Yeah. Who's gonna

And so, I think it's important to recognize their efforts are appreciated, and it has advanced it forward. But I think it has more more weight if this group of people is officially appointed by the council and its representative. So I think that's just the next step to formalize it.

may be taken. And I I wanna say that I support this because I've been a part of that ad hoc committee, and it's been hard to come to any conclusions. And partly because there's no clarity about who's a voting member of that like, who's gonna help make those decisions. And I think this will clarify for VCBO. It'll be a group that can say because they don't know which direction to go. They they're they were hired to give us a recommendation, but they're they need some direction. So I I would support this the formation of this committee. But we need to take a motion on that because it's a resolution. Or and this is the first reading of it if you want to continue it.

So I thank you for excusing my absence for the last council meeting where I was out of town. But there will be a more formal presentation on that visit coming through the county's economic opportunity advisory presentation. So I'll save that for later. So the one thing that I did want to report or talk about tonight is three, four weeks ago, maybe. Don't remember the exact date. But, anyway, it was the kickoff meeting for this year's round of outdoor recreation initiative applications in that process. State, it's through the state grant program for regionally significant outdoor recreation projects. Cache County had multiple projects that were beneficiaries of that program last year. Kick off meeting was good. There was announcement there's a bit more funding available this year. And the period the application period opened on the fifteenth, Or opens on the fifteenth tomorrow, and, goes to September 15. So look for some discussion mostly led by Landis at this point for some of the things that Cache County would specifically look at as well as, other communities in the county will probably be bringing up some information to one or all of us members of the council to consider. But in the North Region, you know, we're one of multiple counties that are will have submissions for this funding. But this is a great way to, at least my perspective, a great way to enhance what we can do with some of the open space properties that are out there as well as long term plans with some of the projects we've talked about, like the Coldwater Ranch Road Mhmm. And others. So this is a good opportunity for us to work with. His land is taking the lead now. He he is as nature of he and I are both members Okay. Of that committee. So, yeah, he and I will be working on it, but where it's, his opportunity for it to be a day job, he will be leaving it most of it. Yes. And, that's it.

So last Thursday, planning and zoning, Short term rentals were brought up for them to make a policy on. There's a lot of questions. There's also the subdivision thing. So I offered that maybe we could have a workshop on that so that we could help them with what the council is thinking so that it doesn't sit like a ping pong come back and forth on us on the short term rentals. So that's something to think if we wanna do that as we try to help the planning and zoning come up with some areas on the short term rentals and also the subdivisions so that we align what we would like to see there.

I think that's a good idea.

Mark talked a little bit about the little bit about the economic opportunity board, but was it state law that's restricting elected officials from being on that board now? So that was probably our last meeting.

So, It's pretty blunt. Well, I'm leaning on that this body has always liked to be in tune and aware of all the things that are coming for us requesting funds. And this now pulls us back from that a step, which, you know, there there's some good reasons. There are pros and cons. But There's still public meetings today. Yes. It's all very public. It's all very open. And so that'll be fine. But that also means that we will be receiving a well, we will have the opportunity to make wholesale reapp or appointments to that board because now everybody's terms are up or Keegan and I have been pulled out. So that'll be coming in the future meeting where there'll be a request for, appointments.

Yeah. And I guess that's just to segue off that. There are a few boards that we wanna consider names for. Airport Authority Board, Economic Opportunity Board, and then the recently established recreation board. So, should probably come with names

Well, I have a kind of a question.

Why does this budget amendment keep coming up every month? Can you explain that? I'll try, Joanne. And then and Andrew can help me. The way it's set up is that we we do a budget amendment once a quarter. We're supposed to do one once a quarter. If there's anything that deviates from our budget, we will consider it once a quarter. In the past in the past month or six weeks, there have been some things that have come up that such as the what was the one that we had to vote on the last time that was oh, there was one budget opening that we did. It was money that Matt needed to do something and we had to discuss it. There was a time there it was time sensitive. I can't remember what it was. I don't know what it was. Anyway, so we've had recently some things that have come up that there were some things that the executive things that were brought to the attention of the Appropriations Committee, things that were time sensitive that had been budgeted for that we needed to make a decision on. And so this is unusual to have this many budget openings and to and it it has been confusing. And so, hopefully, by the twenty eighth, we'll get that cleared up. The regular budget opening for this quarter is set to happen September. We're not due to have a regular budget opening until September again. And that hopefully will get back on track to that once a quarter budget opening. So I thought the budget was an annual thing where you The budget is an annual thing, but once we set it for the year, if something deviates at all from that for during the year, it has to be done in a budget opening and approved by the full council. So I think maybe an example that was there's was some expensive equipment that failed that needed I don't know if I remember if it's a printer or something, but

it needed to be replaced. So and that had to be expedited.

We also adjust our revenues as we get our tax. We do, estimations, really good estimations when we make the budget. But as we get those tax actual hard numbers in, then we get our revenues and we put those into the budget too. Oh, okay. Yeah. And and, hopefully, we'll get back to just doing that once a quarter.

This is a little messy right now, but we'll we'll get past it and, hopefully not be too confused.

We had a meeting of the Criminal Justice Coordinating Council here in our county and there's some some good things happening with the health department. We're gonna we're hiring a caseworker to help with the warm handoffs to people who are exiting the justice system. I think we're gonna be able to make a real difference here in our county. Last time in the appropriations meeting or not appropriations when Catherine and I met with the executive Monday, we talked about our budget timeline, and I think he's gonna clarify that with the auditor where it's time to start looking at the things that we need to to pass the next year's budget because we're all happy about that.
